Subject:- Grant of conditional permission to N R Sastry Govt. Ayurvedic College Vijayawada, l1ndhra Pradesh
(Inst. ID AYU0002) for intake capacity with 60 Seats (75 seats including EWS) in UG BAMS course and
20 Seats (25 including EWS) in 04 PG course namely (i) Dravyaguna Vigyana-5 Seats (06 Seats including
EWS), (ii) Rasa shastra & Bhaisajya Kalpana- 5 Seats (06 seats including EWS), (iii) Prasuti Tantra
evum Stri Roga - 5 Seats (06 Seats including EWS), (iv) Kayachikitsa- 5 Seats (07 Seats including EWS)
under section 28 of the NCISM Act, 2020 for the academic session 2022-23 and relevant regulations
thereunder in respect of appeal dated 22.11.2022-regarding.

Sir/Madam,

With reference to the subject mentioned above, I am directed to inform you that in pursuance of the provision of
National commission for Indian System of Medicine Act, 2020, the Indian Medicine Central Council Act,1970 (48 of 1970) has
been repealed with effect from the 11th day of June, 2021. With effect from the said date, the Central Council of Indian Medicine
constituted under sub-division (1) of section 3 of the Indian Medicine Central Council Act, 1970 (48 of 1970) shall stand
dissolved. Now, in exercise of the powers conferred by sub-section (3) of the section 1 of the said Act, the Central Government
hereby notifies that all the provisions of the National Commission for Indian System of Medicine Act, 2020 has been come into
force with effect from the 11th day of June, 2021.

1. This is with reference to the first appeal filed by Commissioner, Ayush Government A.P, Gollapudi, Vijayawada, Andhra
Pradesh vide letter no- 1840255/dated 31.10.2022 to the commission in respect of denial of conditional permission issued
to N R Sastry Govt. Ayurvedic College Vijayawada, Andhra Pradesh (Inst. ID AYU0002), for intak:e capacity with
60 Seats (75 seats including EWS) in UG BAMS course and 20 Seats (25 including EWS) in 04 PG course namely
(i) Dravyaguna Vigyana-5 Seats (06 Seats including EWS), (ii) Rasa shastra & Bhaisajya Kalpana- 5 Seats (06
seats including EWS), (iii) Prasuti Tantra evum Stri Roga - 5 Seats (06 Seats including EWS), (iv) Kayachikitsa-
5 Seats (07 Seats including EWS) as the case may be due to not fulfilling the basic eligibility criteria in terms of
Regulation 3 of the "Indian Medicine Central Council (Requirements of Minimum Standard for under-graduate Ayurveda
Colleges and attached Hospitals) Regulations, 2016", Indian Medicine Central Council (Post Graduate Ayurveda Education)
Regulations, 2016, provisions under the NCISM Act, 2020 and provisions under the NCISM Act, 2020 and relevant
regulations thereunder due to non availability of teaching, non-teaching staff, hospital staff and other shortcoming as
mentioned in denial order dated 17.10.2022

2. Thereafter the said appeal was placed before the Chairman, NCISM and Chairman NCISM constituted a Hearing Committee
and provided an opportunity of hearing to the college. Accordingly, the letter was sent to The Principal of the College vide
Commission·s letter NCISM/Comm./Appeal/(2022-23) dated 18.11.2022 to appear before the designated hearing
committee as constituted by the Chairman, NCISM on 22.11.2022 in respect of appeal filed under section lO(l)(g) and
section 24(3) of the National Commission for Indian System of Medicine ACT, 2020 and to produce all relevant valid
documents/records/ proof to substantiate the claims and make written submission and submit an authenticated copy of
evidence/verifications to commission with shortcoming wise clarifications mentioned in the denial orders dated 17.10.2022
passed by the Medical Assessment and Rating Board for Indian System of Medicine, NCISM. The proceedings of appeal was
held virtually on 22.11.2022 at 12:00 PM and on behalf of college, Dr. P. Sai Sudhakar, Principal, attended the hearing.

3. The hearing committee sought clarification from the representatives of N R Sastry Govt. Ayurvedic College Vijayawada,
Andhra Pradesh (Inst. ID AYU0002) regarding shortcomings mentioned in the denial orders dated 17.10.2022 passed
by the Medical Assessment and Rating Board for Indian System of Medicine, NCISM.

