Pagbati mula sa Dakilang pagpapala ng ating Poong Maykapal! Punong Barangay
Atin pong pakatandaan, ang tunay na Hukom ay ang ating Panginoong Diyos. Tayo ay parurusahan batay sa ating mga
nagawang kasalanan. Kung kaya’t habang tayo ay nasa reyalidad ng buhay dito sa sanlibutan, patuloy na tayo ay gumawa ng Kabutihan sa ating kapwa
at Kabanalan sa ating Panginoong Diyos, ng may totoong pagsunod sa mga tuntunin at aral na mula sa Kaniya. Sa pamamagitan ng ating Panginoong
Hesukristo at lubos na pananampalataya, ating masusumpungan ang pagkalinga ng ating Panginoong Diyos sa kabila ng mga pagsubok at suliranin sa
ating buhay. Kumapit tayo ng mahigpit sa kamay ng ating Panginoong Diyos, upang patuloy nating makakamit ang tunay na Kapayapaan sa ating puso’t-
isipan.
Sa maraming taon ng pagsisilbi ko sa aming Barangay, at kasalukuyang Punong Barangay, sa aking pangalawang termino, isa sa pangunahin kong
layunin ay mapabuti at mapaunlad ang pamamahala ng Katarungang Pambarangay sa aking nasasakupan. Maliban sa pagpapatupad ng mga proyekto
at programa sa pagpapaunlad ng aming Komunidad ay kailangan ko ring isa-isip at isa-puso ang tunay na paglilingkod kabilang sa pagsasa-ayos at
pagresolba sa mga usapin na naidudulog sa tanggapan sa ilalim ng Katarungang Pambarangay, marating ang tamang pakikipagkasundo ng bawat
magkabilang panig tungo sa kanilang mabuting pakikipag-ayos.
Mula sa legal na basehan ng tamang pagpapatupad ng Katarungang Pambarangay at mula sa mga orientations at seminars na aking nadaluhan, mahalaga
ang angkop at tamang pamamahala ng Katarungang Pambarangay. Nang sa gayon ang bawat mamamayan na nasasangkot sa mga simpleng alitan o
usapin ay maaaring isaayos at marating ang mabuting pakikipagkasundo sa bawat isa upang hindi na sila humantong pa sa korte at magdemandahan.
Ang responsibilidad na ito na naiatang sa akin bilang Punong Barangay ay malugod kong isinasakatuparan dahil ang pagtanggap ko sa aking tungkulin
ay kaugnay sa aking sinumpaan na itaguyod at paunlarin ang kahalagahan ng pagpapatupad ng Katarungang Pambarangay.
Hindi ko man masasabing perpekto ang aking pamamalakad, ngunit ginagawa ko ang lahat ng aking makakaya na mapaunlad ang aming Barangay
kabilang na ang tungkulin ko bilang Tagapamagitan sa mga usapin o reklamong naidudulog sa Barangay. Sa tulong at suporta ng mga miyembro ng
Lupong Tagapamayapa at Konseho ng aming Barangay magagawa ang angkop at tamang pamamaraan ng pamamahala ng Katarungang Pambrangay.
Ang mabuting pakikipag-koordinasyon sa mga ahensya na maaaring makatulong sa pamamahalang ito ay sinisikap kong maging mabuti ang aming
pakikipag-ugnayan tungo sa pagpapahalaga at respeto ng bawat indibidwal.
Muli po naming ilalahad sa inyo ang inihanda naming 2017 LTIA Documentation, kaugnay nito ang bawat detalye ng aming paraan ng pamamalakad ng
Katarungang Pambarangay sa aming komunidad. Ang pagbabahaging ito ay siya naming naging hakbangin patungo pa sa karapat-dapat na pagpapabuti
at pagpapaunlad ng pamamahala patungkol sa Katarungang Pambarangay. Isang napakalaking Karangalan na Mahirang ang aming Barangay bilang Best
Lupong Tagapamayapa Provincial at Regional Winner 2016 sa ilalim ng 4th-6th Class Municipal Category, at ito ay lubos naming ipinagpapasalamat. Sa
Karangalang ito na aming nakamit, ay isa sa aming naging inspirasyon na mas lalo pa naming pagbutihin ang angkop na pamamahala ng Katarungang
Pambarangay, sapagkat kaugnay sa pagtanggap ng aming tungkulin, ay kaakibat nito na maibigay namin ng may kaluguran ang tunay na pagsisilbi sa
aming nasasakupan. Sa anumang pagsubok o balakid, sama-sama kaming maglilingkod ng tunay at tapat tungo sa Mapayapa at Maunlad na Pamayanan.

