CHARTER OF DEMANDS
PREAMBLE

The structure of Pay scales presently in vogue was effective from 01.08.2002
and therefore, Revision thereof has become due from 01.08.2007.

While formulating the Demands, especially on Revision of Wages/Wage


structure which predominantly comprised of demands in economic terms, it is
essential to go into the broad spectrum of things and issues which are
confronting the General Insurance Companies and its Employees. Essentially
the economic demands cannot stand in isolation without due focus on issues
quite relevant to it and forms the basis for evolving proper perspective to the
issue of Wage Revision per se. In addition to contributing its role in terms of
its impact on economic demands, these issues do require its due attention at
the time of discussing issues at macro-level.

With this perspective, the following issues are listed hereunder:

1. RE-ORGANISATION

The Demand for formation of One Single Monolithic Corporation had remained
without much progress thereof. The pooling in of effective strengths-
Financial, Administrative, Technical and Marketing – based on the experiences
gained over three decades of its existence could get assimilated for achieving
best results in the industry. The Demand is reemphasised and it is insisted
that a dialogue be opened up for crystallizing the formation of One
Corporation.

Notwithstanding the above Demand, on Re-organisation required on the


functional aspects, the insistence would naturally be on ‘Full Functional
Autonomy’ to the Public Sector General Insurance Companies. While granting
functional freedom, the Government may take assurances on performance
from the managements so as to ensure that the performance levels are
maintained as per the expectations of the Administrative
Ministry/Government.

Various suggestions given by GIEAIA from time to time in response to the


recommendations of external agencies – like ‘Ferguson’ – remains and re-
emphasised here. The expectation level of customers, fast-pace of changes
taking place within the industry – such as removal of tariff barriers,
preparations towards new products development – all these issues require
meaningful, constructive and responsive bilateral discussions and the GIEAIA
with its majority representative character expects the management to roll-out
proper mechanism hereof to ensure that the companies make best use of the
talents available for achieving exemplary results out of these changes.

Recent initiatives of the companies in engaging external agencies like ‘Boston


consulting Group’, ‘Pricewaterhouse Coopers’ with terms of reference relating
to restructuring, needs to be brought within the ambit of ‘BILATERALISM’.

In our considered opinion this is not the panacea for the ills afflicting the
industry. The remedy lies in “Formation of one Single Monolithic
Corporation”.

These Macro-level changes do mean further pressure on Employees – in


addition to the work pressures transpired on them following mass exits
through ‘SVRS’ and therefore, these aspects do contribute while deciding the
factors for revision of wages and the need for granting substantial hike.

2. RECOGNITION

This is one of the long pending demands – Demand remains unresolved for
more than three decades now. In partial consideration, the Check-off
exercise was introduced in the year 2004 and the industry-wise second such
exercise was conducted in 2006. Undoubtedly the GIEAIA had established its
majority character under both the exercises. Following these exercises,
representative character of the Association have been well established and it
is time for us to move forward – from the stages of Check-off to full-fledged
Recognition of Union – The GIEAIA This has become necessary in view of the
fact that the bilateral mechanism as presently available does not truly reflect
the benefits and advantages of ascertaining the representative characters of
various unions and the GIEAIA, having proved its strength as per its claims
needs better positioning to further the cause of employees and the Industry
to enable it to play its effective role.

The emphasis on recognition at this juncture does assume significance –


extending proper recognition based on representative character of the Union
would be crucial in the forthcoming negotiations and finalization of Charter of
Demands and other issues at the Macro-level.

3. OUTSOURCING

On the issue of outsourcing, the position of Managements had remained


lackadaisical. In the name of outsourcing, some of the ‘CORE FUNCTIONS’ of
the offices – like claim settlement of Mediclaim Policies, some of the functions
under Motor claims – were also ‘OUTSOURCED’ despite opposition from
GIEAIA, with the result the service parameters of the Companies in these
segments have been coming down. As a consequence, the efficient, effective
and experienced manpower available within the companies have not been
utilized properly in these areas. On a number of occasions, the

employees were to face the wrath of customers who were otherwise


dissatisfied with the kind of service extended by those Third Party
Administrators who were engaged therefor.

It is, therefore, very essential that in order to protect the brand image of
Public Sector General Insurance Companies, the management shall forthwith
stop the contemplated move of outsourcing.

