CHAPTER I

PROBLEM AND ITS BACKGROUND

Same-sex marriage became an increasingly prominent issue in the United

States after the Hawaii Supreme Court held in 1993 that the state's ban on

same-sex marriage was unconstitutional. In 1996, Congress enacted and

President Clinton signed into law that the Defense of Marriage Act (DOMA).

Section 3 of DOMA defined marriage for purposes of administering federal

law as the legal union between one man and one woman as husband and

wife, and further defined the term spouse as a person of the opposite sex who

is a husband or wife.

Introduction

Same-sex marriage, also known as gay marriage, is marriage between people

of the same sex, either as a secular civil ceremony or in a religious setting. The

term marriage equality refers to a political status in which same-sex marriage

and opposite-sex marriage are considered legally equal.

Same-sex marriage laws has varied by jurisdiction, being variously

accomplished through legislative change to marriage laws, a court ruling

based on constitutional guarantees of equality, or by direct popular vote (via

ballot initiative or referendum). The recognition of same-sex marriage is a

political and social issue, and also a religious issue in many countries, and

debates continue to arise over whether people in same-sex relationships

should be allowed marriage or some similar status (a civil union).

Same-sex marriage can provide those in same-sex relationships who pay their

taxes with government services and make financial demands on them

comparable to those afforded to and required of those in opposite-sex

marriages. Same-sex marriage also gives them legal protections such as

inheritance and hospital visitation rights. Various faith communities around

the world support allowing those of the same sex to marry, while many major

religions oppose same-sex marriage. Opponents of same-sex marriages have

argued that recognition of same-sex marriages would erode religious

freedoms, undermine a right of children to be raised by their biological

mother and father or erode the institution of marriage itself.

Some analysts state that financial, psychological and physical well-being are

enhanced by marriage, and that children of same-sex parents or careers

benefit from being raised by two parents within a legally recognized union

supported by society's institutions. A court document filed by the American

Anthropological Association stated that reversing enacted SSM legislation

served to single out gay men and women as ineligible for marriage, thereby

both stigmatizing and inviting public discrimination against them.

The American Anthropological Association asserts that social science research

does not support the view that either civilization or viable social orders

depend upon marriage as an exclusively heterosexual institution.

In the late 20th century, rites of marriage for same-sex couples without legal

recognition became increasingly common. The first law providing for

marriage of people of the same sex in modern times was enacted in 2000 in

the Netherlands and came into force in 2001. As of 20 December 2017, same-

sex marriage is legally recognized (nationwide or in some parts) in the

following countries: Argentina, Australia, Belgium, Brazil, Canada, Colombia,

Scope and delimitation of the study

The study focus on the same sex marriage. To identify what is all

about, and what is the side effect of same sex marriage. To discuss the

significant of same sex marriage. Aim to know the deepest reason of the some

people who involved the same sex marriage.

Definition of terms

Marriage- A legally recognized relationship, established by a civil or

religious ceremony, between two people who intend to live together as sexual

and domestic partners. A married relationship between two people, or a

somebody's relationship with his or her spouse. The ceremony in which two

people are joined together formally in wedlock.

Love- passionate attraction and desire: a passionate feeling of romantic

desire and sexual attraction. Very strong affection: an intense feeling of tender

affection and compassion. Somebody much loved somebody who is loved

romantically or sexually. Something eliciting enthusiasm: something that

elicits deep interest and enthusiasm in somebody.

Lesbian- A homosexual woman or a woman who is attracted to other

women.

Gay- Someone who is homosexual, especially a man.

Bisexual- Someone who is attracted to two genders.

Transgender- Someone who does not identify as their birth gender

(man to woman, woman to man).

Chapter II

REVIEW OF RELATED LITERATURE

Local

Marriage is both ubiquitous and central. All across our country, in

every region, every social class, every race and ethnicity, every religion or

non-religion, people get married. For many if not most people, moreover,

marriage is not a trivial matter. It is a key to the pursuit of happiness,

something people aspire to—and keep aspiring to, again and again, even

when their experience has been far from happy. To be told “You cannot get

married” is thus to be excluded from one of the defining rituals of the

American life cycle. The keys to the kingdom of the married might have been

held only by private citizens—religious bodies and their leaders, families,

other parts of civil society. So it has been in many societies throughout

history. In the United States, however, as in most modern nations,

government holds those keys. Even if people have been married by their

church or religious group, they are not married in the sense that really counts

for social and political purposes unless they have been granted a marriage

license by the state. Unlike private actors, however, the state doesn’t have

complete freedom to decide who may and may not marry. The state’s

involvement raises fundamental issues about equality of political and civic

standing. Same-sex marriage is currently one of the most divisive political

issues in our nation. In November 2008, Californians passed Proposition 8, a

referendum that removed the right to marry from same-sex couples who had

been granted that right by the courts. This result has been seen by the same-

sex community as deeply degrading. More recently, Iowa and Vermont have

legalized same-sex marriage, the former through judicial interpretation of the

state constitution, the latter through legislation. Analyzing this issue will help

us understand what is happening in our country, and where we might go

from here. Before we approach the issue of same-sex marriage, we must

define marriage. But marriage, it soon becomes evident, is no single thing. It

is plural in both content and meaning. The institution of marriage houses and

supports several distinct aspects of human life: sexual relations, friendship

and companionship, love, conversation, procreation and child-rearing,

mutual responsibility. Marriages can exist without each of these. (We have

always granted marriage licenses to sterile people, people too old to have

children, irresponsible people, and people incapable of love and friendship.

