S, R, O no.294-Law/2008. As per Bangladesh Environment Protection Law, 1995( Rule-1 of


1995) Section-20, the Government has made this Rule as under:

1. The heading , Introduction and implementation: (1) This rules will be named as” Medical
Wastages” ( Management and Processing) Rules,2008.
(2) To be implemented immediately.
(3) It will be applicable for all Medical Services Providers for Medical Wastage Management
and Processing.
2. Definition: (1) If not repugnant to this Rule , in this Rules- (a) “Law “ means Bangladesh
Environment Protection 2015 (Rule-1 of 1995):
(Kha) “ Appellate Authority” means an Appellate Authority made for hearing of an appeal made
against the order of the authority.
(Ga) “ Authority” means an authoratiry made under Rule-3.
(Gha) “ Coloor Code” means the the division of medical wastages as per alphabet for proper
management and processing as per schedule-3.

(Uma) “Medical Wastage” means the wastages solid, liquid, gaseous or atomic produced for
the treatment of human being, for vaccination, diagnosis of diseases or research work for
investigation which affects the environment and the wastages described in Schedule-1 will also
be treated as medical wastages.
(Cha) Processing of medical wastages means collection of medical wastages, separation ,
packaging , destroying, burning, processing, refining and making disposal the same.
(Chha) “ Medical Wastages Management” means carrying medical wastages ,storing, filing,
observation and supervising.
(Ja) “ Place of Medical Services” means the Institutions which give medical services, viz.
Government/ Private Hospitals, Consultation Chambers, Private Clinic, Nursing Homes,
Pathological Laboratories, Dispensary, Medicine Shops, Blood Bank and the Institutions
described in Schedule-2 will be included.
(Jha) “Schedule” means any schedule which is concerned with this rules.
(Neo) “ Inspector” means any Inspector of this Directorate.
(Ta) “ Form” means any Form concerning this rules.
(Tha) “ license” means under section-5 any License given for wastage management.
(Da) “ Delegated Person” means any person delegated by Director General for doing any
assigned job.
(Dha) “Local area” means Metropolitan area of City Corporation, for Municipality municipal
area and for the Union villages.
(2) Any term used in this rule which has not been defined will be similar in meaning with the
legal term.
3. Making Authority: For fulfilling the purposes of this rule an “ Authority” will be formed in
each Department with the following persons within 3 months from the date of implementation
of this rule. Such as:
(a) Divisional Director, Directorate of Health Chairman(By dint of his post)
(b) A Representative of the Divisional Commissioner Member
(c)A Representative of the Director General, Directorate

4. Duties and Responsibilities of the Authority: The duties and responsibility of the Authority
will be as under:
(a) To give license, renewal or cancelation of the license to the proper person for processing
medical wastages.
(b) To observe and supervise the work of the licensee as per section(a).
(c)To give instruction to the parties for processing medical wastages.
(d) To collect the information of environment pollution by the medical wastage, publish and
preach and other activities regarding this.
(e) As per section 6 (Ja) compilation of annual report and submit the same to the Ministry of
Forest and Environment through the Director General by 31st March of each year.
(f) To keep contact with the Director General regarding the activities under this rule.

5. Nature of License, Procedure for giving, Renewal and cancellation: (1) Under this rules, there
will be three classes of licenses.
(a) License for separation of medical wastages, packaging storing, destroying and burning.
(b) License for collection of wastages and carrying and
(c) License for refining, purifying and dispose up.
(2) Without any license no holder is allowed to manage or process medical wastages.
But, the condition is that if the City Corporation takes step to manage this wastages this rule
will not be applicable.
(3) For getting license application Form-1 to be submitted with prescribed fee of the
government.
(4) After receiving application the Authority will make inspection and if the inspection report is
satisfactory, the authority will issue license.
(5) The license to be issued within three months from the date of receiving application. If not,
the cause of not giving license to be informed to the applicant in writing.