CRITERIA
I. EFFICIENCY IN OPERATIONS
The Lupong Tagapamayapa of Barangay Camiing ensures the proper implementation of Katarungang Pambarangay Law. They
A. Observance make sure that every rule and regulation under the Local Government Code of 1991 and Presidential Decree No. 1508 also

Deadlines
FILING OF COMPLAINT/S
Complaints are filed through the Punong Barangay either verbally or in writing. If the complainant cannot write his/her complaints,
the act of writing is usually done by the Barangay/Lupon Secretary.
Complaints stating the nature of disputes and date and time of incidents are written using the KP Form No. 7 signed by the
complainant attested by the Punong Barangay/Lupon Chairman.

ISSUANCE OF SUMMONS & NOTICE OF HEARING
-The Lupon Secretary prepares the Notice of Hearing to be given or to be issued to the complainant/s on the same time the
complaint/s filed and paid the filing fee amounting to P50.00 to the Barangay Treasurer with the official receipt. The Notice of
Hearing is prepared with a duplicate copy. In scheduling the hearing of complaints, the secretary always asks the availability of
complainant/s and considers his/her requested time & date. The Notice of Hearing may also be served on the next working day.
Pormularyo ng KP Blg. 8: PAABISO NG PAGDINIG
-Upon filing of complaint/s, the Summon with the Officers Return Form are also prepared by the Lupon Secretary to be served to
the respondent/s by the assigned Barangay Tanod. The Officers Return Form will be brought back by the server proving that the
Summon/s are served. The Summon/s may also be served on the next working day.

-For every complaint filed, the Hearing is normally scheduled within 3 to 5 days from the date of filing.
-A Docket Book is prepared per year, it states the Docket No. of Case filed, Date filed, Name of Complainant/s, Case Title, Name
of Respondent/s, Schedule of Hearing (Date & Time for Mediation & Conciliation), Status/Disposition and Remarks.
MEDIATION PROCEEDINGS
-In every scheduled hearing of complaint, the Punong Barangay/Lupon Chairperson always starts the confrontation with the opening
prayer.
-On the scheduled initial hearing of complaint/s, the Punong Barangay/Lupon Chairperson will mediate the case. He clearly analyzes
the situation with both party’s statements from the incidents or problems they’ve encountered. He will use every possible means to
bring the disputants into a settlement. He carefully discusses the advantage of settling the case in the Barangay level. A period of
15 days from the starting of initial hearing is given to the Punong Barangay/Lupon Chairman to mediate the case.
-If the Punong Barangay/Lupon Chairperson successfully mediated the case and brought both parties into settlement, the case is
closed. An Amicable Settlement Form is prepared to be signed by both parties attested by the Punong Barangay/Lupon Chairperson.

KASUNDUANG PAG-AAYOS
-The Barangay/Lupon Secretary, after the case is settled, clearly reads to both parties the minutes of confrontation and stated
Agreement in the Amicable Settlement Form before they sign it, just to let them know if the demand/s or request/s are airly noted.
The Settlement is subject to repudiation within 10 days from the signing of Agreement. There is a KP Form No. 17 prepared for
Repudiation. Last 2017, there was no cases repudiated. In fact, almost all cases filed are settled.
CONCILIATION PROCEEDINGS BY PANGKAT TAGAPAGKASUNDO
-In such cases that no settlement has been achieved from Mediation Proceedings, the Punong Barangay/Lupon Chairperson will
progress to the Conciliation Proceedings and will refer the case to the Pangkat Tagapagkasundo.
-In constituting the Pangkat from Lupon Members, the Punong Barangay/ Lupon Chairperson shall again call the disputants who are
entitled to choose the Lupon Member of their choice. The third Lupon Member will be chosen by the Punong Barangay/Lupon
Chairman. However, it may also adopt the procedure in constituting the Pangkat in accordiance to the KP law through drawing l ots
of Lupon Members.
-After the Pangkat was constituted, the Punong Barangay/Lupon Chairperson notifies them through KP Form No. 11: Notice to Chosen
Pangkat Member and he meets them personally to present the case to conciliate. He shares to them the details and history of the
case during his mediation process, and with that, the Pangkat may adopt any ideas or techniques to bring the disputants into possible
settlement. They should meet them and shall agree on who will become the Pangkat Chairman, Pangkat Secretary and Member.
After the Pangkat Tagapagkasundo sets their position, they should proceed to the Conciliation process. The KP Form No. 12: Notice
of Hearing (Conciliation Proceedings) is to be served to both parties. In this preparation, the Barangay/Lupon Secretary i s always in
assistance on the preparation of the needed KP Forms.
-Once the Pangkat is constituted, they shall proceed to conciliate the parties not later than 3 days from its constitution. The Pangkat
exerts all the efforts to conciliate the parties within 15 days from their initial confrontation. If no settlement is reached by that time,
the Pangkat at its discretion, may extend another 15 days or even longer if the case has a possible reach the settlement.
If the Pangkat ng Tagapagkasundo will succeed to bring both parties into settlement, it shall prepare the Amicable Settlement KP
Form No. 16 stating their Agreement to be signed by both parties attested by the Pangkat Chairperson.
In the year 2017, we have prepared the KP prescribed Forms in Tagalog, and when its needed, there are
always blank forms printed in proper recording of cases. There are no cases filed issued with Certificate to File Action
in Court, mostly were settled by the Punong Barangay through mediation proceedings and two cases were referred to conciliation
proceedings and settled by the chosen Pangkat Tagapagkasundo.

