NATIONAL GRID CORPORATION OF THE PHILIPPINES V. RHH

REALTY AND DEVELOPMENT CORPORATION

SPECIAL CIVIL ACTION NO. 58

FOR: EXPROPRIATION

June 28, 2017

Consignation has been made by the Plaintiff National Grid Corporation of

the Philippines (NGCP) before the RTC-OCC Region 02 in the amount of One
Million Four Hundred Thousand and Forty Pesos (P1, 400, 040) and Ten Thousand
Six Hundred Pesos (P10, 600) before the RTC-Tuguegarao.

July 18, 2017

The Plaintiff NGCP has filed a “NOTICE TO TAKE POSSESSION”

before the RTC, Branch 10, Tuguegarao City informing the Court that pursuant to
Sec. 6 of RA 10752, the plaintiff will take possession and control over the
properties of the defendant RHH Realty and Development Corporation subject of
the special civil action on expropriation; that the affected portions to be
expropriated will be for the use and benefit of the public through Transmission
Line Project; and that NGCP will immediately enter the property and commence
work on the said project after it secures a Writ of Possession from the Regional
Trial Court.

On the same date, a NOTICE OF ENTRY OF APPEARANCE OF

COLLABORATING COUNSEL AND URGENT EX-PARTE MOTION has
been filed before the same Court by the Plaintiff NGCP praying that the plaintiff
be allowed to take possession of the property sought to be expropriated and start
the implementation of the Transmission Line Project; that the sheriff be directed or
any of the deputies, to place the plaintiff in possession of the property sought to be
expropriated; that the plaintiff be allowed and all persons under its direction and
control to have access in going to the premises of the property for the
implementation of the Transmission Line Project; and that the PNP of the
Municipality of Iguig, Province of Cagayan and/or other law enforcement
agencies, to assist the Sheriff, if necessary in the enforcement of the Writ.

January 11, 2018

The RTC Branch 10, Tuguegarao issued its ORDER directing that a Writ of
Possession be issued and allowing the plaintiff and all persons under its direction
and control to take possession of the property sought to be expropriated and start
the implementation of the Transmission Line Project and to have access in going to
the premises of the property.

The said Court also ordered the Sheriff to place the plaintiff in possession of
the portions of land to be expropriated and to promptly submit a report thereof to
this Court with service of copies to the parties.
