The ancient common law rule in homicide was denominated "retreat to the wall." This
doctrine makes it the duty of a person assailed to retreat as far as he can before
he is justified in meeting force with force. This principle has now given way in
the United States to the "stand ground when in the right" rule.

RA 386, Article 429: Doctrine of Self-help

The owner or lawful possessor of a thing has the right to exclude any person from
the enjoyment and disposal thereof. For this purpose, he may use such force as may
be reasonably necessary to repel or prevent an actual or threatened unlawful
physical invasion or usurpation of his property. 👎🏽

Battered Woman Syndrome as a Defense. – Victim-survivors who are found by the


courts to be suffering from battered woman syndrome do not incur any criminal and
civil liability notwithstanding the absence of any of the elements for justifying
circumstances of self-defense under the Revised Penal Code.

The battered woman syndrome is characterized by the cycle of violence, which has
three phases: (1) the tension-building phase; (2) the acute battering incident; and
(3) the tranquil, loving (or, at least, nonviolent) phase.