B. -The Punong Barangay/Lupon Chairperson ensures the proper implementation of the Katarungang Pambarangay Law giving
Systematic utmost importance to the proper recording of all cases filed. The Barangay/Lupon Secretary is assigned in maintaining the records,
Maintenance which are kept separate from the legislative records and other documents in the office. A filing cabinet is designated solely for all
of Records
KP related records from previous years up to present. Although the Barangay office is not abundant with office supplies, it doesn’t
mean that the Lupon cannot administer or manage the office properly. They do their best to ensure that they are able to provide
a convenient and accessible service to the clients. In Fact, the Barangay Council with the Lupong Tagapamayapa Members,
requested Municipal Mayor Hon. Jocelynn B. Apostol for the improvement of designated office of the Lupong Tagapamayapa
adjacent the session area of Barangay Council. The Honorable Mayor’s support is highly appreciated. In organizing the KP records,
the Lupon prepare the following:
-The prescribed KP Forms are prepared to ensure that all complaints undergo in the proper proceedings. This envelope contains
all Katarungang Pambarangay Forms. These includes the Complaint Form, Summon, Officers Return Form, Notice of Hearing,
Amicable Settlement etc. In this year 2017, Tagalog Forms were prepared. (Pormularyo ng Katarungang Pambarangay)
-All Katarungang Pambarangay related cases are kept in the provided filing cabinet located in the designated office of the Lupong
Tagapamayapa. For privacy purposes, this cabinet is kept locked to secure all records of cases. Only authorized officials can open
and organize the files.
-A reference book of Katarungang Pambarangay & other related materials are also organized just to ensure guidance of the Lupon
in the proper implementation of Katarungang Pambarangay Law.

II. EFFECTIVENESS IN SECURING THE SETTLEMENT OF INTERPERSONAL DISPUTE OBJECTIVE OF THE KATARUNGANG PAMBARANGAY
A.) Quantity -Out of thirty-three (33) total cases filed under Katarungang Pambarangay for CY 2017, mostly are settled, thirty-one (31) were
of Settled amicably settled and only two (2) cases were not settled. One case was withdrawn by the parties because they came to a settlement

are fake or valid. He dismissed the case, and he coordinated to the Provincial DENR Office and as per the office’s advice, he forwarded
the case to their office for appropriate action. An indorsement letter is forwarded. This process was also agreed by both parties.

B.) Quality of -The Lupong Tagapamayapa achieved an outstanding quality of settlement of cases due to the desire of the Punong Barangay/Lupon
Settlement Chairman to, as much as possible, prevent both parties in court hearings. Each party in dispute was presented with the consequences

III. CREATIVITY AND RESOURCEFULLNESS OF THE LUPONG TAGAPAMAYAPA
A.) Settlement - During each meeting, the Punong Barangay will start with a prayer to seek the guidance of our Lord Almighty and hope for
Technique the spirit of calmness to rule throughout the proceeding. The Punong Barangay, being a Born Again Christian, always shares
the Words of God which focuses on the importance of acceptance and forgiveness.
- As a mediator, the Punong Barangay ensures that both parties in dispute are given their respective time to voice out their
sentiments. Also, he explains the importance of respect and instruct both parties to not interrupt when one is talking. He also
gives time to the witnesses to narrate their side of the story which may help in analyzing and eventually arriving at a
settlement.
- The Punong Barangay invites the Sangguniang Barangay Member-Officer-of-the-Day or the SB Member Committee
Chairperson on Peace and Order & Legal Matters, upon the permission of both parties, during the proceedings. Their assistance
and support can help with the easy settlement of cases.
- If both parties involved are related to each other or “magkakamag-anak”, the Lupon Chairman finds a way to talk to some
of their close relatives to help in settling their family problems.
- In case the Punong Barangay/Lupon Chairman is on official business, he assigns the First SB Member or the Comm. Chairman
on Peace and Order & Legal matters to handle the mediation proceedings, likewise in the conciliation proceeding, the assistance
of the Pangkat Tagapagkasundo are always requested.
- The Barangay Tanod assigned to serve the Summons to Respondents is always advised that during the Serving of Summon,
he must serve with respect and patience and he must convince the respondent/s to attend the confrontation and face the
problem they’ve encountered with the complainant/s and resolve with the mediation of Punong Barangay. Barangay Tanods
on duty are also requested to assist during the hearing of confrontations. They are always present to assist in pacifying both
parties when their emotions or situations become intense.
- Some case hearings are scheduled on weekends or holidays to consider the availability of complainant/s or respondent/s,
particularly if they are working and their schedules are conflicting with the schedules on weekdays. This consideration for the
respondents and complainants is an effective way to help them resolve the conflict. This practice of the Lupon has greatly
helped a number of respondents and complainants to settle their problems.
- If the respondent/s did not attend for two to three times the scheduled hearing, the Punong Barangay conducts visits to
encourage and convince the respondent/s to attend the hearing and at the same time, he explains carefully the advantage of
being cooperative and suggests any solutions that could help resolve the problem.