(6) The License will be valid for 3 years from the date of issuing license and renewal can be
made for the next term making application in Form-1 with proper fees.
But, the condition is that if the occupant does not renew the license and continues his activities
in that case he may be given 30 days notice for making renewal of the license and his activities
can be suspended for the notice period and during this period if the holder fails to renew the
license , his license can be cancelled.
(7) In spite of the rules of section-6 of the rules, for the sake of testing the ability of the holder
experimental License for one year may be issued.
(8) If the authority decides to give license under sub-section (4) & (7) that should be given in
Form-2.
(9) Under this rule any person can be given one or more than one licenses.
(10) If any license holder violets any condition of the license, the authority will give
considerable time for hearing, if necessary the order for cancellation of license can be given.
(11) Under this rule for giving license proper rules to be followed.
6. The duties and responsibility of the License holder: (1)The duties and responsibilities of the
license holder will be as under:
(a) To take all the steps for managing the medical wastages so that there will be no harmful
effect for the human being.
(b) The employees who will process this wastages should be given proper training.
(c)Proper steps to be taken for the safety of the employees who will take part in this activity.
(d) As per Schedule-6 for processing the medical wastages “ Ideal standard” to be maintained
and waste management to be made without any infection.
(e) In case of any accident during time of work, proper steps to be taken and statement to to be
submitted to the authority in Form-3.

(e) The files of the medical wastage management to be preserved annually and to be kept for 3
years.
(f) The annual report of the medical wastage management to be submitted in Form-4 to the
authority by 31st January of each year.
(2) Each Licensee is bound to process and manage medical wastage in a healthy way and
without any environmental pollution and to ensure economic & legal responsibility.

7. Separation, Packing, carrying and storage of Medical wastage: (1) Medical wastage is not
allowed to mix with other wastage.
(2) As per schedule-3 the medical wastages to be kept separately in a covered bin before
storing, carrying and destroying. As per schedule-4 there should be a label on the covered bin.

(3) If the medical wastage is carried from the place of its production in a covered bin for
reprocessing even that there must have label of information as per schedule-5.
(4) Unrefined dangerous medical wastage to be carried in an approved specific transport which
is suitable for carrying this sort of materials.
(5)The unrefined medical wastage is not allowed to store more than 48 hours.
But, the condition is in case of necessity if the wastage is needed to keep more than 48 hours
for any reasonable ground in that case the licensee is to ensure that the waste will not be
harmful for human being or for environment. After that the licensee have to take permission
from City Corporation, Municipality or Union Council which one is applicable.
(6) The medical wastage can be stored in a separate, demarcated protected place and there
should be proper ventilation in that room and there should be adequate water supply there.
(7) As per sub-section(6) the unused rooms of that area to be kept under lock and key and the
access to that area is restricted and only the licensee and the trained people are allowed to
enter.
(8) The carrying of medical wastages to be made by the processing authority according to the
instructions, time and rule by the approved individual.
(9) The safe medical wastages and processed unsafe wastages to be disposed of by the City
Corporation, Municipality or Union Council to be continued.

8. Selection of Area for destroying or burning medical wastages: Keeping the section-7
unhampered the City Corporation, Municipality or the Union Council to allowed to select for
dumping these wastage and destroying it in their custody.

9. Processing, purifying and disposal of medical wastages: For disposal of medical wastages
the responsibilities of the licensee is as under:
(a) As per schedule-6 the processing purifying and disposal of medical wastages shuld be
according to the time and standard.
(b) Ensure proper technology and system for this work.
(c) As per the instruction of the authority to use proper dress, instrument and materials.
(d) To write information about the medical wastage in the container in clear Bengali words.
(e) To give service taking the service charge prescribed by the authority.
(f) To dispose up harmful wastage without infection.

10. The power to access: (1) As per the rules of this provisions any person being authorized by
the D.G., may access to any building or place in a reasonable time for the following purposes:
(a) For doing his duties as per rules.
(b) For making inspection as per notice given.
(c) For examining any plant, machinery ,record or register.
(d) For making investigation of a committed crime.
(e) For arresting any plant, machinery record or register which can be used for committing
crime.

(2) Any licensee is bound to co-operate with the authorized person under this rule.

