1. Can safety and health be legislated? What are the limitations of safety legislation? Where
would we be without it?
- Yes, safety and health can be legislated. This is done in many areas. Currently there are
no limitations of safety legislation because everywhere we go there is always danger
ahead on us in which we must always think the first priority is being safe. Without
this safety legislation we won’t always bear it on mind that safety is the most
important thing to keep in mind to avoid accidents and etc.

2. How do you think the future of safety legislation would be affected by another major
occupational disaster of the magnitude of a Monongah mine disaster? Do you think
passage of new safety and health legislation is still of a reactive nature?
- I think it would cause a lot of questions wherein it focuses on the safety legislation
because if it happens again like the monongah mine disaster it will cause more
ruckus in which can make the people be traumatized. I think it is still but we don’t
really know what will really happen next specially it is a reactive nature because we
can’t predict what will happen in the near future.

3. Although safety and health fines have gone up significantly in recent years, do you think
it matters how high they are when the likelihood of being inspected is so low? Discuss
this with people in the industry and note their opinions.
- For me it matter because if you are inside a responsible company wherein there are
people specified for that field well it will help avoid safety and health refines and
which it can bring more clients and investors because the way they come up with
this kind of solution.

4. What is R.A. No.11058? What is its purpose?


- With the RA 11058, employers are now required to comply with occupational safety
and health standards including informing workers on all types of hazards in the
workplace and having the right to refuse unsafe work, as well as providing facilities
and personal protective equipment for the workers, among others.
5. Which governing bodies implement and regulate the safety legislation in the country
(Philippines)? What is its scope of responsibilities?
- The Department of Labor and Employment (DOLE) and other government agencies
have issued hazard-specific guidelines, departmental orders and implementing rules
on OSH matters. The Labor Code (Presidential Decree No. 442 of 1974).
