a, Area under acquisition - 50031.00 Sq.mtr
b. Land rate as per Award - Rs. 15 to 20 per Sq.mtr
c. Amount of compensation as per Award- Rs. 23,44,372.00
d. Status of compensation - Since there is a dispute of ownership
of lands in between Govt. and
Godrej, the amount of compensation
is deposited in the Bombay High
Court ws 30 of L. A. Act, 1894 on

e. Land under acquisition is already handed
over to acquiring body i.e. Central Railway - on 22.10.1986.

2. The claimant had made a reference ws 18 of
Land Acquisition Act, 1894. = on 27.10.1986.

Grounds of reference
a. The Awarded rate for land under acquisition is very low so demanded Rs.75
per Sq. yard (i. ¢. Rs. 63 per Sq. mtr)
b. The Sale instances considered by the Land Acquisition officer are not proper.
3. Our say regarding reference made w/s 18:-
This office has declared an Award u/s 11 of land Acquisition Act, 1894 after
following the due process of law and ascertaining the correct true market value of
land under acquisition. Even this Award has also declared after obtaining necessary
approval from the higher authority i, e. Collector of Mumbai Suburban district.the amount of compensation 0s « i with the

Act, 1894 on 03.12.1987.
By letter dated 29.06.1998 Godrej & Boyce co. Ltd has informed to the
secretary, revenue & Forest Department, Govt. of Meharashtra, Mantralaya that
the land under acquisition was deserved (Please refer Annexure ‘E’ of
Maharashtra Govt. gazette dated June 8, 1995.) Accordingly the office has also
brought all the facts to the notice of Collector MSD vide letter dated 26.10.1
Govt. of Maharashtra through Revenue & Forest Department had filed suit
against petitioner bearing suit No. 679 of 1973. In this suit Govt. of
Maharashtra claimed title over the lands of the petitioner. The said suit is stil
pending in the Bombay High Court. (Please refer Annexure ‘G’ for Xerox copy
of suit No. 679 of 1973.)
Conclusion: - the main disputed issue in the present LAR is ownership of
land between Govt. & Godrej and which need to be sorted out first
therefore the amount of compensation was deposited in the Bombay High
Court u/s 30 of L. A. Act, 1894 on 3.12.1987.