Impotence, lack of interest in sex, and refusal to allow intercourse may count

as grounds for divorce, but they don’t preclude marriage.) Marriages can exist

even in cases where none of these is present, though such marriages are

probably unhappy. Each of these important aspects of human life, in turn, can

exist outside of marriage, and they can even exist all together outside of

marriage, as is evident from the fact that many unmarried couples live lives

of intimacy, friendship, and mutual responsibility, and have and raise

children. Nonetheless, when people ask themselves what the content of

marriage is, they typically think of this cluster of things. Nor is the meaning

of marriage single. Marriage has, first, a civil rights aspect. Married people get

a lot of government benefits that the unmarried usually do not get: favorable

treatment in tax, inheritance, and insurance status; immigration rights; rights

in adoption and custody; decisional and visitation rights in health care and

burial; the spousal privilege exemption when giving testimony in court; and

yet others.

According to Godoy 2012 gay marriage has been legalized in the

District of Columbia and 7 U.S Vermont being the first to recognize legal

equality in the civil marriage laws and to protect the religious societies

authorized to solemnize civil marriages. The laws then came into effect on

September 1, 2009. In Vermont the Supreme Court ruling in the Baker v.

Vermont that same-sex couples had a constitutional right to access the

benefits of marriage stated in the (New York Times).Massachusetts issued its

opinion that banning gay marriage arbitrarily infringed on the individual,

reversing a lower courts decision to uphold the ban. Massachusetts began

issuing marriage license on May 17, 2004. As a result of the Supreme Judicial

Court of Massachusetts ruling Goodridge V. Department of public Health

stated in (New York Times). Connecticut Supreme Court overruling the

decision of a lower court who had found in favor of the state. Stated in the

(New York Times) the Supreme Court found that prohibiting gay marriage

violated the constitution guarantees of equal protection. Same-sex marriage

couples were issued marriage licenses starting from October 28, 2008. Iowa

wanted to ban same-sex marriage as well. However, the ruling came in the

case of Vamon v. Brien in which the Supreme Court upheld a lower court

ruling that said that there was no compelling government interest in denying

same-sex marriage stated in (New York Times). Weeks later after they were

trying to decide whether or not should the state should ban gay marriage,

their licenses were issued April 27, 2009. They made the case for equality in

Iowa. New Hampshire had gone through several permutations so as to satisfy

Gov. Lynch’s desire that the rights of religious institutions to deny marriage

related services to same-sex couples be explicitly mentioned. They then

recognized the same marriages from other jurisdiction being were gay

marriages was already legalized (New York Times). The law came into effect

on January 1, 2010. Gay marriage has been an issue that has become a huge

discussion in America today. Same-sex marriage, considering marriage

between two persons of the same biological sex or gender identity. There are

people that are for gay marriage and against it, there are also some states that

have passed gay marriage laws and other states that have not, and the 2012

presidential election has also become a part of this big issue with gay

marriage. With gay marriage having two different sides to it, this literature

review will focus on three questions on the topic gay marriage.

gender, for them to be more confident in the society full of discrimination. While

13 or 44% never in their entire life thing to change their gender because they are

already contented for who they are.

said that they are knowledgeable enough and they know that what to do to

SUMMARY, RECOMMENDATION, CONCLUSION

SUMMARY

Same sex marriage is very hot issue in our country today. Same-sex

marriage can provide those in same-sex relationships who pay their taxes

with government services and make financial demands on them comparable

to those afforded to and required of those in opposite-sex marriages. Same-

sex marriage also gives them legal protections such as inheritance and

hospital visitation rights. Various faith communities around the world

support allowing those of the same sex to marry, while many major religions

oppose same-sex marriage. Opponents of same-sex marriages have argued

RECOMMENDATION

 To those LGBT do what they want but also know their role and

limitation in the society.

 To those LGBT even they are judging by the other people, try to avoid

them and avoid get in trouble and create misunderstanding.

 To the readers stop looking them by their outlook appearance, judge

them by their kind heart.

CONCLUSSION

We conclude that LGBT people are having a role in the society even

though people bullied them. And LGBT have a role in the society that they

need to come up with it. Stop judging and bullied them because they are

also a human that they need to respect.