11. Punishment for violation of this Rules: (1) If anybody violets this rule will be treated as
crime.
(2) Crime made under sub-section-(1) the punishment will be two years’ effortless prison or
penalty for Tk. 10,000/-(Ten thousand) only or both the punishment will be executed.
(3) If any person is punished for violation of sub-section-(1) in that case the instruments used
for that crime or articles the Court has the right to confiscate those items.
(4) If this crime is committed by a company or by any commercial organization in that case the
owner of the company, Director, Manager, Secretary or Agent has made this crime unless he
can prove that the crime has been committed without his knowledge or he has tried his best to
stop this crime.
Explanation: In this section:
(a) Company means any Registered company made by law, Partnership Concern or any
Society or organization.
(b) For a Commercial concern ‘Director” means a member of the Administrative Board.
(5) As per sub-section-(4) if the company is registered company and treated as an Individual in
that case the company may be punished, but in that case only monetary penalty can be
imposed.
12. Taking Claim for crime and compensation: Without the written statement of an Inspector
or any person delegated by the Director General, no Court is allowed to take any case of claim
or compensation.
But, the condition is that if any person gives written complain for taking claim and
compensation and the Inspector or delegated person does not take any action within 60 days
and the case has the jenuinity, in that case the Court which has authority can case the case
giving proper time for hearing and take the case directly and can give instruction to the
Inspector or delegated person for making investigation.

13. settlement of the Case: For settling the cases of this rule, section- 1898 of CPC to be
followed.

14. Appeal: (1) If any person is not satisfied with the decree of case given by the authority, in
that case appeal can be made in Form-5 in Appellate Division within 30 days.

(2) Yet as per sub-section(1) if the party fails to make appeal in due time for some appropriate
cause, in that case with the satisfaction of the Appellate authority can make appeal within 60
days.
15. Construction of Appellate Authority, its Power and functions: (1) As per section-14 the
Appellate Authority can me made with the following persons:
(a) Joint Secretary(Hospital Nursing), Chairman
Ministry of Health & Family Welfare ( Ex-officio)
(b) Deputy Secretary(Hospital), Member
Ministry of Health & Family Welfare ( Ex-officio)
(c)Deputy Secretary (Environment-2) Member(Ex-officio)
(2) Appellate Authority after receiving appeal application can make notice within 30 days and
can give the date of hearing.
(3) The Authority can ask the party to submit papers for the case.
(4) If the date od hearing is adjourned the hearing can be made on next date.
(5) The authority will final the appeal within 90 days from the date of filing appeal.
(6) If the applicant is absent on the date of hearing the authority can cancel the appeal.

(7) After hearing, the authority can approve, amend or cancel the order.

(8) The decision of the authority is final. No case can be filed in the Court against this order.

16. Construction of Advisory Committee: (1) For managing the Medical Wastages the
Representatives of the Ministry of Forest & Environment and the Ministry of Health and Family
Welfare and the specialist of Medical Service and Environment Management and City
Corporation will form a National Advisory Committee for doing the wastage management
perfectly.

(2) The National Advisory Committee will advise the Government and prepare rules for Medical
Waste Management.

The above options depend on the availability of the technology. If the party wants to use
different system, the proposal to be sent to the authority for their consent.

b) Halogen materials or PVC plastic can not be burnt in Incinerator unless processing for
smoke and gas are not used.
c) Steam autoclaving to be made as per standard given i9n schedule-6.
d) Liquid chemical can be given in drain after treatment as per schedule-6.
e) Chemical treatment should be made before disposing up sharp wastage.
f) To stop reusing the rubber/ Plastic tube etc to be cut in to pieces.

Standard for destroying and processing Medical Wastages:

Ministry of Forest & Environment/ Directorate of Environment will set up standard time to time for
destroying and processing medical wastages:

The Standards for Incinerators:

At the time of burning the instrument must have the following operating & Emission Standards:

(A) Operating Standards:


(1) The combustion capacity should be at least 99%.
(2) The calculation will be made as under:
Combustion capacity= % carbin-dy-oxide x100
% Carbon-di-oxide +% Cabon-monooxide

Combustion efficiency (C.E.)=%co2 x100

(3) The temperature of the 1st chamber will be minimum 800 degree centigrade plus/minus 50
degree centigrade.
(4) In the 2nd chamber the gas will exist 105 degree centigrade temperature at least 1 second
and there should be at least 3% oxygen in the stack gas.

