COMPLAINT-AFFIDAVIT

I, MAANN GO, Filipino, of legal age, single, and a resident of The

Lerato Tower, Makati City, Philippines, after being sworn to in
accordance with law, depose and state:

1. That I know the person of MITCH SANTOS, who is a resident

of 123 Nacoolac St. Caloocan City, Philippines;

2. That sometime in the morning of 1 February 2022, at

Makati City, Philippines, the said Respondent issued in my
favor a Banco De Oro Check No. 123456 in the amount of
Fifteen Million Pesos (P15,000,000.00) as supposed
payment for the loan accommodation of the same amount,
which I have extended to her;

3. That the said check is drawn against the account of the said
Respondent at Banco De Oro with Account No. 654321;

4. That the said check was due and demandable on 15

February 2022;
5. That at the time the said Respondent issued the delivered
the said check to me, she made the assurance and
representation that the said check is a good check and
would be covered by sufficient funds when presented for
payment;

6. However, when the above-mentioned check was deposited,

the same was dishonored and returned by the bank on the
ground that the same was drawn against an "ACCOUNT
CLOSED." A true and faithful machine reproduction of the
said check is hereto attached as Annex "A";

7. As such, I immediately notified said Respondent of the

dishonor but the call I made to her was ignored. A true and
faithful machine reproduction of the call logs from my
phone to her is hereto attached as Annex "B";

8. When said Respondent failed to heed my demands, I

endorsed the said check to my legal counsel who
immediately sent a Notice of Dishonor on 27 February 2022,
which was personally received by the said Respondent at her
residence in Caloocan City. A true and faithful machine
reproduction of the Notice of Dishonor is hereto attached as
Annex "C";

9. When the Respondent failed once again to heed my

demands, my legal counsel immediately sent a Notice of
Dishonor with Demand to Pay on 10 March 2022, which
was once again personally received by the Respondent at
her residence in Caloocan City. A true and faithful machine
reproduction of the Notice of Dishonor with Demand to Pay
is hereto attached as Annex “D”;

10.As of date, however, Respondent has unjustifiably ignored

all these demands to pay the said account and/or to redeem
the said returned check.

11.I am therefore executing this Complaint-Affidavit in support

 of the charges for Violation of Batas Pambansa Bilang 22
against the said Respondent, who may be served with
subpoena and other processes of this Honorable Office at
her last known address at 123 Nacoolac St. Caloocan City,
Philippines;
