3 The most significant thing that happened between March 2020 and March 2022 is the

5 Back in March 2020, the Australian population had robust natural immunity. There were
6 no COVID-19 vaccines and the alleged original strain of the virus caused much more
7 severe infections.
8 Now, COVID-19 vaccines are very much in the picture and natural immunity barely exists
9 among the vaccinated. Data also showed the omicron variant was dominant and caused

14 The first wave of the pandemic that hit the country as a whole was the least severe. When a
15 second wave hit the country in August 2020, it was more severe. Then deaths fell to almost
16 zero three months before the first COVID-19 vaccine was administered in the country, and
17 they remained at virtually zero until August 2021.
18 Australia experienced a wave of deaths comparable to the August 2020 wave, but lasted
19 much longer and never declined to near zero again. Deaths were at least steadily declining
20 until the vaccine booster campaign began and deaths were again recorded at an alarming

28 The NSW government had been producing a weekly coronavirus Statistical Report, but
29 recently decided to stop publishing it. Included in these reports was the number of deaths
30 by vaccination status, which showed that the worst day for deaths throughout March
31 was recorded on the 31st:
32  There were three deaths among the unvaccinated.
33  There were nine deaths among the double-vaccinated.
34  There were five deaths among the triple-vaccinated.
35 Between March 1 and 31, the NSW government revealed that 195 people lost their lives.
36 This is eight times as many deaths as what occurred during the first three months of the
37 pandemic in NSW in 2020.
38 Of the 195, only 31 were considered unvaccinated. However, even this may not be true
39 because NSW still considers a person unvaccinated within 21 days of actually getting a
40 COVID-19 vaccine.
41 The highest number of coronavirus deaths was recorded among the double-vaccinated
42 population with 92 deaths while the triple-vaccinated population recorded 67 deaths. There
43 was also one death recorded among the quadruple-vaccinated population.
44 A chart on the percentage of coronavirus deaths between the vaccinated population as a
45 whole and the unvaccinated population showed that overall the unvaccinated population
46 accounted for 15.8 percent of all coronavirus deaths between March 1 and 31.
47 The vaccinated population accounted for 84.2 percent, which means over four in every five
48 coronavirus deaths in NSW are among the vaccinated population. This is probably why the
49 NSW government wanted to make the data hard and tedious to find.
50 Like the rest of the world, Australians have had to deal with strict mandates in an attempt
51 to deal with the coronavirus. They’ve experienced long lockdowns and were unable to

2 Australians were also required to present permits to go to work and had to go through
3 military checkpoints just to leave their homes as they traveled to their offices. Based on the
4 data, there’s no denying many Australians who were practically bullied into getting
5 vaccinated actually put themselves at risk because of the COVID-19 vaccine.

25 grandson Dion Schorel was kidnapped by the Children Protection Society on about 16
26 December 2021 and since took it upon itself to refuse to communicate with my son Mark
27 Schorel (Dion’s father) even so Dion was in his care prior to what I consider to be the
28 kidnapping, false imprisonment, causing undue harm to Dion and placing his safety and
29 wellbeing in jeopardy.

22 Are the COVID-19 Vaccines Safe?
23 Before a vaccine is deemed safe, it goes through what the Centers for Disease Control and
24 Prevention (CDC) calls “rigorous” testing. Initially, safety trials start in the lab, where
25 experts run tests on (and research) cells and animals — and that’s all before human studies
26 are given the green light.
27 Additionally, CDC guidelines require that “vaccines pass through six general stages of
28 development: exploratory, pre-clinical, clinical, regulatory review and approval,
29 manufacturing, and quality control. …It’s not unusual for a vaccine to take 10 to 15 years
30 to complete all the phases under normal circumstances.” Obviously, these are not normal
31 circumstances. Although speeding up the development process was necessary, leading
32 experts, including Dr. Anthony Fauci, stated that attempts to fast-track a vaccine should
33 not supersede the fact that a vaccine must be both safe and effective before distribution.
34 For example, Pfizer ran its own tests and clinical trials that included more than 44,000
35 adult participants, while Moderna ran a 30,000-person efficacy trial. After these trials and
36 the FDA’s own analysis, which found “no specific safety concerns,” the vaccines were
37 authorized for emergency use. Dr. Fauci has gone on record stating that he has “extreme
38 confidence” in the safety of the approved vaccines and even received the Moderna
39 vaccine on camera in late December 2020. The Pfizer vaccine specifically received full
40 support from the FDA after satisfying the agency’s strenuous testing and review processes

32 the Ministry of Health, in collaboration with the World Health Organization, decide which
33 vaccines are added to the national immunisation program, taking into consideration

35 Vaccines undergo rigorous scientific evaluation by regulatory authorities. Vaccines
36 are rigorously reviewed and tested to make sure there is evidence that they are safe,