(b)Emission Standards:

Per Nm3 how much mg balace and concentration (12% carbon-di-oxide correction)

(Parameters & concentration in mg.Nm3(12% correction)

(1) Particulate matter : 150/mg


(2) Nitrogen oxide s : 150 mg
(3) HCL : 50 mg
(4) The height of the gas stage will be minimum 30 meters from the land.
(5) The volatile organic compounds of ashes will not be more than 0.01%.

(c)Note:

1. The pollution control devise will be standard. For achieving this goal that technology should
be added.

2.The wastage which is flammable can not be processed with chemical process.

3. Chlorinated plastic can not be burnt.


4. In the burnt ashes the polluted metal should be within the limit of the Directorate of
Environment.
5. Only low grade fuel like l.D. Od LS, H.S.I.Diesel will be used for burning.

Standards for waste autoclaving:

Cytotoxic , chemical or radio-active wastages are processed through autoclave system.

(1) For density directed autoclaving depends on the following:


(a) If the minimum time of autoclave is not 60 minutes in that case the temperature will be at
least 121 degree centigrade and pressure will be per inch 15 pounds. Or
(b) If the time of the autoclave is not less than 45 minutes the temperature will be 135 degree
centigrade and pressure per inch will be 31 pounds.
(c) If the time of the autoclave is not less than 30 minutes the temperature will be 135 degree
centigrade and pressure per inch will be 31 pounds.
(3)Autoclaving process should be made for proper time and pressure, otherwise the dangerous
medical wastage will not be properly processed.
If the machine does not give proper signal in that case autoclaving should be made again unless
time and pressure is proper.

(4)The recording of operational parameters, load Identification number to be made graphic


in autoclave or computer recording should be there.
(5) Validation test.
(6) Spore test:
Each autoclave as per design will destroy germs in a same ratio and under any
circumstances the time of the autoclaving should not be less than 30 minutes. The
temperature should not be less than 121 degree centigrade and pressure should be
minimum 15 pounds per inch.
(7)Routine test: Chemical tape which changes color in particular temperature may be used
for checking temperature. To ensure autoclaving different types of tape can be used.

Standard for liquid test:


The liquid wastage of the hospital should be within the following limits:

90% fish will be alive.
This limit for those hospitals which are not connected with connected with the drain
without processing.

Standards for Microwaving:

( 2) Microwave system can not be used for purifying citotoxic, chemical or radio-active wastage, toxic
body of the animal, limbs of human being, big metal product etc.

(2)The routine test/ efficacy test of microwaving will be continued and performance guarantee to be
given by the supplier.

(3) Microwave will work to purify at the same ratio and the design of the microwave will ensure the
maximum power of the system. The power of the microwave will be bacillus subtilis spores per ml 10
to the power 4 spores.

Standards for deep burial:

(1) Two miters deep hole to be dug. Care should be taken for water level. The half of the hole will
be dumped with wastage. Before filling the rest half with soil lime to be given to cover it 50 cm
down from the surface.
(2) To give fence with rust free iron bar so that no animal can enter.
(3) After dumping waste every time a 10 cm thick layer of soil to be given.
(4) This system to be kept under proper observation.
(5) The place should be secured so that waste can not run out. There should be no shallow well
within 15 meters of the area. In case of need cemented floor to be made.
(6) The hole should away from the residential area. The hole can not be made flood affected area or
in a soil erosion area.
(7) The palce of hole to be approved by the proper authority.
(8) The organization must have to maintain a file for this system.

Standards for Radioactive waste treatment and disposal.:

For purifying these kinds of wastages the rules of the Bangladesh Atomic Energy Commission to be
followed.

(1) This power giving will be in accordance with the Bangladesh Environment
Preservation Rules-2015 and the laws made under this rules.
