BETWEEN:
NDOMA T. NDOMA of Abuja (hereinafter called the "DONOR" which expression shall where the
context hereof so admits include his heirs, agents, privies, successors-in-tile, personal representatives)
of ONE PART.
AND
UCHE ANTHONY IFEANYI of No. 15 Urnunwa Avenue, in Orji-River Local Government Area of
Enugu State (hereinafter called the "DONEE" which expression shall where the context hereof so
admits include his heirs, agents, privies, successors-in-tile, personal representatives) of OTHER
PART.
WHEREAS:-
1. By virtue of Offer of Lease with Ref, No. EN/SAA.REP/VOL.1/56 dated 23 rd. day of
September 2002, the Community through the New Home Land Phase 1 Umuchigbo, Iji Nike,
allocated the above plot of land known as Plot 5 Block XIX (Residential) situate at, New Home
Land Phase 1 Umuchigbo, Iji Nike Enugu to the DONOR - NDOMA T. NDOMA. The
DONOR is in possession under the Land Use Act 1978 to the Statutory Right of Occupancy
granted over and all that piece or parcel of land together with other appurtenances thereon. The
plot is measuring square metres and is more particularly delineated and verged RED in Survey
Plan No? _______ Dated ___________ day of _____________ 20 and bounded by Beacon
Nos. ________________, ______________ and _______________ (herein called the
PROPERTY),
2. The DONOR has agreed with the DONEE to assign unto the latter all his interest in respect of
that piece of land known as Plot 5 Block XIX (Residential) situate New Home Land Phase 1
Umuchigbo, Iji Nike, Enugu for a valuable consideration and subject to the terms and
conditions hereinafter appearing.
NOW THIS POWER OF ATTORNEY WITNESS that the above named DONOR HEREBY
APPOINT AND CONSTITUTE THE SAID DONEE – UCHE ANTHONY IFEANYI to be my true
and lawful Attorney for me and on my name to all or any of the following acts and things in respect of
1. To take full and absolute possession of the said property and to administer, manage or
2. To prepare building plans for the said property and to design or improve the buildings thereon
whether to be erected or already erected in his own name and according to his taste and choice
3. To erect, build, construct, repair, or amend building and fences on the said property and or to
enter into agreements or contracts for the erection, repairs, construction or amendment of
buildings with any part or parties in accordance with the provisions of the State/Land Laws or
4. To sublet, mortgage, charge, sell, convey, alienate or assign the said property either to himself or
5. To apply in his own name to the appropriate Government, Ministry or Department for the
issuance or renewal of the Building Certificate of Occupancy for the approval of sub-lease,
mortgage, assignment or any other type of instruments in respect of the said property.
6. To execute all instruments and sign any documents or deed in respect of the said property and to
enter into acknowledgements, perfect and do all such agreements, instruments and things as
shall be required or may be deemed proper in relation to all or any of the purposes or matter
aforesaid.
7. To demand, collect, receive or accept at all times but without giving account to the DONOR
payments by way of rents, fees or dues from any tenant or person who may occupy the said
building thereon and to keep the utility same in his absolute discretion.
8. To assign and give notices to tenants and occupier of the property to quit or to repair or to abate
nuisance or to remedy a breach or to ward off or to prohibit or deal with trespassers or for any
other purposes whatsoever and to delegate such power and enforce all remedies open to the
DONOR in respect thereof and to enter upon the said property whether for the purpose of
viewing the state of repair thereof or in exercise of any right of re-entry or other rights vested on
him.
9. To commence, prosecute, enforce, defend, compromise and execute all legal proceedings with
regard to the recovery of premises law with respect to the said property.
10. To pay to appropriate authorities rents, rates, taxes, assessments and outgoings in respect of the
said property.
11. To appoint another Attorney in his place and stead in respect of all or other matters aforesaid so
that the principles of "Delagatus Non Potest Delegare" does not apply to this Deed.
12. GENERALLY and without any limitation by reference to or inference from any other
provisions of these present, to manage all the DONOR affairs affecting the said property and on
the DONOR behalf to execute and act in all things fully and effectually in all respect as the
13. This POWER OF ATTORNEY is given for valuable consideration and is therefore
14. I the DONOR HEREBY DECLARE and CONFIRM that I have not sold, assigned or
mortgaged or alienate the said property nor agreed or contracted to sell, mortgage or alienate the
said property to any person other than the DONEE herein mentioned.
15. The DONOR HEREBY RATIFY AND CONFIRM AND AGREE TO RATIFY AND
CONFIRM whatsoever his said Attorney shall lawfully do or cause to be done in respect of the
said property and I also declare that the powers enumerated above shall be given the widest
interpretation and shall not be construed to give limits to the general authority conferred on the
Attorney.
16. I further declare that this POWER OF ATTORNEY shall be irrevocable by me, my assigns or
successors-in-title and is given for a valuable consideration already furnished to me by the DONEE –
UCHE ANTHONY IFEANYI.
IN WITNESS WHEREOF, the parties hereto set their respective hands and seals the day and year first above
