1. Decide the validity:


(a) Sale of dwelling house by karta to meet expenses of re-marriage of widowed
daughter.
(b) Sale of dwelling house by karta to meet expenses of his own second marriage after
the death of his first wife.
(c) Sale of dwelling house by karta to meet expenses of his own second marriage while
his first wife is still alive.
(d) Sale of JFP to meet expenses for appealing conviction of family member by lower
court for murdering a minor boy from another caste.

2. Karta mortgages JFP to repay existing family debts. However, the money is diverted
for purchasing a farm house. Decide if alienation is valid.
If the alienation is invalid, discuss what remedies does the alienee have, if any.

3. A coparcenary consists of Rahul and his two major sons, Raj & Ramesh. They have
sprawling JFP in their native village, Saharanpur. Rahul sells the property to his long-
time friend Rupesh and uses the funds for:
(a) Repaying a debt contracted by his father for match-fixing
(b) For the marriage of Raj’s 12 year old daughter.

The alienations are challenged by Raj and Ramesh in (a) and by Ramesh in (b) as non-
binding on them since they are not a legal necessity nor are they for the benefit of the
estate. Decide.
