representatives of DENR to address illegal logging operations in the
area of Oriental Mindoro. After inquiring whether they had a license
to cut down the tree, they replied that they had none. In view of the
same, an Information was filed against them with crime of violation
of PD No. 705 or the Revised Forestry Code.
As to the part that the accused cut the dita tree without any
authority, the Court held that the language of Section 77
incriminates them as they cut, gathered, collected, and removed
timber from a dita tree. It explaining the same, the Court had the
occasion to enunciate that the term “private land” covers lands
possessed by national minorities such as their sacred and
communal grounds. Section 77 of PD 705 reference to forest lands
and even alienable and disposable public land could have also
encompassed ancestral domains and lands.