4. RECRUITMENT

The Public Sector General Insurance Companies have been registering


phenomenal progress and growth consistently year-after-year. There had
been no addition to the workforce subsequent to the last general recruitment
drive conducted during the year 1991-1992. Despite regular exits by way of
retirements and resignations and of mass exits through SVRS, the Companies
could achieve these results with additional burden being shouldered and
shared by the employees in a big way. It should be borne in mind that the
absence of “NEW ATTRITION” affects the performance levels of the
companies. This is one of the very important factors being kept before while
formulating the Charter on pure Economic Demands.

As an upshot, it is emphatically emphasized here that the need for making


additions to the staff complement of the companies cannot be brushed aside
further and in order to raise further the performance levels of the operating
offices, the recruitment drive has to be taken up forthwith. It is a fact that
despite best efforts of the employees at the operating offices who were taking
on additional burden to off-set the space fallen vacant on account of exits,
the vacuum could not get filled up fully and with the challenges confronting
the Industry/Companies, the necessity to increase our workforce would
become paramount. We are sure and confident that substantial rise in ‘Wage
Package’ and increased workforce would be the two important factors

to counter the effects of “EXITS’ AND ‘BRAIN-DRAIN’ and the companies can
look upon the reap spectacular returns on its investments in human capita.

5. PAY SCALES

I The existing pay scales shall be linked to


All India Consumer Price Index 2944 (Base 1960 = 100), Index average of
April 2007 to June 2007 in such a manner that:-

i) While constructing pay scales ensure inter-se Class and Cadre


relativity.
ii) All allowances should be linked with Basic Salary irrespective of
Class and Cadre.

iii) ‘SPECIAL PAY’, ‘PERSONAL PAY’, ‘FIXED PERSONAL ALLOWANCE’


and such other pay which is treated as Basic Pay should be added
to BASIC PAY before merger.
iv) The neutralization of minimum of 125% for Class IV and 120% for
Class III shall be realised.
v) The span of all pay scales shall be reduced.
vi) The new pay scales would result in minimum 20% rise in terms of
take home pay (Basic + Dearness Allowance – P. F. Contribution)
at all stages.
vii) An employee who has reached the maximum of the present pay
scale shall be placed in next higher pay scale.
viii) One Stage higher fitment in new pay scales.

6. DEARNESS ALLOWANCE

Dearness Allowance shall be granted at


100% neutralization for every point of rise in All India Consumer Price Index
over 2944 for industrial workers (Base 1960 = 100), the index average of
April to June 2007.

The revision of Dearness Allowance shall


be made quarterly.

For the purpose of calculation for


particular quarter, the index figure of last quarter will be taken.

7. HOUSE RENT ALLOWANCE

All employees including those who are provided with Staff Quarters
shall be paid House Rent Allowance @ 30 per cent of the Basic Pay.

8. CITY COMPENSATORY ALLOWANCE

The Scale of City Compensatory payable to the employees shall be as


under:

PLACE OF POSTING RATE


Cities with population exceeding 12 lakhs Urban
agglomeration and National Capital Region, employees @ 10%
posted at project towns and any city in Goa, Gurgaon,
Faridabad, Ghaziabad, Noida, Vashi, Gandhinagar and
such other cities

City with population of 5 lakhs and above but not @ 8%


exceeding 12 lakhs, State Capitals and such other
places where Central Government / State Government
employees are eligible for City Compensatory
Allowance.
City with population of One Lac and above but not
exceeding 5 lakhs @ 6%
All other cities with population of less than 1 lac @ 4%

NOTE:

1. Population figures shall be related to latest census and also the Midterm
Population appraisal made by the Central Government / State
Government.

2. Employees transferred from CCA center to Non CCA center or center with
lesser CCA, the existing CCA shall continue.

9. TRANSPORT ALLOWANCE

All employees shall be paid Petrol Expenses of ONE LITER a day

10. ALLOWANCE FOR PHYSICALLY CHALLENGED

All physically challenged shall be paid allowance @ 5% of BASIC PAY

11. QUALIFICATION PAY

Special Qualification Increments shall be granted to all the employees on


passing the following examinations and / or equivalent examination at the
rate indicated against such examination.

On reaching maximum of the grade the qualification pay will be treated as


personal pay and attract all other allowances.

