Once branded “unsinkable”, the Royal Merchant Ship (RMS) Titanic went down after crashing
into an iceberg during her maiden voyage from Southampton to New York City.

The ship was the largest afloat in the world at the time, and was built by ship makers Harland and
Wolff in Belfast.

The British passenger liner sank in the North Atlantic Ocean on April 14, 1912, killing more than
1,500 passengers and crew.

SOLAS Convention
(Applies to who?)
❖ A SOLAS ship (as defined in Maritime Rule Part 21) is any
ship to which the International Convention for the Safety of
Life at Sea 1974 applies; namely:
▪ a passenger ship engaged on an international voyage, or
▪ a non-passenger ship of 500 tons gross tonnage or more
engaged on an international voyage

❖ There are some exceptions where certain commercial vessels


are required to meet the safety standards of a SOLAS ship.
These vessels are required to be in Class and have an
International Safety Management system in place (ISM
Code).
These exceptions are:
▪ a passenger ship of 45 metres or more in length that proceeds
beyond restricted limits
▪ a non-passenger ship of 45 metres or more in length that
proceeds beyond restricted limits
▪ a self-propelled mobile offshore drilling unit of 500 tons gross

SOLAS Convention
(What is SOLAS?)
❑ The International Convention for the Safety of Life at
Sea (SOLAS) is an international maritime treaty which sets
minimum safety standards in the construction, equipment and
operation of merchant ships.

❑ The convention requires signatory flag states to ensure that ships


flagged by them comply with at least these standards.

❑ The current version of SOLAS is the 1974 version, known as


SOLAS 1974, which came into force on 25 May [Link] of
November 2018,

❑ SOLAS 1974 had 164 contracting states, which flag about 99% of
merchant ships around the world in terms of gross tonnage.

❑ SOLAS in its successive forms is generally regarded as the most


important of all international treaties concerning the safety of
merchant ships.

What is it and it’s purpose?
International Safety Management (ISM) Code is a set of
guidelines for shipping companies and its employees, both
on ship and shore, to ensure that the ship and the
companies are operating as per guidelines of SOLAS , to
ensure safety at sea, prevent damage to property,
personnel and environment.

(International Safety Management - Code)
Application of ISM Code?
(SOLAS Chapter IX Regulation 2)
SOLAS chapter IX (ISM Code) applies to ships, regardless of the date of construction,
as follows:
1. Passenger ships including passenger high speed craft, not later than 1 July 1998;
2. Oil tankers, chemical tankers, gas carriers, bulk carriers and cargo high speed
craft of 500 gross tonnage and upwards, not later than 1 July 1998;and
3. Other cargo ships and mobile offshore drilling units of 500 gross tonnage and
upwards, not later than 1 July 2002.*

SOLAS chapter IX (ISM Code) does not apply to government-operated ships used for
non-commercial purposes

• Exxon Shipping Company failed to supervise the master and provide a rested and
sufficient crew for Exxon Valdez.
• The third mate failed to properly manoeuvre the vessel, possibly due to fatigue or
excessive workload.
• Exxon Shipping Company failed to properly maintain the Raytheon Collision Avoidance
System (RAYCAS) radar, the tanker's radar was left broken and disabled for more than a
year before the disaster, and Exxon management knew it. It was just too expensive to
fix and operate
• Captain Joseph Hazelwood, who was widely reported to have been drinking heavily
that night, was not at the controls when the ship struck the reef.

• The oil industry promised, but never installed, state-of-the-art iceberg monitoring
equipment.
• Exxon Valdez was sailing outside the normal sea lane to avoid small icebergs thought
to be in the area.
• The 1989 tanker crew was half the size of the 1977 crew, worked 12- to 14-hour shifts,
plus overtime. The crew was rushing to leave Valdez with a load of oil
• Coast Guard vessel inspections in Valdez were not performed, and the number of staff
was reduced.

