Tolentino AN ORDINANCE PROVIDING FOR THE CASH INCENTIVES OF REGISTERED SENIOR CITIZENS IN THE CITY OF MAKATI, SUBJECT TO APPLICABLE LAWS AND AUDITING RULES AND PROCEDURES. Makati, Wakalia Matin ... Ati Ye, ie Page 1 of 5 201. 4: WHEREAS, Art. 15, Sec. 14 of the 1987 Constitution provides that the family has the duty to take care for its elderly members but the state may also do so through just programs of social security; WHEREAS, Article XIII, Sec. 11 of the 1987 Constitution provides that the State shall adopt an integrated and comprehensive approach to health and other social services available to all the people at affordable cost. There shall be priority for the needs of the underprivileged, sick, elderly, disabled, women and children; WHEREAS, Sec. 16. of RA 7160, otherwise known as the Local Government Code of 1991 provides that every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare; WHEREAS, Sec. 16. of RA 7160, otherwise known as the Local Government Code of 1991 provides the local legislative power shall be exercised by the Sangguniang Panlungsod of the City; WHEREAS, Sec. 10 (e) (17) of RA 7854, otherwise known as the Charter of the City of Makati, provides that the Sangguniang Panlungsod shall approve ordinances which appropriate funds to support programs and projects for the benefit of the elderly; WHEREAS, as of 15 October 2016 there are around 42,426 senior citizens for ages 60-69, ages 70-79 there are around 22,748 senior citizens and ages 80 and up there are around 4,241 senior citizens in the City of Makati; WHEREAS, the City of Makati sees the reality that most senior citizens’ medical concerns require maintaining medicines and treatments, some of which are expensive for the senior citizens; WHEREAS, assistance in a form of monetary allowance would be of great help for senior citizens to augment their expenses in medicines and other treatment; WHEREAS, in recognition of the vital roles and contributions of the city’s sen citizens to the development of the Makati into a vibrant city and the recognized economic powerhouse of the country, while, at the same time, retraining its rich cultural identity/heritage and religious piety, the City Government has been granting annual cash Incentives in the amount of three thousand pesos (P3,000.00) each to all registered (blu card holders) senior citizens; WHEREAS, the mounting expenses for medicines and other medical concerns of senior citizens as their age advances make their monthly pensions, if any, hardly sufficient to tide them over. This condition is true to most of the city’s senior citizens, particularly those belonging to the older groupings who are in more fragile state of health, but not, necessarily, the least grateful for the privileges that come with their realization of how much the city genuinely and truly care for them in their twilight years; WHEREAS, the Sangguniang Panlungsod, considering the integral role, contribution and participation of the members of elderly sector in the promotion of the nation as well as to the development of the City, hereby enacts this Ordinance for the cash incentives of registered senior citizens in the City of Makati, subject to applicable Jaws and auditing rules and procedures. NOW THEREFORE, BE IT ENACTED AS IT IS HEREBY ENACTED BY THE SANGGUNIANG PANLUNGSOD OF MAKATI, METRO MANILA, BY VIRTUE OF THE POWERS VESTED IN IT BY LAW, IN SESSION ASSEMBLED, that: Section 1, There shall be cash incentives for senior citizens every year, to be given in half during the months of July and December. Section 2, The following is the age bracket of senior citizens for the purpose of determining the amount of incentives they may receive every year: A. For senior citizen whose age is between 60-69 years old, such senior citizen is entitled to receive Three Thousand Pesos (Php 3,000.00) to be distributed as follows: 1. The first half [One Thousand Five Hundred Pesos (Php 1,500.00)] shall be given in July of every year; and 2. The other half [One Thousand Five Hundred Pesos (Php 1,500.00)] shall be given in December of every year. B. For senior citizen whose age is between 70-79 years old, such senior citizen is entitled to receive Four Thousand Pesos (Php 4,000.00) to be distributed as follows: 1. The first half [Two Thousand Pesos (Php 2,000.00}] shall be given in July of every year; and 2. The other half [Two Thousand Pesos (Php 2,000.00)] shall be given in December of every year. C. For senior citizen whose age is 80 years old and above, such senior citizen is entitled to receive Five ‘Thousand Pesos (Php 5,000.00) to be distributed as follows: 1. The first half [Two Thousand Five Hundred Pesos (Php 2,500.00)] shall be given in July of every year; and 2. The other half [Two Thousand Five Hundred Pesos (Php 2,500.00)] shall be given in December of every year. Section 3, The Makati Social Welfare Department (MSWD) in coordination with the City Budget Office, the Accounting Department and Office of the Senior Citizens Affairs (OSCA) shall formulate the Implementing Rules and Regulations within 30 days after the effectivity of this ordinance Section 4, The funds for carrying this Ordinance shall be chargeable to the Executive Budget of the Office of the Mayor, under Special Activities Funds, and/or funds of the Makati Soctal Welfare Department, under the Blu Card Program or any other sources of funds as indicated in the Annual or Supplemental Budget of the city government, whichever is applicable, subject to existing laws and auditing rules and procedures. Section 5, Let a copy of this ordinance be furnished the Makati Social Welfare Department (MSWD), the City Budget Office, the Accounting Department and the Office of the Senior Citizens Affairs (OSCA) and other concerned agencies for their information, guidance and reference, QQY \ Page 3 of S IN, Section 6, All ordinances, executive orders and rules and regulations inconsistent or in conflict with any provisions of this ordinance are deemed repealed, amended or modified accordingly. Section 7. This Ordinance shall take effect immediately upon its approval.
