JUDICIAL AFFIDAVIT OF WITNESS

I, RODRIGO E. MERIN, of legal age, married, and presently residing at

Purok 4, Magaogao, Guinatan, Pinukpuk, Kalinga after having been duly sworn
and informed that I am being examined by ATTY. YVONNE JADE MANONGYA-
MAYMAYA of Manongyao-Maymaya Law Office do hereby depose and state that
I am consciously answering the questions propounded to me under oath and
that I may face criminal liability for false testimony or perjury by reason
thereof:

OFFER OF TESTIMONY:

The testimony of the above mentioned witness is being offered to prove that he
knows the parties, and knows that defendants are the rightful owners of the
land and that the parents of defendants and then later on the defendants
continued tilling alternately the land up to the present;

QUESTIONS AND ANSWERS PROPER:

1. Q: Mr. Witness, please state your name, age, and other personal
circumstances?

A: I am RODRIGO E. MERIN, of legal age, married, Filipino and

presently residing at Purok 4, Magao-gao, Pinukpuk, Kalinga, Ma’am.

2. Q: Please tell me why you appeared before me today?

A: I want to tell everything I know about the parties and the case;

3. Q: How many years have you been a resident of Magaogao, Pinukpuk?

A: I arrived at Magaogao, Pinukpuk in 1979 having married thereat,

so I am a resident of Magaogao for the last 43 years;

4. Q: Do you know the parties in this case?

A. I know personally all the parties Ma’am.

5. Q: Do you know about the pending case between the parties?

 A: Yes, I know that they have a pending case regarding the land that
the defendants are presently tilling.
6. Q: Do you know where the land is located?

A: Yes Ma’am, at Purok 3, Magaogao, Pinukpuk, Kalinga.

7. Q: What is the area of the subject land?

A: I think it is more than half hectare;

8. Q: Since you arrived at Magaogao, Pinukpuk, Kalinga, do you know

who was or who were tilling the land then?

A: Yes Ma’am, it was tilled by Nicasio Addatu, then he was

substituted by his son Marcos Addatu, later on by Eliseo Cambri,
the husband of Clara Addatu who took over the cultivation of the
land, then it was taken over again by Romulo Dalire and his son
Louie Dalire. In 2015 it was then turned over to Jovita Addatu
Mangliwan to till the land, and that was the time when plaintiff
wanted to get the riceland, but Jovita refused and called all his
sisters and cousins in the Addatu side to help each other to till the
land;

9. Q: At the present, who are tilling the land?

A: Defendants together with their cousins on the Addatu side;

10. Q: From 1979 up to the present, was there a time that

defendants or their parents were ever ousted from the land?

A: None Ma’am, there was never a time that defendants or their parents
ever left, abandoned or were ousted from the land.

11. Q: Do you want to say anything else regarding the case?

A: No more Ma’am.

IN WITNESS WHEREOF, I hereto attest to the truth of the foregoing

averments, this 9th day of August 2022, here at Bulanao, Tabuk City, Kalinga

I, ATTY. YVONNE JADE MANONGYAO-MAYMAYA, hereby attest that I

faithfully recorded the questions propounded and the corresponding answers
given by the witness RODRIGO E. MERIN. I duly Interpreted the questions I
asked in the English language which the witness understands and he provided
the answers the best way he could which were duly translated by me in
ILOKANO dialect. I did not in any way coach or taught or instruct the witness
on how to answer or any other person or persons then present or assisting the
witness regarding the latter’s answers.
