Sub : CC No.607 and the batch cases – SE Department – counting the pre-regularization period
of the part time vocational instructions for the purpose of pension – Implementation of
orders passed in W.P.No.1049 of 2020– Reg.

I am to inform that in the instance case, the petitioners are initially re-engaged on hourly basis
(part-time) in the year  1986,  thereafter, they were paid honorarium till their services were regularized  
in the year 2009. To count the pre-regularized service for the purpose of pension as directed by the
Hon'ble Court, the Finance Department has no clarity with regard to the method to be applied for
implementing the orders in toto.  Accordingly, informed the administrative department to request the
opinion of the learned Advocate General's for the method/remedies available to be followed in
implementing the orders of Hon'ble Court in true spirit to overcome the matter. 

2. Since the  orders of the Hon'ble H.C  attained  finality and as per the  discussion held with  O/o
learned  Advocate General, the proposal of the administrative department was concurred duly work
out the modalities for implementing the orders of the Hon'ble High Court vide Finance U.O.No. FIN01-
HR/148/2021-HR-III, Dt.7/10/2021.

3. Further the School Education Department  was advised to re-submit their proposal in


consultation with Pension Fund Regulatory and Development Authority ( PFRDA ) as the petitioners   are
presently in Contractual Agreement with PFRDA under Contributory Pension Scheme ( CPS/NPS ) as per
PFRDA Act.” vide Finance U.O.No. FIN01-HR/148/2021-HR-III, Dt.28/10/2021.
4. Further when sought, the School Education Department was informed regarding the
introduction of Contributory Pension Scheme (CPS) w.e.f 01.09.2004 in the State and its salient features
and advised to make necessary correspondence with PFRDA being the administrative department in
consultation with DTA..”

                      This Scheme is being implemented in Government of A.P. and Grant in Aid institutions,
Universities, Local Bodies and Corporations etc. from 01.09.2004. The Directorate  of Treasuries &
Accounts (DTA)  is the Nodal Agency   in the State for allotting PRAN Numbers and making
contributions as per PFRDA norms.

   

  5. Further as per the request of the School Education department, a Memo issued to DTA dated
07-12-2021 and directed to  depute Addl Director / Jt. Director dealing with CPS in O/o DTA
to accompany with Education Dept. Officials on next convenient date. While furnishing the copy of
Memo dt 07.12.2021, the SE department was requested vide Finance U.O.No. FIN01-HR/148/2021-HR-
III, dt 07/12/2021 to contact the Director of Treasuries & Accounts in this matter.

6. In view of the position envisaged above, I am to inform that, the matter is pending with the
administrative department i.e. School Education Department which is implementing authority on the
issue. I therefore, request you to appraise the same to the Hon’ble High Court on the hearing of the
subject.
