what is homicide
is the unlawful killing of any person, it is neither parricide, murder nor
infanticide. General rule,

body of the crime - consummated, mismong corpse
in case of robbery the corpus delicti is the stolen property. in case of arson -
corpus delicti is the property that is being burned

elements of the crime of homicide


= person was killed
= without any justifying circumstance
= accused had the intention to kill, which is presumed.
= did the killing was not attended by any qualifying circumstances of murder, or by
that of parricide or infanticide.

categories of modes of death


1. accidental death
- often homicide is disguised to appear to be accidental in nature. ex - drowning,
falling, motor vehicle wrecks, accidental drug overdose, and so on.

2. natural death
- in many circumstances, the deceased will have been under a doctor's care but
often people are found in their mood of death is questionable. ex- heart attack,
stroke, disease and old age.

3. suicide
- as with other modes of death, the incestigator should be sure that the cause of
death was actually suicide and not homicide designed to look like suicude. ex-
stabbing, shooting, drug overdose, and carbon monoxide poisoning(in arson cases).

4. homicide
- if one person has intentionally caused another person to die. ex- gunshot wounds
from firearms, stabbing, incision, chopping and puncture wounds etc.

investigative activities in homicide case (duty of investigator mismo, not the


first respondence)
a. record the crime scene through notes, photographs and sketches.

b. recognize, collect and preserve all physical evidence and clue materials

c. identify the victim and the person who witnessed the commission of the crime
(golden hour)

d. establish the cause and the manner of death of the victim.

e. ascertain the motive of the suspects in committing the crime.

f. seek additional information by interviewing people and by examining the records


of the victim. (hobbies, vices of the victim)

g. question the suspect. This should be done after explaining his rights under
custodial investigation. (interrogation)
partitioning responsibilities
1. evidence technician - person who collects the evidences, analysing, perserving
the physical evidence
2. cirminalist - recording the crime scene, ex- fingerprint - dadalhin sa
fingerprin identificatoin division (insturmentalization)
3. forensic pathologist - autopsy
4. forensic anthropologist - specifically nageexamine ng mga bone ng tao,
especially kung matagal na bago na discover the crime scene
5. investigator - gather information available, responisble to question the
suspects

motives of the crime of homicide


is an important factor in pointing to possible suspects in homicide investigation.