What caused so much casualty in the Fire Disaster of Car and Passenger Ferry MS Scandinavian
Star ?
• In an emergency situation, the crew who shall be responsible for the safety of passenger and
trained know how to handle the emergency is clearly that they did not know how to handle the
disaster on board the Scandinavian star.
• The Scandinavian star was rush into service as a fairy cruise ship and had only been in Scandinavian
waters for only 15 days Before that she was working as a Casino cruise ship with the different crew
more than 3400 miles away in Miami.
• The ship's Manager schedule just 10 days to convert the ship from a casino cruise ship to a
passenger ferry and train an almost completely new crew not nearly enough time.
• Not one single fired row / drill had been carried out
• Even worse they discover that many of the new crew didn't speak English or any of the
Scandinavian Languages so confusion in the multilingual crew is a problem from the very start of
the various journey when the catastrophe happens the crew organizations simply falls apart.
• No Clear emergency procedure to follow

What caused so much casualty in the Fire Disaster of Car and Passenger Ferry MS Scandinavian
Star ?
• Crew not understand fully the management of the vessel
• Fire alarm available but the only alarm sounded is on the bridge
• Laminated wall coating makes the fire spread faster
• The fire doors on the area where fire started, must be shut manually. Fire doors was not closed
during fire
• Lay out of the cabin and position of fire alarm not sufficient, emergency escape not clearly marked
and not properly designed. The passage mostly died trapped in cabin or lost in the interior
• The sound level of alarm is less than 57 decibels much quitter than inside a luxury car traveling at a
high way. Sleeping passenger never heard the alarm, it was to quietly also engine noise and
ventilation noise interfere the hearing the alarm

What if…??
• If the crew had been better prepared more passenger might have been evacuated
• If the Captain had responded effectively to the first arson attack the second fire might
have been caught sooner
• If some none had been on deck three to report the fire it never would have gained such
a deadly hold
• If there had been smoke well heat alarm in the passenger areas the fire could have
been caught when it was still small
• If the fire doors had been shut immediately the fire would have been trapped and
unable to spread
• If the alarm had been louder or the sleeping passengers would have been roused in the
rear of deck 5
• If the walls had been fitted with a fireproof lining that did not produce poisonous
smoke, people could have survived

The ISM Code in its mandatory form was adopted in 1993 by resolution A.741(18) and
entered into force on 1 July 1998.
Amendments have been adopted:
➢ 2000 by resolution MSC.104(73), these amendments entered into force on 1 July 2002.

➢ 2004 by resolution MSC.179(79), these amendments entered into force on 1 July 2006.

➢ 2005 by resolution MSC.195(80), these amendments entered into force on 1 January 2009.

➢ 2008 by resolution MSC.273(85), these amendments entered into force on 1 July 2010.

Understanding DOC (Document of Compliace)


➢ DOC is the ISM Compliance Certificates issued to a Company

➢ DOC A full-term certificate issued under the authority of the Flag State
Government

➢ DOC is issued to a company based on the type of ship.

➢ This means that the DOC will be different for different type of ships i.e. if
company have10 containers and 10 oil tankers then 2 different DOC will be
issued, one to the container fleet and other to the tanker fleet.

➢ DOC is issued under the authority of flag state government by successfully


auditing and reviewing companies SMS and its implementation.

Types of DOC
A. Interim DOC
• An Interim DOC issued to a Company which has no practical operational experience of its SMS

• An interim DOC is issued to a newly established company or when a new type of ship is added in the company

• The company is requested to submit SMS implementation plan and 12 months are given to the company for

fulfilling the ISM requirements.

• The company shall undergo initial audit, and in case of newly built shipping company within the validity period

of interim DOC i.e. 12 months.

• The company shall undergo additional audit in case new ship type is added to the shipping company within the

validity period of interim DOC i.e. 12 months.

• For a new company, further document review is conducted prior to the audit by administration

B. Short Term DOC
• A Short-term DOC issued to cover the period until a full term DOC is Issued.
• A short term DOC is issued on the day of the audit by the administration auditor as a response
or proof of completion of the initial, annual or renewal audit process.
• Validity of short term DOC is 5 months

C. DOC
• It is issued by the administration after successful completion of initial audit or fulfilment or
interim DOC requirements.
• Issued after at least three months of implementation of SMS at the company and at least one
ship in the fleet for which DOC is concerned.
• The validity of DOC, after initial audit is 5 years from the next date of expiry and it is subjected
to annual audit.
• If a Major NON Conformity is found in the audit, the DOC is withdrawn.
• The DOC is kept with the company and copy is kept in all the ship under that DOC fleet.

