JUDICIAL AFFIDAVIT

I, MAGNA P MOLINA, 49 years old, married and a resident of Brgy. Tagsing, Sta.
Barbara, Iloilo., after having been duly sworn in accordance with the law, do hereby depose
and say:

PRELIMINARY STATEMENT
The person examining me on Judicial Affidavit is PCpl Joe Devin P Calibar, Investigator-
On-Case of Sta. Barbara Municipal Police Station, Province of Iloilo. The examination is being
held at the same address. I am answering his questions fully conscious that I do so under oath
and may face criminal liability for false testimony and perjury. The question being held under
the supervision of Iloilo Provincial Prosecutor HON. NICK C ARROYO.

Questions and Answers

1. Question(Q): Please state your name and other personal circumstances for the record.

Answer(A): I’am MAGNA P MOLINA, 49 years old, married and a resident of Brgy.
Tagsing, Sta. Barbara, Iloilo.
2. Q: Why are you here at the investigation section of Sta. Barbara MPS?

A: I am here to give my testimony regarding the shooting incident that transpired on

Novemebr 28, 2017 at Brgy. Tagsing, Sta. Barbara, Iloilo which resulted to the death of the
victims OMAR SANTOS Y DE LEON.
3. Q: How were you able to identify the suspect?

A: I was able to identify the suspects because I personally saw the shooting incident in my
Sari-sari store and I am the one who inside the store. I was able to identify them because their
barangay is near only were I was leaving. I identify their clothing surely to my naked eye.
4. Q: How sure you are that they were MARK SALASIM Y GONZAGA, XANDER FORD Y
MALAYAN and JOHN MAR IGPUARA Y LARGADO?

A: I am 100% sure Sir because based on the physical appearance during the incident is
almost the same and as to their body build-up.

5. Q: Where were you on November 28, 2017 at around 7:45 in the evening?

A: I am inside my Sari-sari store when shooting incident transpired.

6. Q: What particular incident have you witnessed on November 28, 2017 at around 7:45 in
the evening?

A: I witness that when the victim buying something on my store then the suspects also buy
something and suddenly one of them take something on his waist believe to be a firearm and
fired it to the victim which resulted to death of the victim.

7. Q: What did you do after witnessing said incident?

A: I suddenly give assistance to the victim and immediately take him to West Visayas
Medical Center - Sanitarium Hospital for medical attendance but it was declared as dead on
arrival by an attending physician and I make a phone call to Police station for immediate
assitance.

8. Q: How could you describe the suspect’s appearance during that particular time?

A: The suspects were wearing slippers, brown shorts, stripe shirt, black cap, about 5’5’’ in
height (MARK SALASIM Y GONZAGA), the other one is wearing also slippers, jagger pants,
plain white shirt and his face were covered by a “malong”, about 6 feets in height (XANDER
FORD Y MALAYAN) and the other suspect belive to be a minor is wearing shoes, black shorts,
spider man shirt and about 4’ 5’’ in height (JOHN MAR IGPUARA Y LARGADO).

9. Q: Do you swear to the truthfulness and veracity of your statement in this affidavit?

A: I am executing this affidavit to attest to the truth and veracity of the foregoing
averments and for the purpose of filing a criminal charge of MURDER against the three (3).