12. SPECIAL FUNCTIONAL ALLOWANCE PAY

All the existing Part Time Employees and Contract Employees such as
Care Takers of the Guest Houses, Transit Camps, Holiday Homes and
engaged in other Contract Jobs shall be regularized to as permanent full time
employees.

Employees including FTS engaged in work mentioned below and / or


designated below shall be entitled to Special Pay. The Special Pay shall be
determined and linked to INDEX POINTS 2944 (Base 1960 = 100) and qualify
as BASIC PAY for all purposes.

Employees carrying cash to Banks, Employees holding Office Keys, Cashiers,


Stenographers attached to the DGM, Chief Regional Manager and above and
such employees performing a similar nature of jobs.

13. OTHER ALLOWANCES

a. HILL STATION ALLOWANCE:


Employees working at Hill Station at an altitude of 1000 meters above
the Sea Level shall be paid Hill Station Allowance @5% of the BASIC
PAY.

b. The other Centers which are declared by the Central Government, State
Government as Hill Stations, Hill Area, Special Area, Disturbed Area or
by such other name and their employees are paid such allowances shall
be, irrespective of the NOMENCLATURE of the place, entitled to receive
the allowance.

c. CHILDREN EDUCATION ALLOWANCE:


Employees shall be paid @ Rs.1000/- per child up to –2- (TWO) children
per month.

d. SPECIAL AREA ALLOWANCE:


As declared by the Government of India from time to time, the
employees posted at such place shall be given Special Area Allowance
@ 10% (Ten) of the BASIC PAY.

e. PROJECT AND PLANT AREA ALLOWANCE, PARADEEP PORT


ALLOWANCE:
All the employees working in project and plant area shall be paid Project
Area Allowance at the rate of 10% (Ten) of the BASIC SALARY.

f. DESERT / DIFFICULT AREA ALLOWANCE:


As declared by the Government of India and / or State Government
from time to time, the employees posted in Desert / Difficult Area shall
be given Desert Area Allowance at 10% (Ten) of the BASIC SALARY per
month.

g. KIT ALLOWANCE:
Employees transferred or posted to any of the Hill Stations shall be paid
KIT ALLOWANCE of Rs.5,000/-.

h. UNIFORM WASHING ALLOWANCE:


The employees shall be entitled to Uniform Washing Allowance at the
rate of Rs.200/- per mensum.

i. TRAVELLING ALLOWANCE:

I) Employees while travelling on duty or on transfer shall be paid


First Class / Second A. C. Sleeper and Rajadhani II Tier Sleeper
and Shatabdi Train Fare.

II) HALTING ALLOWANACE:


Halting allowance to all employees while on duty or on transfer
shall be paid Rs.500/- per day.

An increase of 50% of Halting Allowance shall be paid in respect


of “A” Class Cities.
An increase of 25% of the Halting Allowance shall be paid in
respect of “B” Class Cities.
Reimbursement of Hotel Charges of Three Star Hotels.
Incidental Expenses and Conveyance Expenses shall be made
on actuals.

III) In case of transfer, Travelling and Halting Allowances shall be


paid to employees’ family members and dependents. The
employees on transfer shall be paid actual cost of packing and
transport of personal luggage.

IV) Apart from reimbursement of packing and cartage, employees


shall be paid ONE MONTH GROSS SALARY as transfer grant.

V) Mid-Academic year Allowance: Employees transferred to place


of posting on transfer in the middle of academic year shall be
granted Rs.1,000/- per month till the academic year is completed.

14. BONUS / EX-GRATIA

All the employees shall be paid an amount equivalent to 20% of their gross
wages as BONUS / EX-GRATIA every year.

15. INCENTIVE SCHEME

A suitable Incentive Scheme shall be framed in consultation with GIEAIA, to


up-keep the moral of the employees.

16. MEDICAL BENEFIT SCHEME

All employees and Retirees shall be entitled to free and full Medical expenses
for self and their dependents. A Comprehensive Medical Policy covering
domiciliary treatment and such other requirements of treatment without
exclusion of pre-existing disease be given free of cost to the employees and
their dependents.

The facility of cash less settlement of claim shall be made available.

The facility of free medical check-up shall be given once in two years to the
employees and their spouses on attaining the age of –50 years.