Understanding SMC
❖ A Safety Management Certificate is issued to the ship which is managed by a
Company who is possession of a DOC or Short-term DOC (Not Interim DOC) relevant
to the Flag State Government, by Flag state Government or Recognized Organization
authorized by the Flag State of Government after successful completion of an Initial
Audit after at least 3 months implementation of its SMS on ship.
❖ Every individual ship must have a SMC which ensures that it complies with the on
board Safety Management Manual based on ISM.
❖ If a company owns 25 oil tanker ships, then SMC is issued to each ship with total of 25
SMC.
❖ SMC is issued after successfully auditing the ship for making sure that it is operating as
per the SMS based on ISM code.
❖ SMC shall be endorsed upon the successful completion of intermediate audit

A. Interim SMC
• Issued to a ship which is manage by a Company who is possession of DOC, Short-term DOC or Interim

DOC relevant to the flag state, by the Auditor who has conducted the audit under the authority of Flag state

Government upon completion of an audit for issuing Interim SMC in the following cases:

o A newly built ship added to the existing fleet of the shipping company.

o A new ship for which the Management Company has changed.

o To a Ship which SOLAS IX applies as mandatory required due to conversion, change of navigation area,

etc; or

o A ship as required by the new Administration when changng flag.

• Its Validity is for 6 months.

• A ship undergoes initial audit with interim SMC and it must fulfil the entire requirements to comply the SMS

based on ISM code to get the main SMC.

of the ship.

• Flag State Control is An enforcement of national and international

enforcement, ie port state control is necessary

• State is the nation state in whose port a vessel is for the time being.
For example, if a Malaysian Flagged Ship is in Indonesia, the
Indonesia is the Port State.

• Port State Control is an enforcement of international conventions


and codes by the administration of a port state visited by vessel of
any flag other than that of that port state. For example. Malaysian
flag ship may subject to port state control by Singapore Port State
Control Officer (PSCO), whereas Malaysian flag ship in malaysian
Port may be inspected only under flag state procedures.

• Because some flag state administration are not always
willing or able to properly exercise their control function
over ships flying their flags in accordance with

What is IMSAS ?
IMO’s main role is to create a regulatory framework for the shipping industry
that is fair and effective, universally implemented, and that promotes safe,
secure, environmentally sound, efficient and sustainable shipping.

However, the benefits from such a regulatory framework can only be fully
achieved when all Member States carry out their obligations as required by
the instruments to which they are Parties.

Member States have the primary responsibility to establish and maintain an


adequate and effective system to discharge their obligations as flag, port
and/or coastal States emanating from applicable international law.

IMO can assist Member States to improve their capabilities and overall
performance in order for them to fully comply with the IMO instruments to
which they are Parties.

The IMO Member State Audit Scheme (IMSAS) commenced as a voluntary


Scheme in 2006 and became a treaty obligation in January 2016. It aims to
promote the consistent and effective implementation of applicable IMO
instruments and to assist Member States to improve their capabilities

The procedure used to make the amendments to IMO Convention


enter into force:

• Tacit Acceptance
to the modern procedure for bringing into force amendment to an IMO
Convention, whereby the amendments will enter into force on a particular date
unless, by that date, objections to the amendments are received by IMO from a
specific number of parties.

• Explicit Acceptance
The normal procedure for adopting amendments to an international treaty is by
means of "explicit acceptance." This means that the amendments enter into force
so many months after being accepted by a specified number of Parties to the
original Convention.

The North India Ocean Hydrographic Commission (NIOHC)

Brief History of NIOHC


The North Indian Ocean Hydrographic Commission (NIOHC) was established in 2002 as the 13th Regional
Hydrographic Commission with Bangladesh, India, Myanmar, Sri Lanka, Thailand and UK as initial members, with
03 associate member countries and 03 observer countries to promote greater navigational safety in the Indian
Ocean region through common standards and procedures.

The area of NIOHC covers the northern part of Indian Ocean from Andaman seas to Gulf of Aden excluding the
Gulf of Oman area. A large portion of the world’s maritime traffic passes through the area and therefore NIOHC
has a vital role to play in assuring the safety of mariners within this area.
The first NIOHC meeting was held from 31st January to 03rd February 2002 at Dehradun, India, under the
chairmanship of RAdm KR Srinivasan, AVSM.

Primary objectives of the formation of NIOHC includes mutual cooperation in the field of hydrography,
establishment of regional ENC coordination, conducting joint hydrographic surveys in poorly surveyed
areas and coordinating hydrographic resources in the region.
