Inc. (11 S&A"), and the Defendant, Patricia King ("Kittg'l

Findings of Fact

WHEREAS, on January 28, 2010, S&A acquired from JP Morgan Chase Bank, N.A.

(

Chase 11 ) a first mortgage loan made by Chase to King (the "King Mortgage") whicb was

secured by the real property located at 5092 Dundee Avenue, De Leon Springs, Florida 32130

(the "Property"); and

WHEREAS, Cbase provided S&A wi1h an assignment of the King Mortgage which was

recorded in Book 6455, Page 532 of the Official Records in the County Recorder,s Office of

Volusia, State of Florida oo March 15, 2010 (Exhibit A); and

WHEREAS, -in or around 2013. King defaulted on the King Mortgage by failing to remit

I. her: monthly payments, pay the outstanding property tax.es aJJ.d insurance and, thereafter, S&A

instituted this action to foreclose on the King Mortgage; and

WHEREAS, on October 31, 2013, S&A's agent:, BSI, filed on S&A's behalf a Notice of

Lis Pen dens and Complaint against King for non~payment of the note that was secured by the ·

King Mortgage (Exhibit B); and

WHEREAS, on November 19, 2013~ Chase recorded, a release of its mortgage lie~

pwportedly re]easing King of the mortgage loan that Chase.had previously sold to S&A in 2010

WHEREAS~ the Lien Release appeai:s to have been robowsigned by someone ~ho lacked ·

knowledge as to the transaction; and

WHEREAS~ King answered the foreclosure complaint filed on February 2, 2014 and
asserted that her loan was modified by.Chase in 2009; and . .

WHEREAS . on May 27, 2014, counsel for S&A sent a cease and desist letter to Chase

for its wrongful. release of the King Mortgage lien which Chase hw previously sold to S&A; and

WHEREAS, on May 27, 2014, Chase recorded a Vacation and Rescission of ·

Modification of Mortgage in Book 6992, Page 3573 of the Official Records in the County

Recorder's Office of Volusia, State of Florida (the "Vacation and Rescission") (Exhibit D); and

WHEREAS, the Vacation and Rescission provi~ed that Chase "[tJhrough inadvertence

and mistake[) executed a Home Affordable Modification of.' the: King Mortgage which was

recorded on November 19, 2013 in Book 6930, Page 4838 of the: Official Recc,r.ds in the County

Recorder's Office of Volusia, State of Florida.; and

WHEREAS, Chase may have taken credit towards its consumer relief obligations under

the RMBS Settlement Agreement for granting cons um.er relief in the ful) am.ount of the KJng's ·

indebtedness to S&A pursuant to its "Pre-DOJ T.ien Release Project;" and.

WHEREAS, King has confirmed that she never had any communication witJ, Chase since

2010 and that she did not request, apply for., or receive a loan modification from Cba,;e after .

January 1, 20l O; and

WHEREAS, Chase and King did, in fact, enter into a modification on February 1, 2009

pursuar,\t to which King's monthly payment was to include taxes and insurance (Exhibit E);

Scope or Consent Judgm.en t


NOW WHEREFORE, based on the foregoing factual finding, IT IS SO ORDERED:

ADJUDGED AND DECREED:

l. S&A owns the I(jng Mortgage;

2. Chase has no intere~ in the King Mortgage;

3. Neither Chase nor its agent(s) had any right.to telcasc the lien securing the King

Mortgage because Chase bad sold the King Mortgage loan to S&A and had no standing to

relinquish the lien thereafter;

4. The S&A and King mutually release one another of any claims that were or could

have been asserted in the above captioned action; and
