ADOPTING R.A. 9165 OTHERWISE KNOWN AS “COMPREHENSIVE DANGEROUS DRUGS ACT OF


2002” AND CREATING THE TAPAZ DANGEROUS DRUGS BOARD (TDDB)
IN THE MUNICIPALITY OF TAPAZ, CAPIZ

BE IT ORDAINED by the Sangguniang Bayan of Tapaz, Capiz in session assembled:

Section 1. Rationale.
1. It is the policy of the state to safeguard the integrity of its territory and the well-being of its citizenry
particularly the youth, from the harmful effects of dangerous drugs on their physical and mental well-
being, and to defend the same against acts or omissions detrimental to their development and preservation.
2. Section 447 (v) of the Local Government Code of 1991 provides that the sanggunian shall enact
ordinances intended to prevent, suppress and impose appropriate penalties for habitual drunkenness in
public places, vagrancy, mendicancy, prostitution, establishment and maintenance of houses ill repute,
gambling and other prohibited games of chance fraudulent devices and ways to obtain money or property
drug addiction, maintenance of drugs dens, drug pushing, juvenile delinquency, the printing, distribution
or exhibition of absence or pornographic materials or publications, and such other activities inimical to the
welfare and morals of the inhabitants of the municipality;
3. Section 52 of RA 9165 otherwise known as the Comprehensive Dangerous Drugs Act of 2002 provides for
abatement of Drug related public nuisance and the enactment of an ordinance creating an administrative
board to hear complaints regarding drug related Public Nuisances.

Section 2. Purpose
The purpose of this ordinance is to establish a consultative multi-sectoral body that shall serve as the policy-
making, monitoring and coordinating body on the prevention and control of drug abuse in the Municipality of Tapaz,
Capiz and for the execution of the programs and projects with the end view of formulating and implementing short
term long term and sustainable to the drug problem;

Section 3. Unlawful Acts


The following unlawful acts under this Dangerous Drugs Municipal Ordinance;
a. Importation sale, trading administration, dispensation delivery, distribution and transportation of
dangerous drugs and/or controlled precursors and essential chemicals.
b. Maintenance of den dive or resort.
c. Manufacture of dangerous drugs and/or delivery of equipment, instrument, apparatus, and other
paraphernalia for dangerous drugs and/or controlled precursor and essentials.
d. Illegal chemical diversion of controlled precursor and essential chemicals.
e. Possession of dangerous drugs and/or equipment instrument, apparatus and other paraphernalia.
f. Possession of dangerous drugs and/or equivalent instrument apparatus and other paraphernalia for
dangerous drugs during parties, social gathering or meeting.
g. Use of dangerous drugs.
h. Cultivation or culture of plants classified as dangerous or are sources thereof.

Section 4. Participation of Family, Students, Teacher and School Authorities


a. Involvement of the family. The family as the basic unit of the Filipino Society shall be responsible for the
education and awareness of the members of the family on the ill effects of dangerous drugs and close
monitoring of the family members who may be susceptible to drug abuse.

b. Student Councils and Campus Organizations. All elementary and secondary schools student councils and
campus organizations shall include in the activities a program for the prevention and deterrence in the
dangerous drugs and referral for treatment and rehabilitation of students for drug dependence.
c. School Curricula. Instruction on drug abuse prevention and control shall be integrated in the elementary
and secondary curricula of all public and private schools, such instruction shall include;
1. Adverse effect of the abuse and misuse of dangerous in person, the family, the school and the
community.
2. Preventive measures against drug abuse.
3. Health socio-cultural psychological legal and economic dimension and implication of the drug
problem.
4. Steps to take when intervention on behalf of a drug dependent is needed, as well as the service
available for the treatment and rehabilitation of drug dependent, and;
5. Misconception about the use of dangerous drugs such as but not limited to the importance and
safety of dangerous drugs for medical and therapeutic use as well as the differentiation between
medical patients and drug dependents in order to avoid confusion and accidental stigmatization in
consciousness of the students.

Section 5. Creation of Tapaz Dangerous Drugs Board (TDDB). The Tapaz Dangerous Drugs Board (TDDB) in
the Municipality of Tapaz, Capiz is hereby created with the following composition, to wit;

Section 6. Duties and Functions. The following are the duties and functions of the board to wit;
1. Meet on a bimonthly basis.
2. Prepare and adopt internal rules to govern the conduct of bimonthly meetings.
3. Undertake planning and evaluation sessions on quarterly and annual basis.
4. Undertake semi-annual programming and assessments.
5. Undertake systematic consultations with the barangays, schools and other sectors.
6. To hear complaints against Drug related Public nuisances and hold annual drug summit.
7. Formulate and cause the implementation of short term and long term plans, programs and projects.
8. Closely coordinate with line agencies and non-government organizations regarding the plans of
action and program approved by the Board.
9. Monitor and maintain the necessary records on the status of drug abuse in Tapaz, Capiz and
submit quarterly summary reports thereof to the Sangguniang Bayan.

10. Provide the Local Chief Executive and the Chairman of the concerned committees of the
Sangguniang Bayan with minutes, plans and action, policy recommendations and other pertinent
decisions regarding the programs and projects of the Board.
11. Perform such other functions, necessary and proper, to effect the foregoing functions.

Section 7. Effectivity. This ordinance shall take effect upon approval and mandatory posting at conspicuous places
within the municipality.

ENACTED on the regular session of the Honorable Sangguniang Bayan of Tapaz, Capiz on April 2, 2018 upon
motion of Hon. Hernane G. Pio unanimously seconded.
