If Test plan / OEM Test standard / specification used based on customer requirement, the test report will be issued without NABL
symbol. However, the laboratory accreditation certificate and scope will be shared with customer upon request.

NABL Accredited CAB Combined ILAC MRA Mark’ provided in the test report does not certify the product and shall not be
placed by any means on the products or items, which the lab has tested. It shall not be used on any other item other than the
Test Report.

Decision Rule Procedure:

Standard / Specification: For Immunity tests lab will adapt the DUT functional class / status requirements as per international
standards and/or OEM specifications. For Emissions tests the PASS/FAIL will be declared against the limits used as per international
standards and/or OEM specifications
Test plan: In case of specific requirement to assess the PASS/FAIL of the product are clearly defined in the customer test plan or
email information, Test plan overrules the Standard / Specification

Customer defined: In case of ambiguity lab will declare only the observations or outcome of the measurements. Final decision on
statement of conformity shall be given in a written form or email to lab by the customer department, Customer defined overrules the
Standard / Specification & Test Plan
Measurement uncertainty will not be considered in declaring statement of conformity.Upon request, uncertainty budget for quantitative
tests will be shared.

Terms and Conditions for EMI/ EMC Testing


These Terms and Conditions for EMI/ EMC Testing (hereinafter referred to as ‘Terms’) shall apply to the relationship between Bosch
Global Software Technologies Private Limited (‘BGSW’) and ‘Customer’ (Customer details in Page1) for the testing services to
be rendered by BGSW under this Test request form. These Terms will be binding between both the Parties.
The Customer agrees as under: The Customer hereby engages BGSW for providing the EMI/ EMC testing services as per Test request
form and respective Purchase Order (hereinafter referred to as “Services”).

1. BGSW shall render the Services as per the proposal submitted to the Customer enumerated under the respective proposal to the
Terms. The timelines for testing are indicative and in the event there is any delay, such as failure of lab instruments, or any other
delay which is beyond the control of BGSW, Customer shall co-operate and makes no claim in this regard.
2. The Customer hereby agrees to make payment to BGSW for the services rendered by BGSW as per the PO with necessary
statutory deductions as per applicable law. The Customer shall provide proof of remittances of such statutory deductions as
required by BGSW. The payment terms shall be as agreed by the parties in the PO.
3. The test services are performed based on Customer requirements and BGSW will not be responsible for any damage caused to the
test samples during the rendering of tests. Customer makes no claim in this regard.
4. These Terms along with the PO (irrespective of its release or receipt) shall be effective from the date of execution by the Customer
and BGSW and shall remain in force for a period of One Year, unless terminated earlier by either party without being liable for any
kind of compensation. The time taken to execute these Terms shall automatically extend the service period pro rata. Upon
termination BGSW will be entitled for the payment as stated in the PO. BGSW has the right to terminate these Terms in its sole
discretion. Notwithstanding anything contained above and or under any of the Terms, termination or expiry of these Terms shall not
affect the rights and obligations of the Parties which existed prior to termination of expiry.
5. BGSW will perform the services on an ‘AS IS’ basis. In no event, whether as a result of breach of contract or warranty, alleged
negligence or otherwise, BGSW shall not be liable for any direct, indirect, consequential, exemplary, special or punitive damages (or
any comparable category or form of such damages, howsoever characterized in any jurisdiction) arising out the services rendered
by BGSW, regardless of the form of action, whether in contract, tort, strict liability or otherwise, and even if foreseeable or if such
party has been advised of the possibility of such damages.
6. This arrangement is on a non-exclusive basis and does not prevent BGSW from providing similar services to any other party.
7. No waiver, cancellation, addition or alteration of these Terms will be binding unless made in writing and signed by both parties.
8. These Terms shall be governed under the laws of India and the courts of Bangalore shall have exclusive jurisdiction.
9. In the event of any dispute or difference arising at any time between the parties hereto as to the construction, meaning or effect of
these Terms or any clause or thing contained herein or the rights, duties, liabilities and obligations of the Parties hereto in relation to
the Services the same shall be referred to a single arbitrator, in case the parties can agree upon one (1) arbitrator, within a period
of thirty days upon being called by a party to do so and failing such agreement to three (3) arbitrators, one (1) each to be appointed
by BGSW and the Customer and the third to be appointed by the two arbitrators so appointed. All such arbitration proceedings shall
be held in Bangalore in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time.
10. Neither Party shall be liable for non-performance or delay in performance of any obligation stipulated in this Agreement if such non-
performance or delay is caused by an event of Force Majeure (eg. Earthquake, fire, flood, accidents, war, riots, situations beyond
their control, etc) that materially impairs the ability of a party to perform its obligations under these Terms.
11. Both parties agree to keep information confidential communicated by either party in connection with these Terms, whether marked
as ‘Confidential’ or not. BGSW will take due permission from customer (in written form, via E-mail/Letter) if it intends to place any
information in public domain. Except for information that the customer makes publicly available, or when agreed between the
laboratory and the customer (e.g. for the purpose of responding to complaints), all other information is considered proprietary
information and shall be regarded as confidential.
12. Each party hereto shall be considered as an independent contractor responsible for its own expenses and financial obligations
incurred in the performance of these Terms.
13. Customer acknowledges and agrees that background Intellectual Property of BGSW used in the performance of the services shall
remain with BGSW.
14. If any provision of these Terms be deemed invalid or unenforceable under applicable law, such provision will be considered
inoperative but will not affect the validity of the remaining provisions of these Terms.
15. These Terms are for the benefit of the parties. No third party shall have the right to (a) reply on the services provided by BGSW or
(b) seek to impose liability on BGSW as a result of these services.
16. Any amendment to these Terms shall be in writing and signed by both the Parties.
17. Neither party shall assign its obligations under these terms without prior written consent of the other party.
18. These terms shall be executed in two (2) counterparts, both of which will be deemed an original, but both of which together shall
constitute one and the same instrument.
19. Test samples will be tested ‘as received’ and after testing the same will be immediately returned to customer unless otherwise
agreed. In case lab has to retain the samples, necessary conditions to be maintained and duration will be agreed on case to case
