MUNICIPAL ORDINANCS 316 AN ORDINANCE LEVYING FaLS FOR SEALING OF WEIGHT AND MEASURES AND PROVIDING PHWALTINS IN VIOLATION THEREOF WHEREAS, R.A. 7394 dherwise known as the Consumer Act of the Philippines wae enacted primarily to protect the interest of the consumers. WHEREAS, the Municipal Yovernuent of Solsona has prog= ressively implemented over the years, measures to promote public health and safety as well as the adcbess deceptive, unfair and unconscionable sales acts and other welpractice| THERSFORE, on mofion of flons Henry A. Viceate, Hons Hdison &. de Lara and Hone Agripino NM. *stavillo, be it OXDAINMD by the Sangguniang Bayan of Solsona that: Section 1 - Fees for sealing of weights and measures shall be in accordance with the following schedule to wit? A) For sealing linear metric measurest asl - measure not over one meter - 7 10.00 a.2 - measure over one acter - # 20,00 B) Yor sealing metric measures of capacity bel - measures not over ten liters P 10.00 b.2 - measures over ten liters ~ 720.00 Cc) Yor sealing metric instrumenta of weights col - those with a capacity of not more than 50 kilograms - # 20.00 e.2 = those with capacity of more than 30 but not more than 300 kilograms - ¥ 30.00 o.3 - those with a capacity of more than 300 Kilograms 760.00 " ms FE ZzD) For an apothecary balance of other balance of pro= Seesion, the fee shall be doubled. E) A complete set of weights for each scale or balance shall be sealed free of charge for each extra weights. ‘The fee shall be 750.00 Section 2 - The fees herein levied shall be paid at the place where the business is conducted, In the case of the peddler on similar itinerant vendor using only one weignt or measure, he shall pay the fees in his place of residence, Section 3 - The fees herein levied shall be collected by the Municipal Treasurer or her duly authorized representative. Section 4 - Sealing and Testing of instruments of weighta and measure, All instruments for determining woighte and measures in ell consumer and consumer related transactions shell be teated, calibrated and-cealed every six (6) by the official sesler who shall be the Municizal *reasurer or his euthorized represeatative upon payaent of fees required under existing laws. Section 5 - Fraudelent practices and unlawful possession on use of instrument of weights and measures shall be punished by a fine not lees than 71,000.00 but not more than ¥5,000,00, can+ celletion of persits or by imprisonment of not less than one aonth but not more than six (6) months or both at the discretion of a court. : Section 6 ~ This Ordinance shall take effect after the lapse of twenty dne (21) days from the day a copy of it is posted on the bulletin boardy Municipal Churches, Market and other cons~ picuous places and published in the newspaper of local circula- tion.
