POSITION

on holding an open competition for the development of the concept of the architectural appearance
of the memorial complex

"Defenders of Sevastopol 1941-1942"

1. General part

1.1. These Regulations on holding an open competition for the development of the concept of the
architectural appearance of the memorial complex

"Defenders of Sevastopol 1941-1942" (hereinafter - the Regulations) set requirements for the
organization and conduct of an open competition for the development of the concept of the
architectural appearance of the memorial complex

"Defenders of Sevastopol 1941-1942" (hereinafter - the competition).

The competition is held in order to identify the best architectural and artistic solutions of the
memorial complex "Defenders of Sevastopol 1941-1942", the construction of which is provided for
by the federal target program "Social and economic development of the Republic of Crimea and the
city of Sevastopol until 2025", approved by the decree of the Government of the Russian Federation
dated 11.08. 2014 No. 790, the state program of the city of Sevastopol "Development of culture and
tourism in the city of Sevastopol", approved by the decree of the Government of Sevastopol dated
07.11.2016

... The terms used in the Regulation have the following meanings:

1) competition - a form of creative competition, the purpose of which is to identify the best
architectural, design, artistic solutions developed in accordance with the criteria, conditions and
other regulations established by the competition documentation;

2) the competition commission is a temporary body for the technical organization of the
competition;

3) application for participation in the tender - a written application of the person (persons) wishing
to take part in the tender, drawn up in the form established in the tender documentation
(hereinafter referred to as the application);
4) participants in the competition - individuals or legal entities (authors and groups of authors) who
submitted an application registered by the organizer of the competition;

5) the winner of the competition is a person who has been awarded a stipulated award by the
decision of the jury of the competition.

6) the jury of the competition is a group of persons whose powers include determining the best
competition projects from among those submitted for the competition, the awarding of awards to
their authors, as well as the distribution of awards between the winners of the competition
(hereinafter - the jury);

7) tender documentation - a set of regulatory source documents and materials prepared by the
tender organizer required for the development of a tender project, as well as the program and
conditions of the tender;

8) competition program - an integral part of the competition documentation containing information


about the competition organizer, type, name of the topic, subject and objectives of the competition,
requirements for competition projects, initial data for the preparation of competition projects;

9) competition project - documents and materials submitted by the participants of the competition,
developed in accordance with the competition documentation. The competition project is drawn up
and submitted to the organizer of the competition as part of the application;

10) competition secretary - an official of the competition organizer who is entrusted with the
functions of the secretary of the competition commission and secretary of the jury without the right
to vote.

2. Organizer of the competition

2.1. The organizer of the competition is the Department of Architecture and Urban Planning of the
city of Sevastopol (hereinafter referred to as the Department).

2.2. The financing of the costs associated with the competition is carried out from the budget of the
city of Sevastopol.

2.3. The organizer of the competition is responsible for the implementation of activities related to
the competition, including the development of competition documentation.

3. Competitors

3.1. Authors or groups of authors can take part in the competition. A participant of one group of
authors cannot apply for participation in the competition individually or as part of another group of
authors.

3.2. Participants of the competition cannot be representatives or employees of the organizer of the
competition, members of the competition commission, the secretary of the competition, members
of the jury, as well as persons directly related to the members of the jury in connection with their job
duties.

4. Organization of the competition

4.1. The tender documentation, as well as the composition of the tender committee, are approved
by the order of the Department.

4.2. For the implementation of activities related to the competition, the competition committee:

1) places an announcement on the holding of a competition;

2) organizes the registration of applications;

3) ensures the provision of premises for the work of the jury, reception and temporary storage of
applications and competition projects;

4) refuses to register the application if the written part of the application does not meet the
requirements of the tender documentation or the tender project is missing in the application;

4.3. The announcement of the competition must indicate:

1) the conditions stipulating the essence of the assignment;

2) the timing of the competition;

3) deadlines for accepting (submitting) applications

4) the name of the organizer of the competition;

5) the terms and procedure for announcing the results of the competition;

6) the size and form of awards to be awarded to the winners of the competition;

7) the timing and procedure for payment of awards to the winners of the competition;

8) conditions, place and terms of registration of applications for participation in the competition;

9) the procedure and criteria for evaluating the competitive project;

10) a link to the Internet resource on which the Regulations and tender documentation are posted;

11) requirements for the language of presentation of documents;

12) address and telephone number for inquiries.

4.4. The announcement of the competition is posted on the official website of the Department on
the Internet at: https://dag.sev.gov.ru/, taking into account the time required for registration of
participants, but not less than 45 calendar days before the date specified in the announcement
summing up the results of the competition.

4.5. The organizer of the tender may make changes to the tender documentation during the first half
of the deadline for the submission of applications.

In the event of an extension of the deadline for submitting applications, the organizer notifies the
participants of the competition no later than 10 days before the previously established deadline for
submitting applications.

Notification of the changes made to the tender documentation is posted on the official website of
the Department on the Internet at: https://dag.sev.gov.ru/.

4.7. Competition projects cannot be published anywhere until the winners of the competition are
determined.

5. The procedure for filing an application for participation in the competition

5.1. The application must be in two separate parts:

- the written part of the application, drawn up in the form established in the tender documentation;

- a competitive project in the form of drawings and other graphic and text materials that reveal the
creative intention of the author.

