The Supreme Court of Pakistan on Wednesday adjourned the suo moto hearing into the case relating to
the ongoing constitutional crisis in the country that emerged after the ruling of the NA deputy speaker
and the subsequent dissolution of the lower house on the advice of PM Imran Khan till tomorrow (April
7).

Will not issue any order about PA in haste: CJP
Reacting to the issue of Punjab Assembly, Chief Justice Umar Ata Bandial said that they cannot issue any
order over the situation in haste.
“There is an ideal situation in Punjab to approach the people,” he observed. The CJP said that they will
decide tomorrow whether to hear the matter of PA or send it to Lahore High Court.
Meanwhile, the chief justice adjourned the case till 9:30 am on Thursday.

Barrister Ali Zafar, counsel of Arif Alvi, argued that Article 69 of the constitution identified boundary
between the judiciary and the legislature.
Terming Article 69 a firewall, the lawyer said that the judiciary cannot interfere in parliamentary affairs
by crossing the firewall. “There will be a clash if the judiciary interferes in the parliament,” he added,
adding that similarly the parliament cannot interfere in the judiciary under sub judice rule.
The court will exceed his jurisdiction if it issues any direction in this case, says Ali Zafar
“Can the judiciary not interference even if the parliament violates the constitution,” asked the CJP.
The lawyer said that the parliament has two basic privileges:
Freedom of expression
Parliament is itself a master and judge of his business
He maintained that the speaker’s ruling could not be reversed, adding that the president's actions
cannot be reviewed in the court.
The only solution to the prevailing situation in the country is new elections, he argued.

“Political parties are of the view that they were declared traitor under Article 5,” Awan told the court.
The CJP remarked, “They were not declared traitor, the action taken under Article 5 is declared treason.”
The applicant political parties wanted that the reference mentioned in the ruling issued by the National

During the proceedings, the CJP asked Babar Awan, PTI’s counsel, if the speaker’s ruling based on any
findings. “Did he has any material (evidence)?” asked the chief justice.
“Can speaker issue ruling apart from agenda? Does the speaker have the authority to speak other than
the agenda?,” the CJP asked.
“Can you defend the speaker’s action? But your arguments must have grounds,” he asked Awan.

wanted to wrap up the suo motu case relating to the ongoing constitutional crisis in the country that
emerged after the ruling of the NA deputy speaker and the subsequent dissolution of the lower house
on the advice of PM Imran Khan today.
A five-member larger bench of the apex court, headed by Chief Justice Umar Ata Bandial and comprising
Justice Muneeb Akhtar, Justice Aijazul Ahsan, Justice Mazhar Alam, and Justice Jamal Khan Mandokhel is
hearing the case.
On April 3, CJP Bandial had taken suo motu notice of the constitutional crisis in the country, clubbing
multiple petitions filed by various parties and the presidential reference seeking interpretation of Article
63(A) of the Constitution with it.
At the outset of today’s hearing, Umar Ata Bandial remarked, “We want to wrap up the case today.” His
remarks came when PML-N’s counsel Azam Nazeer Tarar tried to draw the apex court’s attention
towards the issue of Punjab Assembly’s session.
“ A very important case is being heard,” the CJP said, adding that they wanted to conclude the hearing
on the case involving the action that took place in the National Assembly on April 3.
“Negative comments are being passed about the court,” he observed and noted: “It is said that the
court is delaying the case.” The CJP said that they will look into the Punjab Assembly matter latter.

Qasim Shah Suri dismissed the no-confidence motion against the prime minister and President Dr Alvi

LAHORE: The Punjab Assembly’s today’s session is in doldrums as the secretary of the provincial
assembly has refused to comply with the notification issued by the Deputy Speaker Dost Muhammad
Mazari, said well-placed sources.
The Punjab Assembly secretary was of the view that the session will be held on April 16, the sources
privy to the matter said. Quoting the official, the sources said that the assembly session cannot be
convened on a simple paper. A gazette notification is required to convene the assembly session, said
the assembly secretary.
Meanwhile, Zain-Ali-Bhatti, spokesperson of the speaker Punjab Assembly, also confirmed that the
provincial assembly session will he held on April 16.

