MUHIMBILI NATIONAL HOSPITAL

CONTRACT OF EMPLOYMENT

This contract is made between MUHIMBILI NATIONAL HOSPITAL (hereinafter referred to


Employer) of P.O. Box 65000, Dar es Salaam Tanzania on the one part and MR. RAJABU
ATHUMANI NYAWILI hereinafter referred to as Employee) of P.O. Box 177, PWANI on the
other part and it is agreed as follows:

1.0. DESIGNATION AND TERMS OF EMPLOYMENT


1.1 MNH shall employ the employee as Technician (Mechanical Engineer) llwith effect
from 01"t June, 2021 on Permanent and pensionable terms. This appointment shalltake
effect from the date the employee accepts the offer of appointment and report to work.

2.0 PROBATION
2.1 The employee will initially be on probation for a period of one year at the end of which and
subject to his work and conduct being satisfactory, he will be eligible for confirmation in
his appointment.

22 Continuation of this employment contract shall depend on job performance and attainment
of set targets, behaviour, and conduct as assessed by the Management from time to time.

3.0 EMPLOYEE'S DUTIES AND RESPONSIBILITIES


. To carry out specified tasks connected with mechanical,
. To assist in the repair and maintenance of mechanical or instrumental workshop
-.facilities,
To carry out, independently, specified routine technical tasks which require a higher
degree of technical knowledge and skills,
To perform any other related duties as may be assigned by his Supervisor.

4.0 EMPLOYEE'S OBLIGATIONS


4.1 The employee shall devote the whole of his working time and attention to the diligent
performance of his duties entrusted to him by MNH in connection with the position to which
he has been appointed and shall comply with the MNH staff regulations 2014 and as
amended from time to time.

42 The employee shall not without prior consent from MNH engage in any other employment
other than his employment with the Hospital.
43 The employee shall not at any time during or after the period of his employment with the
hospital disclose to any other person or company or make use of any information
concerning the business affairs of MNH which may come to his knowledge by reason of
his employment at MNH.
4.4 The employee shall at all times conduct himself properly and show respect to duly
constituted authorities both inside and outside MNH.
4.5 The employee agrees to operate according to the policies and procedures of MNH.
4.6 Strike at the work place and extended meetings are absolutely prohibited. The
employee is not allowed to strike or organize extended meetings at the work place
without consent of his employer.
5.0 EMPLOYEE'S RIGHTS
The Employee will be paid a gross salary of (PGSS 5/1) Tshs. 1,000,000/= per month
subject to applicable taxes and statutory pension oontributions to the PSSSF. In
this
regard, the employee will contribute 5o/o of his basic salary towards her pension fund
and
the employer will contribute 15%.

6.0 LEAVE

7.0 LEAVE TRAVEL ASSISTANCE


7.1 Leave travel assistance shall be guided by the existing standing orders for the public
Service and Hospital Staff Regulations.

8.0 MEDICAL
8.1 The Employee and her family shall be eligible for medical treatments administered under
National Health Insurance Scheme, in which the employee will be contributing Sy. to
the
fund. This is mandatory, hence each employee is -bound to be registef,o by this
insurance programme.
8.2 lf the employee is absent from work by reason of injury or sickness he shall be permitted
local sick leave not exceeding six months on full piy and six months on half pay in
any
sick period. Where a need arises for leave in excess of these periods consideiation shall
be given to the termination of a public servant's appointment on medical grounds.
8.3 In case of accidents at the work place, the Employee is eligible foi compensation
under
the Workmen's Compensation Laws in Tanzanta.

9.0 TRAINING
9'1 The Emplo for training after three years of service, where applicable
and shall b training bond. In the course of employment, the employee
will also be and shortterm training aiming at improving skills.
9'2 This contract shall be terminated if the employee opts to go for further studies beforii
completion of three years service as prescribed above.
9.3 Training shall be based on the Hospital training pfan. In this regard, the employee may
be granted leave without pay in the ev :nt tnai he/she opts to
[ursue a fulltime course
which is not in the Hospital training plan provided he/she has served in the Hospital for
three years.

1O.O REPATRIATIONTRAVEL
10.1 Repatriation shall be guided by the existing public service regulations on retirement.
10.2 Where a contract has been terminated under clause 13, MNH shall pay the employee
accrued leave pay and other entitlements as stipulated in the labour law.
10.3 MNH shall be entitled to recover from the employee all amounts due cjr becoming due to
MNH by deducting such amounts from any sums which may be due to the empioyee at
the date of termination of his employment.

11.0 TRANSFERS WITHIN THE ORGANIZATION.

11.1 The employee may p9 required by MNH to be transferred to any other station
opefated/managed by MNH at its sole discretion.
12.0 REVIEW OF THE TERMS AND CONDITIONS
12.1 These Terms and Conditions of employment may be reviewed at any time as a need
arises on mutual agreement.

13.0 TERMINATION OF CONTRACT


13.1 MNH may terminate the employment by: -
1' Termination for breach of contract or if the employee is guilty of serious
misconduct.
2. By giving at least one month notice in writing or payment of one month's
salary in lieu.
3. As in clause 9.2 above.
13.2 The employee may terminate employment by either giving notice of not less than three
months of his intention to do so or in writing or payment of a month's gross salary in lieu
of such notice.

14.0 APPLICABLE LAW


14-1 This agreement shall be construed and interpreted in accordance with the laws of
Tanzania. -",'.-.
