We, the above named Panchas, on being called by the officers of Customs and Central Excise
presented ourselves at the main gate of M/s Raj Kesari Metals Pvt. Ltd F-307, Road No. 12,
Mewar Industrial Area, Madri, Udaipur at 10.00 hrs. on 28.11.2019. At the premises Shri Rajpal
Moond Inspector, Shri Dileep Kumar, Superintendent and Shri P.S. Detha, Superintendent was
present with Shri Sanjay Darda and Shri Subodh Sharma. The proceedings which were halted
on 27.11.2019 was requested to be continued by Shri Sanjay Darda in front of the Panchas. The
Customs officers then again requested us to be Pancha/witness for the search proceedings of
28.11.2019 and to which we agreed. Thereafter a person came and introduced himself as Shri
Pratap Darda and also mentioned that he is another director of the firm. The Customs Officers
then showed search warrant number 106/2019 dated 27.11.2019 issued by Customs (Preventive)
to Shri Pratap Darda and they explained how the search proceedings were initiated at M/s Raj
Kesari Metals Pvt. Ltd on 27.11.2019 but the search was not concluded because of the dark at
night and thus search is being resumed on request of Shri Sanjay Darda. Shri Pratap Darda after
the perusal of search warrant number 106/2019 has put their dated signatures on aforesaid
authorization and requested the Customs officers to resume the search process. Thereafter the
Customs officers showed us the paper seal of the room which was sealed on 27.11.2019 and
removed the seal and the records stored in the room were found to in the same condition when
the room was sealed.

The search proceedings were then resumed and firstly the remaining domestic marble blocks
were taken into record. Each block of the marble was measured by its height, breadth, and width
and then each block was marked with a marker and 15 domestic marble block were taken into
stock and these are exhibited in Annexure- B1. The Customs Officers after that started to take
into account the marble slab made by the domestic marble blocks and they found total stock of
5019.29 square meter which is exhibited in Annexure- C.

During the search proceedings, the Customs officers asked Shri Pratap Darda to open his e-mail
account and then he opened his account through Microsoft Outlook. The officers checked the e-
mail account of Shri Pratap Darda and then took printout of few e-mails. We the Panchas, Shri
Pratap Darda and Shri Sanjay Darda has put our signatures to the aforementioned printed copy
of the emails and 28 pages of e-mail has been attached to the Panchnama.

During the search proceedings, Shri Sanjay Darda in front of the Customs officers stated that
his father is unwell and thus he is required to be present with him to look after him. Shri Sanjay
Darda also mentioned his father has undergone brain tumor surgery recently which has led to
frequent fits and thus he will not be continue with the search proceeding further. Shri Sanjay
Darda requested to the Customs officers that rest of the search proceedings to begin from the
next day 29.11.2019 and he also mentioned that there is arrangements for the officers to sleep at
the premises and thus they can sleep at the premises for one night. The Customs officers agreed
to the request of Shri Sanjay Darda and thus the Officers requested us to be present at the
premises of M/s Raj Kesari Metals Pvt. Ltd F-307, Road No. 12, Mewar Industrial Area, Madri,
Udaipur next day at 10:00 hrs. We the Panchas agreed to this. The Customs officers’ paper
sealed the room in front of the Panchas where company records such as bill of entry, shipping
bill, computer system, import-export related data, and other manufacturing related data were
kept.
The Panchnama proceedings was commenced at around 10.00 hours on 28.11.2019 and it
concluded on the same day at around 23.00 hours. Nothing untoward happened during the course
of search proceedings. No damage was caused to any person or to any property and no religious
sentiments were hurt. During the proceedings the behaviour of the Customs officers was
controlled and calm. After the proceedings concluded the Customs officers themselves for
personal search which was politely declined by Shri Sanjay Darda.

The Panchnama containing pages 1 to 3 has been typed on the laptop carried by the officers. The
Panchnama which is typed and printed through laptop is made by Shri Rajpal Moond and it
contains true and accurate information. We Panchas and Shri Sanjay Darda and Shri Subodh
Sharma were present during the whole process of search and we are satisfied with the manner of
search. We the Panchas and Shri Sanjay Darda and Shri Subodh Sharma has put our dated
signatures on the printed Panchnama without any fear, threat, or coercion.
