AFFIDAVIT OF ADVERSE CLAIM

       I, NORA M. BERBANO, of legal age, married, Filipino and a resident of Barangay
Buntun, Tuguegarao City, Cagayan, after having been duly sworn to in accordance with
law, depose and state:

1. That I am the incumbent principal of Baggao National Agricultural School

(BNAS) Main-Tallang, Baggao, Cagayan;

2. That on August 13, 1970, Mr. Eduardo Aguinaldo, registered owner of Lot
418, Pls-72 of Baggao Cadastre and covered by Original Certificate of
Title No. P-7597, donated a 10, 000 square meters, more or less portion to
BNAS (then Baggao Agricultural High School) which was duly accepted
on September 14, 1970 by then Director of Vocational Education, Andres
R. Asistin as Donee, a copy of which is hereto attached as ANNEX
“A” and made an integral part of this Affidavit;

3. That as a lawful and equitable owner of the abovesaid portion of property,

BNAS through this representation, undertakes to protect its rights and
interests over the same;

4. However, since the said donation per se could not be annotated on the
above title with the Office of the Register of Deeds of Tuguegarao City,
Cagayan, I am therefore executing this Affidavit for the
purpose of attesting to the truthfulness of the foregoing allegations and in
support of my request for the annotation of an adverse claim over the
parcel of land covered by the Original Certificate of Title No. P-7597;

5. That I attest the truthfulness of the foregoing for whatever intents and
purposes it may serve.