39 manufacturing information to assess the benefits of each vaccine. Regulators may decide to
40 solicit independent expert advice from vaccine scientific committees. The decision of
41 whether or not to approve each vaccine for use is made by the government regulator

43 Vaccines are medicines of continuously proven pharmaceutical quality. Vaccines are
44 manufactured according to the same high standards as other medicines. Vaccine
45 manufacturers are required to meet manufacturing quality standards, and as a further
46 check, batches may undergo laboratory testing by individual national regulatory authorities
47 before they can be supplied to the public.
48 Assuring vaccine safety is an extremely important part of their regulation. Regulators
49 will only allow the use of a vaccine if its benefits outweigh potential risks, monitoring

5 contain, other substances used to make the vaccine more effective or to stabilise it during
6 storage. When evaluating a vaccine for safety and effectiveness, regulators take all of
7 the ingredients of a vaccine into account, including the active ingredients as well as
8 other substances.
9 Each vaccine lot is individually tested by the National Control Laboratory. In addition
10 to the quality tests performed by each manufacturer, vaccines belong to a special category
11 of medicines which are also subjected to analytical testing by a governmental control

33 public that everything that was normally done in clinical trials for a vaccine was done for
34 the COVID shots. Now we’re told that was not the case after all.

38 Over the past three years, mainstream media have promulgated the lie that the COVID
39 shots will prevent infection and transmission, telling us that anyone who doesn’t get the
40 shot is selfish at best, and at worst, a potential murderer at large. Anyone who refuses
41 poses a serious biomedical threat to society, hence the need for heavy-handedness.
42 Alas, it was all a lie from the start. The frustrating part is that we’ve KNOWN for well
43 over two years that the shots were never tested for transmission interruption, yet everyone
44 in government and media insisted they would do just that.

2 By then, Moderna had also admitted they were not testing its jab’s ability to prevent
3 infection. Tal Zaks, chief medical officer at Moderna, stated that this kind of trial would
4 require testing volunteers twice a week for long periods of time — a strategy he called
5 “operationally untenable.”5
6 So, neither Pfizer nor Moderna had any clue whether their COVID shots would prevent
7 transmission or spread, as that was never tested, yet with the aid of government officials
8 and media, they led the public to believe they would. Below is just one example where
9 Pfizer clearly obfuscated the truth. 6 If stopping transmission was their “highest priority,”
10 why didn’t they test and confirm that their shot was accomplishing this priority?

12 Similarly, in an Israeli interview7 (below), Bourla stated that “The efficacy of our vaccine
13 in children is 80%.” The reporter asked him to clarify, “Are you talking about efficacy to
14 prevent severe disease or to prevent infection?” and Bourla replied, “To prevent infection.”
15 How could he say that when preventing infection has never been tested? Is that not
16 evidence of fraud, caught on camera?

18 tracing the moment this was required the cases dramatically escalated as more than likely those
19 doing the “contact tracing” were the super spreaders of whatever. As for the lockdowns/curfews
20 well I recall President Donald Trump to state that going in the sunshine would be a good thing.
21 He was ridiculed for this. Well, locking up people in their homes I view is precisely the worse
22 thing to do (apart of their constitutional and human rights issues) and as I wrote at my blog cats,
23 dog, and other house animals are infect likely a source of diseases and so preventing animal
24 owners to go outside in the sun may enhance them to become more ill.

26 The mantra of the Victorian Government (besides that of the Federal Government) and the usage
27 of the media resulted that on 28 August 2020 I was physically assaulted by a man about one third
28 of my age by hitting me with a trolley, and twisting my arm, etc for not wearing a mask. I did
29 file a police report with the Victorian Police at Greensborough and advised the police that Coles
30 management had made known that it would provide a video recording to the police when
31 requested for this about the incident. I was also given the understanding by Coles management
32 that all trans actions at the checkout are video recorded. Yet the police officer claimed that he
33 didn’t get the video’s and despite that I had provided a photo of my assailant somehow that
34 neither seemed to be of any assistance! In my view the police likely couldn’t bother to
35 investigate properly the complaint because it was mad about enforcing compulsory mask
36 wearing.
37 Regardless of the alleged “mandates” by the Chief Health Officer Bret Sutton from time to
38 time, it was not my job to fight the State of Victoria but rather it was up to the businesses to
39 challenge the validity or the lack thereof.

41 I understand that Bret Sutton is not a qualified medical doctor and neither had any reliable
42 scientific date to base any mandates upon (even if he had the legal powers to issue mandates,
43 which I hold he never had). Indeed, after my writings to Premier Daniel Andrews that the State
44 couldn’t allow an administrator to issue mandates then the Victorian Parliament went about to
45 purportedly exercise prerogative powers to allow the Premier, even so not being the Minister for
46 health to issue declarations of a pandemic without any need for what it was about nor if any
47 pandemic existed at all in real medical terms.

