AFFIDAVIT OF DESISTANCE

I, IGMEDIO R. LONGCOP, of legal age, married, and a resident of Brgy.

Del Norte, Mapanas, Northern Samar, after being sworn to in accordance with the
law, hereby depose and say:

1. That I am the private complainant/victim in Criminal Case No.

M-21-438, entitled People of the Philippines v. Ernesto L.
Pajares, for Attempted Murder, which is pending before the
Regional Trial Court, Branch 38, Gamay, Northern Samar.

2. That after due consideration of the facts and the surrounding

circumstances of the incident, I am fully convinced that the
incident arose merely from misunderstanding as the accused has
no intention of killing me or of inflicting any harm against me as
we were both intoxicated when the incident happened.

3. That I have already forgiven the accused, Ernesto L. Pajares, for

whatever he had done to me after he asked for apology and
forgiveness from me. Further, we decided to restore our previous
harmonious relationship as the accused is still my nephew.

4. In view of the foregoing, I am no longer interested in pursuing the

criminal case against accused, Ernesto L. Pajares. Hence, I am
now asking the consideration of this Honorable Court to honor
and respect my decision to desist from pursuing this criminal
case against him.

5. That I have not been forced, threatened, intimidated, coerced,

nor given any reward, gift, money or promised any consideration
in order to execute this Affidavit of Desistance.

6. That once this case be dismissed, I am fully aware that I could

no longer revive or file another case involving the same incident
against the accused.

7. That I executed this affidavit to attest the foregoing statements

and for whatever legal purpose this may serve.

IN WITNESS WHEREOF, I hereunto set my hand this 30 th day of

September 2021 in Gamay, Northern Samar.
