CONTRACT OF AGREEMENT
This Contract of Agreement is made and entered into by and between:
SARAH DEMIT MENDOZA, of legal age, married to ARTURO
MENDOZA, Filipino and residing at Manila City at GSIS Metrohomes
Bldg.7, GA-3 Pureza Street, Brgy. 628, Sta. Mesa, District VI, Manila
with provincial address at Nijaga Street, Corner Galit Street, Brgy.
East Awang, Calbayog City, Samar., hereinafter referred to as the
“FIRST PARTY”.

EARL FRANCIS M. MARCIAL, of legal age, married to MARY
CRISTINNE B. MARCIAL, Filipino and residents of P5, Nijaga
Extension, Brgy. Rawis, Calbayog City, hereinafter referred to as the
“SECOND PARTY”.
2. That the FIRST PARTY agrees to sell the said real property for
and in consideration of THREE HUNDRED NINETY THOUSAND
(Php390,000) Philippine currency to be paid under the following
conditions:
4. That the parties agree that the failure to give the net loan
proceeds of Housing loan no. 370001952713 upon its
availability, as well as the rest of the installment payment will
make the SECOND PARTY liable for the total remaining amounts
and shall rescind any agreement or contract made between
them;
5. That the SECOND PARTY hereby agrees to pay all the fees and
taxes for the processing of transfer of title OF TCT NO 7269,
including such capital gains tax;
8. That the FIRST PARTY agrees, that in the event that the transfer
of title for TCT 7269 to the SECOND PARTY’s name becomes
unsuccessful, the first payment of FIFTY THOUSAND
(Php50,000) Philippine currency will be returned to the SECOND
PARTY.
