Dear Mr. Patel:

An inspection was conducted on August 11, 2022 by staff members of the City of Midland Building
Department and Midland Fire Department in response to complaints by private citizens about the
condition of the Best Western Hotel. The following is an itemized list compiled by the inspection team.
Please note that this is not intended to be an exhaustive list of deficient items.
Electrical issues:
1) Electrical panel in pool pump room is very rusty and is still energized.
2) Multiple mechanical rooms, wiring for lights not protected and hanging.
3) In the old kitchen, multiple open junction boxes and wires cut off and hanging. Could not verify
these wires were not energized.
4) Fire alarm control panel by main reception area not functioning and no display.

Mechanical issues:
1) Boiler room floor has standing water, the source of the water was needs to be identified and
corrected.
2) There are uncapped gas lines in the kitchen on the second floor which need to be capped.
3) The open vent piping in the mechanical room near the reception desk needs to be capped.

Plumbing Issues:
1) Required drinking fountain is out of order.
2) Laundry sink drain is leaking and needs to be repaired.
3) Unpermitted water distribution piping installed in hallway.
4) The annular space between the PEX tubing and the brick needs to be sealed

Building Issues:
1) Fire extinguishers outdated and must be re-serviced.
2) Smashed patio door window from guest room to courtyard.
3) PEX tubing penetrating fire rated wall assemblies in the corridor. Penetrations must be sealed.
4) Same PEX tubing and all penetrations in fire rated wall assemblies above the ceilings in the guest
rooms must be sealed.
5) Black Chevy Z71 pick-up truck, Michigan license number DD-28710 in-operable with flat tire in
parking lot.
6) In pool pump room, there is a structural steel tubing frame supporting a very large piece of
mechanical equipment that is extremely rusted and flaking. This structural support must be
immediately evaluated for the capability to support the equipment, or be replaced.
7) Extensive water damage to guest room including the unit corridor door being swollen and not
able to be closed. Also, extensive water damage to interior furnishings and wall and floor
coverings inside the unit.
8) Extensive water damage and leak in electrical room near old kitchen.
9) Mechanical Room C had approximately 24” of water in it. Not able to determine the reason this
room is holding water. The cause of the water must be identified and corrected.
10) The pools and spa are holding stagnant water as the water level is below the circulating pump
level. The children’s pool is growing algae and off gassing into the room.
11) Broken window above pool pump room.
12) Hole in the roof on lower first floor area. Roof must be watertight and sealed.
13) There is a new door and one removed from a corridor on the second floor near the former
restaurant. We could not determine a reason for the new construction nor do we have any permits
for this work.
14) There is a permit for a commercial reroof that was issued in 2018. That permit has long ago
expired and is void. A new roofing permit shall be applied for and issued to complete the
remainder of the roof.
15) There were several emergency lights that did not function throughout the entire building. All
emergency and exit lights shall be powered by a commercial source and be lite both under normal
power and under battery back-up power.

Fire Issues:

Numerous violations of the International Fire Code (IFC).

In addition to the numerous violations of the (IFC), you have also failed to comply with the annually
required fire alarm testing which is a life health safety issue. If those results, for both properties, are not
provided to the Fire Chief by 10:00 a.m. on Friday, September 2, 2022, the City of Midland will begin
issuing civil infraction citations for each property and for each violation of the IFC. Please be advised
that violations of this section of the IFC are a civil infraction violation, the first offense of which may
result in the issuance of a $50.00 civil infraction, the second offense a $250.00 civil infraction and the
third and any subsequent offenses a $500.00 civil infraction. Each day that the offense occurs constitutes
a separate offense.

Water Distribution issues:

Threat to public health and the public water system due to known cross contamination and underground
leaks.

Due to the potential for cross contamination of the City of Midland Municipal Water supply, the
numerous Fire, Building, Electrical, Mechanical and Plumbing Code violations, the public health concern
of exposure to Legionella bacteria to people in or around the Best Western Building, the City of Midland
Water Department will shut off water service to the Best Western Motel as well as the Day’s Inn at 8am
Friday August 26, 2022.

Also at 8am Friday August 26, 2022, the building will be placarded as condemned unsafe for human
occupancy and both buildings must be vacated and remain vacated.

After the completion of placarding, entrance to the Best Western and Day’s Inn shall only be allowed
after the approval of the Building Official. Unauthorized entrance into the building could be treated as a
criminal trespassing violation or violations of the International property Maintenance Code subject to
either civil or criminal fines and/or incarceration for the offender.

All areas of the Best Western and Day’s Inn must be vacated by 8am Friday August 26, 2022. All persons
on site at this time shall be instructed to leave immediately. It is highly recommended that all personal

belongings be removed from the buildings prior to this time. Guests of the Hotels will have very limited
or no access to personal belongings after this time.
