What is the Ethical Dilemma/Issue in this case?

On the point of view of Bert, he is in situation in which a difficult choice has to be made
between two courses of action. The issue in this case is, if he will follow what Carlos says just to
ensure that the job will come in under budget even though it is against the employment policy
or Bert will report this issue on the top management since it is against the employment policy.
Who is affected and how are they affected?
In the first place, if Bert reports this problem to the company management, Carlos will
have a major impact on his reputation because he was violating the employment policy just to
achieve the assignment. There’s a high possibility that he will fired from the company.
However, on the other hand if Bert decided to not report this issue it will be a burden for him as
an employee since he is not properly compensated and working beyond the working hours.
If these are Bert’s available alternatives, what are their likely consequence?
• Refuse to work the additional hours
There’s a high risk or possibility that Carlos will fire Bert since he was not following
Carlos on how they will able to make this job under budget. Carlos will be mad since they are
not following the order.
• Perform in the manner requested
It would be good on the part of Carlos since he was able to make the job under budget,
however on the part of Bert it will not be good because they need to work overtime.
• Inform Carlos that he will charge the additional hours worked
The firm or the job will have an over-budget if it happens. Carlos will be problematic
since despite all reasons, he has not been able to make it under budget. However, Bert will
benefit because while he has been working overtime, he is properly compensated.
• Talk to manager or partner about Carlos’ request
It will be caused negative on the part of Carlos since the way he managed the job is
inappropriate which violates some employment policy. It will make the reputation of Carlos
bad. But on the part of Bert, it will be helpful for him because the company will conduct
changes on how they should work on that job.
• Refuse to work on the engagement
If Bert refuse to work with Carlos, there’s a high risk that they will not be able to make
this job under budget since they will not have enough people who can work with this.
Moreover, Carlos will be mad to Bert since he refuses to work with him. But Bert will be on a
good position since he doesn’t need to work overtime just to make sure that the job will be
achieved.

• Quit working for the firm


If Bert decided to quit working on that firm, it will be good for him since he would not
be able to experience to work overtime. On the part of Carlos, it will be challenging because he
loses one people who can work with him just to make sure that the job will be under budget.

What is the appropriate action?


Personally, the correct action is to refer this matter to the top management because it is
not good or healthy for the employee to work overtime. It will be quite challenging for them to
manage and complete their job. The fact that the employee doesn’t have the means to
complain to Carlos Reyes because he’s, their boss. Moreover, for the sake of the company and
employee they can fired Carlos Reyes and find another one since the way he handled the
situation is not actually good most specifically on the part of the employee since they are the
who shoulder most of the responsibilities under the supervision of Carlos Reyes. While Carlos
Reyes' intents are for the benefit of the firm, regardless of the situation, we must not break any
company's employment policy so that the connection between employees and the company is
better and stronger.
