electricity or telephone service.

5.4 Cancellation of the Contract

If the Contract is Cancelled by the COMPANY, for whatever reason, after placing
the Contract (either by Signed Copy or Email Confirmation), and before the
commencement of Works , then the cancellation charge equivalent to 5% of the
Contract Value shall be Compensated to the CONTRACTOR by the COMPANY.

However, if the Cancellation is after the commencement of Mobilization of

Equipment, Tools of the CONTRACTOR, then the Cancellation Charge equivalent
to 10 % of the Contract Value plus the value equivalent to works executed shall be
compensated to the CONTRACTOR by the COMPANY.

For the supply of material the Purchase Order cancellation charges will be
applicable and will be informed upon cancellation.
Prices are valid for whole supply, in case of partial order we reserve our right to
confirm/ Review prices.

5.5 Loss & Damage of CONTRACTOR Equipment

NOT APPLICABLE

5.6 Article 16 of the Petroleum Law

Article 16 of the Petroleum Law Shall be applicable for all the Material Imported by
CONTRACTOR to be utilized within the Construction of the Project.

The COMPANY shall endorse Duty Exemption Form addressed to Custom

Authorities for the shipments whichever is being imported for this project.

5.7 Libyan Civil Law

Libyan Civil Law shall be applicable for all other Terms and Conditions which are
not covered under this Proposal.