5.2. The competition project must be submitted in the amount and in the form established by the
competition documentation. Additional materials to the project can be provided at the discretion of
the participant of the competition.

Making any additions / corrections to the application after the registration of the application is not
allowed.

5.3. If a competition project is developed by a team of authors, the participants of such a team
(individuals and (or) legal entities) submit one application for participation in the competition and
are considered one participant in the competition. Such an application must be signed by all
members of the group of authors and contain requisites for listing the awards of each of the
members of the group of authors.

5.4. Submission of an application is allowed in any way that ensures its receipt by the organizer of
the competition in full within the prescribed period.

5.5. Applications are deemed to have been submitted on time if they are received by the organizer
of the tender not later than the date and time of the deadline for accepting applications established
by the tender documentation.

5.6. Applications received by the organizer of the tender after the expiration of the time period
established by the tender documentation for accepting applications are not registered and are
returned to the sender in the manner and within the time frame established in clause 8.3 of the
Regulations.
5.7. Members of the competition committee ensure the safety of applications for participation in an
open competition, as well as competition projects.

5.8. If at the end of the deadline for submitting applications for participation in an open tender, only
one application is submitted or no such application is submitted, the tender is declared invalid.

6. Awards for the participants of the competition

6.1. The size and form of awards paid to the winners of the competition are established by the order
of the Government of Sevastopol dated 01.11.2021

No. 174-RP.

6.2. The organizer of the competition may establish additional forms of awards for the participants
of the competition - certificates of honor, diplomas and other similar types of encouragement.

7. Organization of the work of the jury. Evaluation of competition projects

7.1. The personal composition of the jury is approved by the order of the Governor of the city of
Sevastopol.

7.2. The work of the jury members is free of charge.

7.3. Before the start of the consideration of the competition projects, the secretary of the
competition informs the jury about any discrepancies found in the received applications.

7.4. The jury meetings are considered competent provided that at least two thirds of the jury
members participate in them.

7.5. The jury determines the winners of the competition based on the number of points awarded to
each competition project. The procedure for determining the winners of the tender is determined by
the tender documentation.

7.6. If several competitive projects are awarded an equal number of points, the winners of the
Competition among the participants of the Competition, whose competitive projects were awarded
an equal number of points, are determined by open voting by the jury, with the vote of the chairman
of the jury decisive.

7.7. Until the results of the competition are announced, the jury members have no right to disclose
information related to the consideration of applications and the awarding of awards.

8. Summing up the results of the competition

8.1. The results of the competition are documented in a protocol on the results of the Competition,
containing information on the number of points awarded to each competition project; information
on the awarding of awards to the winners of the competition; if several competition projects were
awarded an equal number of points - the results of the jury's voting and the jury's decision on the
distribution of awards among the participants of the competition. The protocol on the results of the
Competition is signed by the chairman of the jury and all members of the jury who took part in the
meeting.

8.2. Information about the results of the competition, the procedure for receiving awards awarded
to the winners must be published within a month on the official website of the Department on the
Internet at: https://dag.sev.gov.ru/. The publication of competitive projects is carried out in
accordance with the procedure established by the competition documentation.

8.3. The organizer of the competition ensures the storage of competition projects during the period
of the competition and within one month after the publication of its results. After the expiration of
the specified period, the competition projects that were not awarded and were not previously
claimed by the authors are returned by the organizer of the competition to its participants by
mailing cash on delivery to the address indicated in the application for the return of the competition
project contained in the application.

9. Copyright

9.1. Within a period not exceeding thirty calendar days from the date of publication of information
on the results of the competition, the winner of the competition transfers to the organizer of the
competition in full the exclusive right to the result of his intellectual activity, by concluding an
agreement with the organizer of the competition on the alienation of the exclusive right to the
competition project as a result of intellectual activity (hereinafter - the contract), while the
remuneration for the acquisition by the organizer of the competition the exclusive right to a
competition project as a result of intellectual activity is established in the amount of the award paid
to the winner of the competition, and the amount of money paid as a reward (premium) is counted
towards payment of remuneration for the acquisition of an exclusive right by the organizer of the
competition. The form of the contract is established by the tender documentation.

9.2. The organizer of the competition has the right to use the results of intellectual activity received
from the winners of the competition for any purpose, transfer them to third parties and disclose the
data contained therein without the consent of the winners of the competition. The exclusive right in
full to all the results of intellectual activity, as well as the right to obtain patent or other protection in
relation to intellectual property (where applicable), produced within the framework of the
competition, belongs to the organizer.

9.3. The winners of the competition by the transfer of competition projects, other documents and
materials developed in accordance with the competition documentation, guarantee the organizer of
the competition that from the date of such transfer:

1) the possession of the exclusive right to intellectual property and (or) its use by the organizer does
not violate any intellectual rights or any other rights of third parties;

2) the use of intellectual property does not require any license, authorization or permission from any
third party or the payment of any remuneration or other amounts to any third party;

3) no intellectual property contains, does not use or will not contain or use any confidential
information or any intellectual property created by third parties or owned by third parties;

4) the guarantor has not entered into any transactions for the permission or use in any other way of
intellectual property or other transactions that impede or otherwise impede the possession, use and
(or) assignment of rights in relation to intellectual property or any types of property created on its
basis.