4. The submission made by the Principal, N R Sastry Govt. Ayurvedic College Vijayawada, Andhra Pradesh (Inst. ID AYU0002)
was placed before the designated hearing committee and hearing committee sought clarification regarding the shortcomings
mentioned in the denial orders dated 17.10.2022 and also asked for the compliance of Shortcomings and asked the
representatives to submit the affidavit regarding their assurance in respect of fulfillment of all requisite criteria as mentioned
in the denial orders.

5. In response of the same, commission received the affidavit from the Commissioner, Ayush Department,
Government of Andhra Pradesh vide affidavit no. CM 882653 dated 23.11.2022 with the affirmation that the college will
fulfill all shortcomings with regards to shortcomings of Teaching, Non teaching , Hospital staff, and along with other
shortcomings mentioned in the denial orders. Commissioner, Ayush Government of Andhra Pradesh also confirmed that they
will appoint new Teaching, Non- Teaching, Hospital Staff and alongwith other shortcomings within stipulate time period.

6. Hence, in view of the affidavit submitted by the Commissioner, Department of AYUSH; Govt. of Andhra Pradesh, the
Chairman, NCISM directed the President, Medical Assessment and Rating Board for Indian System of Medicine, NCISM vide
letter no. NCISM/Comm./Appeal/(2022-23) dated 24.11.2022 to grant conditional permission to N R Sastry Govt.
Ayurvedic College Vijayawada, Andhra Pradesh (Inst. ID AYU0002) under section 28 of NCISM Act, 2020 for the
academic session 2022-23.

7. Therefore, it has been decided by the President, Medical Assessment and Rating Board for Indian System of Medicine,
NCISM to issue conditional permission to N R Sastry Govt. Ayurvedic College Vijayawada, Andhra Pradesh (Inst. ID
AYU0002) for intake capacity with 60 Seats (75 seats including EWS) in UG BAMS course and 20 Seats (25
including EWS) in 04 PG course namely (i) Dravyaguna Vigyana-5 Seats (06 Seats including IEWS), (ii) Rasa
shastra & Bhaisajya Kalpana- 5 Seats (06 seats including EWS), (iii) Prasuti Tantra evum Stri Roga - 5 Seats
(06 Seats including EWS), (iv) Kayachikitsa- 5 Seats (07 Seats including EWS) under section 28 of the NCISM
Act, 2020 for the academic session 2022-23 on the basis of affidavit submitted by the Commissioner,
Department of AYUSH; Govt. of Andhra Pradesh, subject to following condition:-

(i) It is further informed that minimum 15% of undergraduate seats of the permitted intake capacity of 60 Seats (75
seats including EWS) for UG and 20 Seats (25 seats including EWS) in 4 PG courses shall be treated as all
India quota. The counseling for seats under all India quota shall be conducted by respective counseling authority as
designated by Central Government for A.Y. 2022-23 and counseling for the remaining 85% seats or as the case may be,
shall be conducted by the concerned Counseling Authority of that State/UT. The permission of the college stands
withdrawn if the college fails to comply with the aforesaid direction of the Central Government/NCISM for
all India quota or the students admitted thereunder.

8. Admissions made in violation of the above conditions will be treated as invalid and action will be initiated under NCISM Act &
Regulations thereunder.

9. Discrepancies, if any, may be immediately brought to the notice of Medical Assessment and Rating Board for Indian System
of Medicine, NCISM.

10. The following requirements should be fulfilled by the college by 31st December, 2022 and send a compliance report to
get permission for the session 2023-24:

i) All the requirements of Minimum Standard of infrastructure and teaching & training facilities as specified in Regulation 3
of the "Indian Medicine Central Council (Requirements of Minimum Standard for under-graduate Ayurveda Colleges and
attached Hospitals) Regulations, 2016;
ii) All the requirements of the Indian Medicine Central Council (Minimum Standards of Education in Indian Medicine)
Amendment Regulations, 2016 (for Ayurveda);
iii) All the requirements of the "Indian Medicine Central Council (Requirements of Minimum Standard for post-graduate
Ayurveda Colleges and attached Hospitals) Regulations, 2016
iv) All the requirements under the provisions of the NCISM Act, 2020 and relevant Regulations made thereunder should be
fulfilled in to; and

11. The fulfillment of the conditions given above may be made within the time period specified and compliance report should be
submitted by the college to President, Medical Assessment and Rating Board for Indian System of Medicine. The Medical
Assessment and Rating Board for Indian System of Medicine will verify that the conditions have been fulfilled for considering
the permission from the academic session 2023-24.
