The Truth About Children who Need an IEP
All children develop and learn in different ways.

Being eligible for special education services does not mean that
the child is “dumb” or cannot learn.

It means the child learns in different ways, and/or needs


specialized services to assist with their learning.
WHAT IS SPECIAL EDUCATION?
What is Special Education?

• Under the Individuals with Disabilities Education Act (IDEA), a


child with a disability has a right to special education and related
services. The disability must prevent the child from benefiting
from their education. 20 U.S.C. §1400, et seq., Cal Educ. Code § 56026.

• Special education must be individualized to meet a child’s unique


needs. A child’s program is described in his or her Individualized
Education Program (“IEP”). Cal. Educ. Code § 56031.

• A child has a right to a free, appropriate public education (“FAPE).


Cal. Educ. Code § 56026.

• Eligibility can start as young as 3-years old, and last through


either receiving a high school diploma, or the semester after a
child turns 22-years old. Cal. Educ. Code § 56026.
WHAT IS IDEA?
IDEA
(The Individuals with Disabilities Education Act)
• IDEA calls for a free and appropriate public education
for every child with a disability.
• Education must be delivered in the least restrictive
environment.
• Promotes the concepts of inclusion.
• Requires that students with disabilities be educated in
general education settings alongside students without
disabilities as long as this setting is proven to be
appropriate THE LAW

• IDEA is the nation’s special education law. (USA)
• IDEA places two big responsibilities on states and their
public schools.

• Schools must find and evaluate students thought to


have disabilities — at no cost to families.

• To qualify for IDEA services, a child must have a


disability and need special education to make
progress in school.

• Prevent inappropriate identification and mislabeling of culturally diverse

• Ensure schools are safe & conducive to learning
• Encourage parents & educators to work out their differences by using non-
adversarial means

According to IDEA, parents have the right to…
• Inspect & review educational records
• Obtain an individual educational evaluation
• Require written notification prior to matters regarding
their child be discussed and/or finalized
• Request a due process hearing
• Appeal initial decisions to the State Education Agency
• Request reasonable attorneys' fees from a court for
actions or proceedings brought under IDEA
• Give or refuse consent before an initial evaluation is
conducted
