QUESTION NO 1:

Draft a suitable Power of Attorney executed by the Owner, authorizing


her agent to sell and transfer Flat No: 1, in Baroda House, Alkapuri ,
Vadodara, and consideration to be collected in the name of the Owner
only. Also provide a foot note on legal requirements as regards payment
of Stamp Duty and Registration, if applicable.

POWER OF ATTORNEY TO SELL AND TRANSFER OF PROPERTY

KNOW ALL MEN BY THESE PRESENTS THAT THIS SPECIAL POWER OF


ATTORNEY is executed at Vadodara on this 28 th day of January 2021 that I, Ms.ABC
(hereinafter referred to as the EXECUTANT),

DO HEREBY APPOINT, NOMINATE, CONSTITUTE AND AUTHORISE


Mr.XYZ (hereinafter referred to as the ATTORNEY) at present Residing at FLAT
NO.201, SHREE SIDDHESHWAR HOMES, SAMA – HARNI LINK ROAD,
VADODARA, as my true and lawful attorney to perform all legal acts with full authority
to do and execute the following acts deeds and things for me, in my name and on my
behalf.

WHEREAS Executant herein is the sole and absolute owner, and peaceful possessor of
the Flat No.1 in Baroda House, admeasuring area of 67.35 Sq. Mtrs, forming a part of
the Sanctioned layout Plan of Survey No 190/1, situated at Alkapuri , Vadodara District
(Hereinafter called the said property), having purchased through a Registered Sale Deed
Document No. 7603 dated 28- 08- 2012, Registered in office of the SRO Vadodara
District.

WHEREAS I can't by and by administer and administrate, safe gatekeeper the above said
property, I thus arranged, assign and establish the above said Attorney to do the
accompanying demonstrations, deeds and things in my name and for my sake.

NOW THIS SPECIAL POWER OF ATTORNEY WITNESSESTH AS UNDER:-

1. To oversee and keep up and to hold, shield ownership, oversee and keep up the
said property.

2. To negotiate on terms for and to consent to and sell said property, completely
referenced and portrayed in the Schedule hereto to any buyer or buyers at such
value which my said Attorney, in his outright circumspection, figures legitimate,
to concur upon and to go into any understanding or arrangements for such deal or
deals as well as to drop or potentially disavow the equivalent.

3. To execute and enlist deeds- To sign, execute, enter into, adjust, drop, cancel,
draw, favor, present for enlistment and concede enrollment, all things considered,
records, arrangements, transports, grants, declarations, applications, statements,
trust deeds and different archives as may in any way be needed to be so
accomplished for or regarding the said property having a place with me associated
with the sale and transfer or getting of clearances or grants from the Government
or for some other reason at all.

4. To sign all the papers, documents, receipts, declarations, affidavits, forms,


applications etc., and any remaining significant papers in my name and for my
benefit, in regard of the above said property.

5. To sign the necessary transfer form for transferring the said property to the name
of the Purchaser in the records of the Municipal Corporation and In the Revenue
records, local body and other Government records for the Purchaser.

6. Accepting monies - To demand, collect, and get off also, from individual or
authority including government as well as neighborhood bodies whomsoever
concerned or chargeable therewith all or each aggregate or amounts of cash
including buy consideration, and/or some other cash or funds which will have a
place or be or get payable to me with regards to the transfer of the said property
made for my benefit and on my behalf.

7. To present any such conveyance for registration, to concede execution and receipt
of thought before the Sub-Registrar or Registrar having expert for and to have the
said movement enrolled and to do all demonstrations, deeds and things which my
said attorney will consider important for passing on the said property to the said
buyer or buyers as completely and solidly in all regards as I could do a similar
myself.

8. To file declaration - To prepare, sign, declare and declarations, statements,


applications and additionally returns and in any case regarding transferring or in
any case managing my property prior to any proper or other authority as might be
needed under any law or laws presently overarching or as may in future become
relevant and to do, work out, execute furthermore, play out any or all the important
demonstrations, deeds and things required there under.
Also, by and large my said attorney will have the ability to do every single such act,
deeds and things for my sake and I might have legitimately done, if by and by present.

AND, I do thus for myself, my beneficiaries, agents, executives of acts done and
legitimate delegates sanction and affirm and consent to endorse and by attorney affirm all
and at all my said attorney will legally do or cause to be finished by temperance of these
presents.
