No. G1/ 16291 /2010, Dated: 03-02.2011. @@@@@@ Based on the Order passed on 12.10.2008 by the Honble High Court in WP No. 19459/2003 and batch the Honble APAT disposed of the O.A No. 892/2003 and the batch through a common order dated 17.04.2009 with the following observations. Therefore, the respondents are directed to prepare a seniority list of Lecturers and Senior Lecturers by placing the candidates who were appointed regularly by the APPSC prior to the order of regularization of temporary candidates under proceedings No. G4/11161/1991, dated 11.2.1993 irrespective of the fact that the said proceedings regularizing the temporary candidates with antedate i.e. 20.7.1990. In other words, the candidates appointed prior to 11.2.1993 must be given seniority over the candidates regularized in pursuance of G.O.Ms.No. 193 General Administration (Services-A) Department, dated 14.3.1990. But, the candidates who were appointed subsequent to regularization order dated 11.2.1993 cannot be placed above the temporary candidates regularized in pursuance of G.O.Ms.No. 193 General Administration (Services-A) Department, dated 14.3.1990. 2. Aggrieved by the above orders Smt. N. Vasanthi the 6th respondent in O.A.No. 892 of 2003 filed WP No 15776/2009 and Smt. A. Rajyalakshmi -second applicant in O.A.No. 935 of 2003 filed WP No.16830 OF 2009 in the Honble High Court of Andhra Pradesh. 3. The Honble High Court of Andhra Pradesh on 4.8.2009 while admitting the Writ Petitions granted interim suspension of the order passed by the Tribunal in O.A.No. 892 of 2003 dated 17.4.2009. The Honble High Court later dismissed both the WPs on 10.06.2010 upholding the order dated 17.04.2009 of the Honble APAT in OA No.892/2003 and the batch with the following observation.

Therefore, in our considered view, the petitioners do not have any legally or enforceable right unless they fulfill the criterion laid down under G.O.Ms.No. 193 dated. 14.3.1990. Hence, we find no illegality or irregularity in the order impugned warranting interference by this Court under Article 227 of the Constitution of India.

Keeping in view the orders of the Honble High Court of AP Government have been requested to accord permission to review the Promotions made earlier by this office in terms of Rule, 24 of AP State and Subordinate Service Rules, 1996 since the Government is alone competent for review the Seniority beyond six months vide this office letter second cited. In their Memo third cited, Government has permitted this office to review the Seniority and Promotions of Lecturers with reference to Rule, 24 of AP State and Subordinate Service Rules, 1996 in view of the common order of the Honble AP High Court in W.P.No.15776 and 16830 of 2009 Dated.10-06-2010 duly waiving off the six months time as indicated in Section 24 of AP State and Subordinate Service Rule, 1996 to review the cases in view of the Court orders. In this office Circular Memo. 4th cited a notice was given to the staff members concerned.

::2:: 7. 8. 9. The staff members concerned have submitted their objections with regard to protection of seniority vide reference 5th cited. The objections of the staff members have been examined and same have been overruled vide reference 6th cited. Keeping in view the above, a provisional inter-se- Seniority List of Senior Lecturers in Civil Engineering (Category 3, under Class B in APTES) in Government Polytechnics in the state who have completed (2) years of service in the category of Senior Lecturer in Civil Engineering is prepared duly placing the candidates who were appointed regularly to the posts of Associate Lecturers (now Lecturers) by APPSC prior to 11-02-1993 over and above the candidates appointed through the High Power Committee and whose Services were regularized in the category of Associate Lecturers (now Lecturers) vide this office Proceedings No.G4/11161/1991, Dated.11-02-1993 and communicated here with to the individuals concerned. If there are any Objections / Omissions or commissions in the List communicated the same may be brought to the notice of the under signed in a named cover addressed to Sri.M.Rameshwar Reddy, AD (G), so as to reach him on or before 01.08.2011, so as to finalize and communicate the final seniority list.