CMD’s Ex-gratia Medical Relief shall be increased to Rs.20 lacs without any
restriction. Ex-gratia Medical Relief shall be extended to dependent parents
of the employee.

17. HOUSING AND STAFF QUARTERS

I. The Company shall provide leased Housing Accommodation or


Staff Quarters to the employees transferred and also the
employees posted at Project Town.

II. The Company shall construct Staff Quarters at all places,


commensurate to the needs of the employees.

III. The Company shall acquire for its employees flats from the
Housing Boards and such other bodies to whom it grants loans for
House Building purposes.

IV. The existing loan quantum requires enhancement


commensurating with the prevailing market trends. It shall be
enhanced as under:

Subordinate Staff - Rs. 6,00,000/-


Record Clerk - Rs. 8,00,000/-
Asst. / Sr. Asst. / Steno - Rs. 10,00,000/-

The Employees shall be granted Supplementary Loan besides Scheme Loan.

The provision for SECOND HOUSING LOAN shall be liberalized so as to


every employee can avail the opportunity for two times to exchange the
existing Housing Premises.

Provision shall be made to grant loan for major repairs and extension of the
existing house once in –5- years and not more than –3- times during the loan
term.

18. LEAVE TRAVEL SUBSIDY

a. The concession shall be available to all employees and his family


members and dependents every year.

b. The employee shall be entitled to travel up to 4000 Kms. each way


and Home Town and all cost of travel be borne by the company.

c. The concession shall be available for travelling to Home Town and /


or to any other place of his / her choice.

d. All the employees shall be entitled to travel by RAIL / II AC SLEEPER


including Rajdhani Express or by any other mode.

The reimbursement shall be to the extent of the Second AC Sleeper


Class. Train fare for 4000 Kms each way or actual expenses
whichever is less.

e. The Leave Travel Facility shall be made available to the retired


employees.

f. Option for lump sum payment shall be made available in lieu of LTS
entitlement.

19. Compassionate Appointment.

On death or Physical incapacitation while in service, one dependent of the


employee shall be employed.

20. UNIFORMS, FOOTWEAR, UMBRELLAS and RAIN COAT

All employees shall be provided with four sets of Super fine cotton Uniforms,
Two sets of Winter Uniforms, One pair of Shoes and Chappals with two pairs
of socks, Umbrella / Rain Coat annually.

21. AMENITIES
A. Adequate facilities shall be provided for sports, recreation and cultural
activities of the employees.

B. All employees shall be given reimbursement of one local daily News


Paper every month.

C. All employees shall be given free Household domestic Multi Risk Policy
for Rs.2,00,000/-.

D. The present Life Insurance Cover and GSLI and EDLI shall be revised
with a minimum cover of Rs.1,00,000/- (Rupees One Lac only) and the
cost of Life Insurance Cover shall be borne by the company.

E. The present Life Insurance Cover under GTIS shall be revised to cover
the full commutation value payable under Pension Scheme and the cost
of the cover shall be borne by the company.

F. Company shall have Canteen facilities in all the offices to provide food
at subsidised rates. During the interregnum period all employees shall
be paid Tiffin allowance of Rs.500/- per month.

G. All employees shall be given two cups of Tea / Coffee free of cost.

H. Employees’ Co-operative Credit Societies, Housing Societies at all


centers shall be encouraged. Employees Co-operative Credit Society
shall be given space for working. Company shall also grant financial,
technical and legal assistance, if need be.

22. RIGHTS AND BENEFITS FOR THE WOMEN

i) The Company shall constitute a women cell at every Regional Office


center.

ii) A woman employee after availing of Maternity leave, if prefers to


extend her leave, be permitted to avail leave on ‘loss of pay’ up to a
maximum period of Two years.

iii) The Company shall make provision for CRECHE for working mothers.
To begin with State Capitals / Regional Centers shall be provided with

creche facilities. However, where such facilities are not available, an


allowance of Rs.500/- per month shall be paid to those women
employees till their child attains the age of five years.

iv) The Company shall provide ladies Rest room in every office.

23. LEAVE FACILITIES

The Leave facilities shall be restored with following modification:

1. Casual Leave:
· In a calendar year, an employee shall be granted Casual Leave for a
maximum of –15 days.

· Provision for availing half a day Casual Leave shall be
restored.

· Additional Casual Leave shall be restored.

· Casual leave shall be granted for SIX DAYS at a time.

