1. In Carmel Craft Corp vs. NLRC, the court held the company liable to pay its illegally dismissed
employees a separation pay because of its unfair labour practice. The owner intimidated its employees
that if they will not agree to transfer into other union, she will closed the company which she did. The
employees also proved before the court that the main reason why the company closed is not because of
serious loss, but to obstruct or to halt the formation of the union.

2. The corporation must satisfy all its monetarial obligations, the wages and benefits of the employees,
payment for the suppliers before it can actually proceed to its proper closing to avoid difficulties.

commission of the crime. The law only requires the commission of the crime even there is no present
finality of a court.

4. It depends. If the completion of the project lasted less than 6 months, Diosdado may be dismissed
validly. If the completion of the project has required to be finished for more than 6 months, he cannot
be terminated even he is preferred as a project employee. The completion of the project does not
authorized the company to dismiss him. His nature of work is essential to the company after all.
