AFFIDAVIT OF WITNESS

I, LEOH GODINEZ, Filipino, of legal age, married, and a resident of Leyson

Appt., Purok Macopa, TAbtoy, Tuyan, Naga City, Cebu, after having duly sworn
in accordance with aw do hereby depose and state:

1. That I personally know Mr. Rey Alforque Aroza since we were in high
school;

2. That Mr. Rey Alforque Arnoza is the proprietor of RLV Shipping and
Logistics Services;

3. That sometime in January 2016, Mr. Arnoza approached me and asked

me if I have some money to lend him to be use for the operation of his
company;

4. That I told him that I don’t have money but my nephew Rohel Mondoy
can lend him some amount;

5. That the following day, I talked with my nephew regarding the request
of Mr. Arnoza however, he cannot lend some but he referred me to
someone name ELIZABETH KLEE as a selective lender;

6. That sometime on the second week of January 2016, I and Ms. Klee meet
with each other at the office RLV Office at Naga City (Mr. Arnoza was not
around). Thus, late in the afternoon, I and Ms. Elizabeth Klee went to the
house of Mr. Arnoza in Barangay Lower Lanas, Naga City, City;

7. That it was the first time Ms. Elizabeth Klee and Mr. Rey Arnoza meet
each other. I also heard that Ms. Klee proposed to Mr. Arnoza to be his
business partner but Mr. Arnoza turned her down because she cannot
present any permit from the government. But rather they have come
into a verbal agreement that Ms. Elizabeth Klee will lend Mr. Arnoza
money;
8. That during that meeting, (where I was present) it was agreed by Ms.
Klee and Mr. ARnoza that as a security of the loan, Mr. Arnoza shall issue
a check. And in case of full payment, it shall be the obligation of Ms. Klee
to return the check to Mr. ARnoza. It was clear to the both parties that
the check should not be deposited or be negotiated or rediscounted;

9. That sometime in third week of January 2016, Mr. Arnoza and Ms. Klee
together with me had a meeting at Park Mall Mandaue City. Ms. Klee
lend some amount to Mr. Arnoza and the later issued a check. That was
the first transaction and such was already fully paid;

10. That I acted as the agent of Mr. Arnoza in the creditor-debtor

relationship between Ms Klee and Mr. Arnoza. Mr. Arnoza will issue a
check and hand over to me, and I will deliver it to Ms. Klee and the later
will issue money the money equivalent of the check and deliver the cash
to Mr. Arnoza;

11. That all the transaction between Mr. Arnoza and Ms. Klee is
through me. Never did Mr. Arnoza had a direct contact with Ms. Klee;

12. That Mr. Arnoza pay its obligations to Ms, Klee either through
bank payments directly to the bank account of Ms. Klee, Palawa kwarta
padala or Mlhuillier pera padala. I am the one who will deposit or send
payments to Ms. Klee;

13. That sometime in third week of May 2016, Mr. Arnoza adviced me
that he transferred his bank account from Chinabank to Metrobank. He
also instructed me to call Ms. Klee reminding Ms. Klee not to deposit the
checks because Mr. Arnoza transferred his bank account from
Chinabank to Metrobank. But despite Mr. Arnoza transferred his
deposits to Metrobank, still the amount deposited is not enough to the
total aggregate amount of his loan that in my estimate amounting to
TWO point One Million Pesos. Thus, I called and informed Ms. Klee;

14. That sometime in the mid-2017, Ms. Klee can no longer be

reached or contacted. It was only this year 2019 at around April 2019
when Ms. Klee contacted us (with her new number) again informing us
that she deposited all the checks last May 24, 2019 and demanded a
payment of more than EIGHT MILLION PESOS (Php 8,000,000.00).

15. That I hereby reiterate that the transaction entered between Ms.
Klee and Mr. Arnoza is a contract of loan and in relation to his business
RLV Shipping and Logistics and not in any way connected to him as
public officer;

16. That I hereby attest that all statements stated above are true and
correct based on my personal knowledge.