for summoning the PA session on April 16 but after the top court’s direction, the notification has been
cancelled.
Mazari maintained that he has summoned the PA session in light with the SC orders. Responding to a

case relating to the ongoing constitutional crisis in the country that emerged after the ruling of the NA
deputy speaker and the subsequent dissolution of the lower house on the advice of PM Imran Khan on
Wednesday.
A five-member larger bench of the apex court, headed by Chief Justice Umar Ata Bandial and comprising
Justice Muneeb Akhtar, Justice Aijazul Ahsan, Justice Mazhar Alam, and Justice Jamal Khan Mandokhel is
hearing the case. The top court’s larger bench is holding proceedings in the cases on a daily basis to
decide the important case as soon as possible.
On April 3, CJP Bandial had taken suo motu notice of the constitutional crisis in the country, clubbing
multiple petitions filed by various parties and the presidential reference seeking interpretation of Article
63(A) of the Constitution with it.
During the previous hearing, Chief Justice of Pakistan Justice Umar Ata Bandial said that the court would
only determine the legitimacy of the deputy speaker’s ruling and wanted to see if it could be reviewed
and nullified.
Rejecting the suggestion of the counsel for the Pakistan Muslim League Nawaz (PMLN) on an in-camera
briefing by heads of Intelligence agencies on the alleged foreign conspiracy against the government, the
chief justice said the court did not want to interfere with the state’s affairs and its foreign policy.
Resuming hearing of arguments from PMLN counsel Makhdoom Ali Khan on the dismissal of a no-
confidence motion against the prime minister by the NA deputy speaker, the CJP said it had not been
the judicial practice to interfere with the state’s foreign policy, adding it would be easy for the court to
look into the matter in the legal and constitutional perspective. He said the constitutional right could not
be denied under the rules.
The CJP said the process to form an interim setup had stalled and the court wanted to decide the case at
the earliest. At the moment the focus of the court is on the ruling of the deputy speaker to determine if
it could examine the decision of the custodian of the parliament, he said.
The CJP said the court would decide the matter in the light of law and the Constitution. At this, Justice
Ijazul Ahsen said the court could not decide the case in a hurry as important constitutional points were
under review.
Chief Justice Umar Ata Bandial sought minutes of the crucial session of the National Assembly which was
held on March 31 to debate the no-confidence motion against PM Imran Khan.
He ordered Naeem Bokhari, NA Speaker Asad Qaiser’s counsel, to present the NA session’s minutes
before the top court.
Later, the CJP adjourned the hearing of the case till 11:30 am on Wednesday (today).

held on March 31 to debate the no-confidence motion against PM Imran Khan.
Chief Justice Umar Ata Bandial ordered Naeem Bokhari, NA Speaker Asad Qaiser’s counsel, to present
the NA session’s minutes before the top court.
Former Senate Chairman and PPP leader Raza Rabbani pleaded before the apex court to issue a brief
ruling in the case today.
At this, Chief Justice Umar Ata Bandial stated that they will issue the order today if all the parties
complete their arguments.
Terming the NA deputy speaker’s ruling “illegal”, Raza Rabbani said that Qasim Khan Suri’s ruling is
based on “dishonesty”. As per the National Assembly Rule 28, the deputy speaker cannot issue a ruling
even if he has the powers, argued Rabbani.
He maintained that the no-confidence motion cannot be rejected without conducting voting on it. The
PPP leader declared the ruling violation of the Constitution.
During the course of proceedings, the advocate general of Punjab assured the top court that the
provincial assembly will meet tomorrow (April 6) as per the Constitution.
The CJP observed that Punjab’s situation is an extension of what’s happening in Islamabad. Justice
Mazhar Alam noted that the issue will be resolved if the government hold elections for the coveted slot
of the chief minister in the province.
At this, the CJP observed that the process for a caretaker setup in the country has been halted due to
this case. He stated that the SC respects the parliament, adding that they did not want to talk about the
speaker’s powers.
Later, he adjourned the hearing of the case till 11:30 am on Wednesday (today).

ISLAMABAD: Prime Minister Imran Khan will file a petition in the Supreme court of Pakistan seeking the
formation of a high-powered judicial commission to probe the ‘Lettergate’, revealed well-placed sources
on Wednesday.
The letter is reportedly a memo/cable written by a Pakistani envoy posted in a foreign country, and is
supposed to have conveyed to the government that the said foreign country’s officials had said that if
the no-confidence vote were successful, everything would be forgiven. And that if Imran Khan were to
stay in power, things could get difficult for Pakistan.
PM Imran Khan’s counsels will approached the apex court in this regard shortly, said the sources privy to
the matter.
The prime minister will also demand the top court to probe the international conspiracy to change a
regime in Pakistan, horse-trading ahead of voting on the no-trust motion and the issue of defiant
lawmakers.