- Aside from the enforcement of Barangay Anti-Drugs Abuse Council (BADAC) related to Anti-Illegal Drugs Campaign with

the Philippine National Police (PNP) Municipal Police Station, the Barangay has promptly entertained the cases referred
by the PNP which needs to undergo the KP process first. The Lupon usually entertain cases like Slight Physical Injuries and
some cases referred from their office were properly settled. The Barangay Council has been actively coordinating with the
PNP particularly in maintaining Peace and Order in Barangay.
- The Punong Barangay closely coordinates with the Municipal DSWD particularly about Violence Against Women, &
Children (VAWC) cases, and Children in Conflict with the Law (CICL). The presence of the MSWD Officer is requested during
the hearing of VAWC-related cases and Children in Conflict with the Law (CICL)-related cases. The Punong Barangay
requests the available time of the MSWD Officer to help and assist in handling VAW and BCPC cases especially those
sensitive cases. Mostly, hearings are scheduled during Saturdays and Sundays, the available schedule of the MSWDO. The
VAWC and BCPC related cases are separate the records with KP related cases. The Lupon usually asks the guidance of
MSWDO upon receipt of complaints covered by the VAWC and cases involving minors. As we schedule the hearing of
complaints, we notify the MSWDO for her information and availability of schedule to attend the hearing. Her assistance
and support are requested. Those cases covered by the VAWC and BCPC/CICL filed this year 2017 were all settled with the
assistance of MSWDO.
-Since there was a land dispute filed this year 2017, the Punong Barangay also coordinated with the Municipal Assessor
just to get proper advise related to this case. As per the advise, since both parties had their owned documented properties,
only the authorized DENR officers can handle the case. From the coordination with the Provincial DENR office, a referral
letter should be forwarded related to the case, and immediately the letter was prepared and served to the complainant.
- The Punong Barangay with the Lupon Secretary also coordinated with the Rural Health Unit (RHU) Municipal Health
Officer particularly when cases which involve physical injuries that needs Medico Legal Certificate of Complainants are
filed. A medico-legal certificate from Municipal Health Officer is presented during mediation/conciliation proceedings just
to undertake the proper and right legal actions for the case. A letter requesting a medico-legal certificate of complainant/s
is forwarded to the RHU. This may also help the Punong Barangay to identify whether the injuries inflicted was slight or
serious.
-Since one member of the Lupon is currently working as Stenographer, at the Provincial Prosecutor and at the Department
of Justice, Olongapo City, the Punong Barangay is closely coordinating with them, their advices are highly acknowledged.

IV. AREA OR FACILITY FOR KATARUNGANG PAMBARANGAY ACTIVITIES
With the support of our Municipal Mayor Jocelynn B. Apostol, the adjacent area of Session Hall was provided and improved as the office of
Lupong Tagapamayapa. Information from KP related are displayed at the Lupon office such as, KP Procedures, Mediation, Conciliation &
Procedures, among others area the KP Monitoring Board, and the Organizational Chart of Lupong Tagapamayapa Members. All these are
displayed in tarpaulin printed with the help of Municipal Mayor.
The session area of Barangay Council is also available for the KP Activities, mostly the Mediation Proceedings were happened in this area,
while for the Conciliation Proceedings and Lupon Meetings it happened in the Lupon Office. Since the areas are adjacent, any of the two are
available as designated area for activities Lupon. For the sake of proper management of Katarungang Pambarangay, the office is of great
help to serve the clients, visitors, & constituents properly.