15 If the scientific “gold standard” COVID-19 test (the PCR) doesn’t even provide proof that
16 the virus causes the disease, why is everyone rushing around like a headless chicken?
17 The PCR test doesn’t identify or isolate viruses, doesn’t provide RNA sequences of
18 pathogens, offers no baseline for comparison with patient samples, and cannot determine
19 an infected from an uninfected sample. That is staggeringly useless and scientifically
20 meaningless!
21 The reality is that we have no idea how many people actually have COVID-19. The CDC
22 cannot “confirm” something for which there is no accurate test.

6 grandson Dion’s health and wellbeing they could have sought to assist my son Mark to resolve
7 this, this as perhaps if it was an issue about accommodation they could have assisted with
8 emergency housing (after all not to do so while doing so for females in a similar position would
9 be sexual discriminatory) and/or could have contacted the Minister for age and invalid pensions
10 and/or the Federal Minister for Health as to transmit any concern it may have had at the time so
11 the Commonwealth could act if it deemed so required.
12 I about 4 decades ago actually cross-examined a social worker from the Child Protection Society
13 and exposed that this social worker had fabricated evidence and sworn an Affidavit as well as
14 given evidence under oath for the same. As such, pursuing to perverting the course of justice.
15 The trial judge then accepted that the evidence of the social worker was not correct in facts
16 because the social worker evidence was that she saw a child playing with a brother, about 6
17 months before the child was born! And while the judge suggested that the witness may have
18 been in error with the year, the evidence from the witness showed this to be impossible, this as
19 her report was concluded about 4 weeks after the child was born.
20 I suspect likewise that if there were any litigation regarding my grandson Dion, to which I have
21 no knowledge having occurred, then more than likely the Department may have concealed
22 relevant details including that it had no jurisdiction at all concerning my grandson Dion, this
23 because Dion is in the exclusive Commonwealth legislative, executive and/or administrative
24 powers.

26 Because the proposed Commonwealth of Australia federation was without any legislation on 1
27 January 1901 and there had to be an election held to have Members of Parliament as well as
28 legislation to be enacted subsequently, the Framers of the Constitution in their wisdom held it
29 was better to provide the States with “concurrent” legislative powers until the Commonwealth
30 was to commence legislation upon a certain subject matters. Once the Commonwealth
31 commenced to legislate on a certain subject matter then the States no longer had “concurrent”
32 legislative powers.
33 This also means effectively that any weight and measure instruments used by the law
34 enforcement authorities in any state must be approved by the Commonwealth as otherwise such
35 usage of weight and measurement instruments are without legal basis!

42 circumstances as urgent as curtailing the spread of a pandemic.
43 Over the last 20 months, the LIV has been generally supportive of introducing measures

1 that are appropriately tailored and proportionate to the risks presented by the pandemic but
2 has always maintained that that power should not be unfettered. There is an opportunity
3 now, as restrictions ease and vaccination targets are reached, to reflect on the measures
4 taken to contain the COVID-19 pandemic, and to ensure that only the least restrictive
5 means possible to achieve public health objectives are used to contain future outbreaks of
6 infectious diseases of pandemic proportions.
7 The Bill has been introduced at a time when the Victorian population is reaching its
8 target vaccination rates, and we would question whether passing these powers so
9 urgently in these circumstances is proportionate to the reduced risks currently posed
10 by the pandemic. Rushed legislation is often compromised legislation. The LIV urges
11 pause for law makers to further consider the potential impact of the proposed legislation, as
12 it needs to be fit for the purpose of protecting our democracy, safeguarding members of the
13 community, and be unable to be exploited by governments of unknown persuasions in the
14 future.
15 We summarise our views and recommendations about the Bill below, but we would urge
16 you to read the Position Paper, which is here.

25 About 4 decades ago, while I was at the bar table referring to “assault” the trial judge made clear
26 that this had utterly no meaning because the opposing party would have no way of knowing what
27 I was referring to. As His Honour made clear that unless I presented details as to what I held
28 constituted an “assault” the other party had no way to be able to respond. It was a lesson I kept in
29 mind whenever I represented a party at the bar table. The opposing party legally represented in
30 the end did plea guilty of assault, nevertheless it was a lesson well learned. It often assisted me in
31 litigation where opposing counsel made the same or similar error.

33 For example, when I was representing a party regarding CONTEMPT OF COURT I made clear
34 to the opponent lawyers their case was without legal justification, upon which they sought to
35 withdraw it. I opposed this making clear that once filed it becomes the property of the court.
36 Subsequently the Court confirmed that once filed the CONTEMPT OF COURT application
37 became the property of the court and the party that filed it no longer could withdrew it. Harbison
38 J March 2009.
39 Actually, I submitted that the proceedings should be stayed permanently and this was so ordered.
40 Preventing the opposing party to refile anything as such, in the hope to correct their defects.
41 When I appealed orders of Administration, it never came to a hearing of witnesses, this because I
42 pointed out that the medical experts had made their reports based upon misleading information
43 by the Lawyer of the Public Advocate. This appeal succeeded without any witnesses needing to
44 be called.