· Unutilized casual leave shall be converted into sick leave on full pay.

2. Earned Leave: The Earned Leave shall accrue at the rate of one day for
eleven days of duty and can be accumulated up to maximum 300 days.

The leave shall be granted –5 days minimum and 180 days maximum.

Intervening Holidays / Weekly off days shall not be reckoned as leave.

3. Encashment of E.L.: All employees shall be eligible to encash –15 days of


Earned Leave every year. The Encashment shall comprise the gross salary
with all allowances including HRA.

4. Paternity Leave: Male employees shall be granted Paternity Leave of –15


days for each delivery up to –2 living children.

24. TERMINAL BENEFITS

A) GRATUITY: An employee shall be paid Gratuity at the rate of One Month


Terminal Gross Salary for each completed year of continuous service.
Assured Gratuity Scheme shall be introduced.

B) PENSION:

1. One more option for pension shall be given to the employees.

2. Basic Pension shall be increased to 67% of the last drawn pay.

3. Commutation up to 40% of Basic Pension shall be allowed and restoration


of commutation shall be made after –12-years.

4. Full pension after completion of –30- years of service and 1% additional


pension for every year of service completed in addition to –30- years.

5. Family pension - minimum pension amount shall be raised substantially


and ceiling be removed.

6. Unmarried employees shall be allowed to nominate their dependent


parents for family pension.

7. The Basic pension shall be updated commensurate with every wage


revision in the industry.

8. The quantum of Basic Pension of pre 1986 retirees shall be enhanced


substantially.

C) Extension of Benefits to all the Retired Employees


The following benefits shall be extended to all retired employees and
their spouse
i) Medical Benefit Scheme.
ii) Leave Travel Concessions.
iii) Other Welfare Schemes.

25. ADVANCES

i) FESTIVAL ADVANCE: All the employees shall be paid one month gross
salary. Re-payable in –12- installments.

ii) VEHICLE ADVANCE: All employees shall be granted loan up to


Rs.2,00,000/- or the cost of Vehicle whichever is less for the purchase
of vehicle including motor car.

100% invoice price including registration charges and taxes shall be


sanctioned as VEHICLE ADVANCE.
Waiting period of –2- years shall be deleted. After completion of –5-
years, employees shall be permitted to purchase another vehicle.

iii) Flood / Drought / Natural Calamities advance: All affected


employees shall be granted Rs.36,000/- free of interest.

iv) LOAN FOR MARRIAGE: Loan shall be granted free of interest to the
employees up to Rs.50,000/- for his / her own marriage or for the
marriage of his / her dependents.

v) COMPUTER LOAN: All employees shall be granted loan of Rs.35,000/-


free of interest for purchase of Computer / Laptop.

26. FAMILY PLANNING INCENTIVE

Employees / Spouse who are undergoing family planning operation shall be


given one additional increment.

27. CONVERSION OF Part Time Employees to Full Time


Employees

All part Time Employees shall be regularized as full time employees and all
the benefits including Pension shall be extended to them.

All Full Time Employees will be classified as Class IV Employees.

28. DATE OF EFFECT

The demands under this CHARTER OF DEMANDS shall be given effect


from 1st AUGUST 2007 for THREE YEARS.

29. EXISTING RIGHTS AND PRIVILEGES

Notwithstanding anything contained in the CHARTER OF DEMANDS total


emoluments of any employee in any cadre shall not be reduced at any time,
no recovery shall be effected whatsoever due to the revision in the wage
structure. Nothing shall adversely affect or take away from any employee or
group of employees any rights, privileges or usage, practice or conventions,
amenities or other conditions of service that are already vested in or enjoyed
by employees.

GIEAIA reserves the right to amend, alter, add and / or delete any
part of charter of demands as may be found necessary.

Re: CHARTER OF DEMANDS.

We have great pleasure in placing our Charter of Demands before you for
upward revision of wages and other service conditions for Class III & IV
employees.

You are well aware that the present structure of Pay-scales has been brought
into effect as from 1st August 2002 and therefore, the revision thereof has
become due as from 1st August 2007.

We would, therefore, beseech you to take immediate steps to commence


expeditious and meaningful negotiations on the above.

GIEAIA, as a majority, responsible and responsive trade Union will take all
steps to ensure a speedy negotiated settlement.
