    The case under review involved an indictment for the manufacture of a drug,

    specifically marijuana. The defendant decided to file a motion of censure requesting the

    suppression of the evidence collected, claiming that the evidence was obtained through

    an aerial search of his property without a prior warrant. The defendant appeals that the

    aerial coverage and police officers violated his right to privacy under "Article 19 the

    New Hampshire Constitution and Amendments IV and XIV of the United States

    Constitution." 

    The state troopers mentioned that they found no fence or barrier in the area where the

    drugs were found. In addition, the record shows that the location of the marijuana was

    not necessarily located near his place of residence and that the area was rarely used. 

    Although the New Hampshire state constitution preserves people's possessions in their

    homes. The court decided to deny the petitions because the case provided sufficient

    evidence that the officers did not need a warrant to search that area and, because of this,

    the defendant's rights were not being violated.
