SUPERTECH TWIN TOWERS

:- HISTORY :-

Supertech Limited started the formation of a group housing society named Emerald Court after
the approval to purchase the plot in November 2004. Under the New Okhla Industrial
Development Area Building Regulations and Guidelines, the construction of 14 towers was
initially approved under this scheme. In 2006, Supertech Limited leased out the remaining land.
In the previous plan, approval was given to build a garden near the building’s tower T-1. After
this approval was given for the construction of two more towers. These towers were T-16 and
.T-17, Apex and Ceyane, Supertech twin tower

Residents complain about the Supertech Twin Towers, T-16 and T-17, that the UP Apartments
Act 2010 has been violated in its construction. Since the first plan was changed, the consent of
the buyers was mandatory for such changes, which the builder did not take. The complicity of
the Noida authorities was found in this matter. Fire safety and open space norms were ignored
in the construction of Supertech Twin Towers. First of all, the Allahabad High Court had said
that it should be demolished. The Supreme Court upheld this decision in August 2021,
. according to which the demolition was to be done in May 2022

Many such rules and regulations were violated during the construction of
Supertech Twin Towers. Some of those violations were apparently obvious and
cause for concern.The distance between the towers T-1 and T-17 was kept at 9
meters. This was a violation of NBR 2006, which states that the distance between
two adjacent buildings should be half the height of the tallest building. This
means that the Apex Tower which is more than 100 meters high should be built
near it at position T-1 and at least 50 meters away from Ceyane. There were
many other such problems with the Supertech Twin Towers.
The Supertech twin towers and the 9 meter distance between T-17 and T-1 also
violates the NBR 2010 norms. This rule states that any structure above 18 meters
must be built 16 meters away from the adjoining building. Apex and Cyan both
have a height of over 18 meters.

Under the National Building Code (NBC), 2005, provision of open space around
high-rise buildings is mandatory. Accordingly, around the T-17 there should have
been an open space of about 20 meters. The space of 9 meters is much less than
the prescribed limit.

According to NBC 2005 open space is also mandatory for fire protection.
According to this, the T-17 should have a distance of 16 meters from other
buildings. Here too, the Supertech Twin Towers violated the fire safety norms,
but got a provisional NOC from the authorities.

Several other rules were violated in the Supertech Twin Towers case. It also
violated the Uttar Pradesh Flats Ownership Act, 1975 and the UP Apartments Act
2010, which deals with obtaining consent from current residents and previous
buyers. The consent of the residents was not obtained when new buildings were
planned to replace the previous plan and new construction took place.

The RWA's consent to increase the number of floors of T-17 from 24 to 40 was
also violated. This means that the number of flat buyers has gone up to 1500
instead of 650. In this case, consent from the previous buyer should have been
taken, but was not.

The gardens adjacent to T-1 were used for the construction of the Supertech Twin
Towers, Apex and Cayenne. The flats were sold on the promise of providing
gardens to the residents of T-1. Later, this garden was used for the construction
of new buildings, but residents and previous buyers were not informed about it.

INTERODUCTION

India is all set to witness the biggest demolition of a structure with the
flattering the twins towers of Noida at 2:30PM on August 28th 2022.

The towers, taller than the QUTUB MINAR are were illegally built by a
private builder supertech on the green area of their multi storey
housing society called Emerald court situated in sector 93

BACKGROUND

The project was started in the mid 2000s.

Noida base development company Supertech limited launch the


construction of the project known as emerald court.

The project include the building of 3,4 and 5 BHK flats .

REASON OF DEMOLITION
First Reason:-
The problem started after supertech changed the plans which
by 2012 was a complex of 15 buildings instead of 14.
Each building was now supposed to have 11 stories instead of
9.
The change in the plan also include two more towers that
would rise to 40 floors above the ground.
The latter two became the heart of the decade long legal battle
between the resident and supertech.
Second Reason:-
Supertech had promised to have a green area in front of tower
one.
According to the documents submitted in court until December
2006 this was in the plan that was first modify in June 2005.
The green area later became the ground on which CEYANE and
APEX the town towers at the heart of the fiasco would rise