46 It is very important that when one deals with litigation one MUST explore the legal basis first.
47 No use to argue about if’s and but’s if there is no legal basis in the first place for litigation.

49 As Nicola Gobbo as I understand it showed that lawyers misusing and abusing their positions is
50 not uncommon. However, often others are involved such as Carl Williams murder was
51 investigated and a person was convicted but it appears to me the once who did set it all up were

1 never held legally accountable. For example why did no investigation bothered to check the time
2 and date the additional CD’s were burned that were found in the possession of the governor (who
3 disappeared some weeks later) and a prisoner? After all, if the copies were burned prior to the
4 police officer having delivered the copy to Carl Williams (Re his statements) then the Victorian
5 Police was clearly involved, at least in my view. And if the copies were burned at the time the
6 CD was checked by the prison authorities (as they ordinary do) or thereafter then it means a copy
7 was saved on the prison hard drive and then later copies burned.

9 The documents I read in Carl Williams writings indicated to me that he suspected that Nicola
10 Gobbo was a police informer. One then also has to ask if the tip of to the Herald Sun was
11 designed to start the murder by the inmate.

13 The Commonwealth charged me with FAILING TO VOTE in the 2001 federal election and
14 subsequently also regarding the 2004 federal election. Years of litigation ensured and all along
15 representing myself I had never any doubt that they so to say were barking upon the wrong tree.
16 In the end they lost both cases! I simply as a constitutionalist relied upon the true meaning and
17 application of the Commonwealth of Australia Constitution Act 1900 (UK)! Any lawyer who

25 The role of implications in Australian constitutional law has long been debated. Jeffrey
26 Goldsworthy has argued in a series of influential publications that legitimate constitutional
27 implications must be derived in some way from authorial intentions. I call this the
28 intentionalist model of constitutional implications. The intentionalist model has yielded a
29 sceptical response to several recent High Court decisions, including the ruling in Roach v
30 Electoral Commissioner that the Constitution enshrines an implied conditional guarantee
31 of universal franchise. This article outlines an alternative way of thinking about
32 constitutional implications, which I call the narrative model. I argue that at least some
33 constitutional implications are best understood as arising from historically extended
34 narratives about the relationship of the constitutional text to wider social practices and
35 institutions. The article begins by discussing the limitations of the intentionalist model. It
36 then considers the role of descriptive and normative implications in both factual and
37 fictional narratives, before applying this analysis to the Australian Constitution. I argue that
38 the narrative model offers a plausible basis for the High Court’s reasoning in Roach v
39 Electoral Commissioner.

49 regulators and health officials of deliberately lying to people about the Wuhan coronavirus

52 8, 2022 letter addressed to several officials of the Australian Department of Health and the
53 Australian Therapeutics Advisory Group on Immunization. Officials from the country’s
54 medicine regulator, the Therapeutic Goods Administration (TGA), were also included in

2 The letter alleged that the TGA failed to investigate the long-term safety risks of the
3 COVID-19 vaccines, eventually leading to vaccine fatalities throughout the country.
4 “Australians likely to have died as a consequence of receiving a COVID-19 [vaccine]
5 appear to number somewhere between 2,275 and 6,501. [This] likely means that more have
6 died from COVID-19 vaccines than from COVID-19 illness.”
7 CMN also warned against continual vaccine boosters, something that Australian state
8 leaders have been pushing. “From a modern immunological perspective, too frequent
9 vaccinations for respiratory viruses runs the risk of desensitizing the immune response to
10 the virus, and thus lead to hypo-immunity and worse illness,” it wrote.
11 “The safety signals presented by the data in this letter are of such grave concern that the
12 normal decision would be to immediately halt the use of gene-based vaccines to the

36 ‘groupthink’ can emerge that, once established, can be hard to shake

40 health institutions and their officers, extolling politicized and compromised information –

44 their basic human rights. Australians must receive full information in order to make

29 that this Convention cannot too soon face the issue involved in it. I take it that the people of Australasia

31 limitations, except such as are necessary to the unity of the empire. We claim, without shadow of doubt or
32 vestige of qualification, all the powers and privileges possessed by Englishmen. The governor-general, as
33 representative of the Queen in these federated colonies, should be clothed by statute with all the powers
34 which should belong to the representative of her Majesty; he should be above all risk of attack, because he
35 should act only on the advice of responsible ministers, who should be prepared either to obtain the
36 sanction of Parliament for their acts or vacate office. Parliament, in its turn, should be brought into
37 intimate relation with the electorates. This is true, popular government.
