We will pay any person insured under this section, or in the event of their death, their legal personal
representatives, a benefit, if they are injured solely and directly due to accidental visible violent and
external means. Once this leads to one of the events listed below within 12 months of the injury, we
will pay the benefit amounts shown below, relevant to Section 4A, for each unit of cover you buy.
Your schedule will note the names of those insured under this section.

4B – Family travel
We will pay you a benefit, or in the event of your death, your legal personal representatives, if you
or any member of your family is injured solely and directly due to accidental visible violent and
external means while in, on or getting into or out of:
a. any road vehicle (other than mopeds, motor cycles or motor scooters) as driver or passenger in
a private capacity,
b. any railway train,
c. any aircraft operated by a licensed operator or charterer,
d. any passenger ship or ferry, hovercraft, hydrofoil or air cushion vehicle as a passenger in a
private capacity.

Medical expenses
Where we are paying weekly benefit for any claim under this policy, we will also pay up to 15 per
cent of the weekly benefit amount, towards the medical expenses incurred by the insured person
which arise from the same accident.

Limitations on the cover provided


1. The benefit under items 6 and 7 will be paid:
a. when the total amount has been calculated and agreed,
b. only if the bodily injury requires treatment by, and any period of disablement is certified by
a medical doctor,
c. for no more than 104 weeks after the first week of disablement, as certified by a fully
qualified medical doctor, for any one accident.
2. We will only pay a claim under one of the benefits noted under items 1 to 6 in respect of the
same bodily injury. Any amount paid under items 1 to 5 shall be reduced by the amount of any
benefits we have already paid under items 6 to 7 for the same bodily injury.
3. Once we have paid a claim for bodily injury to a person under items 1 to 5 we will not pay any
further amount in respect of that person under Section 4A and or 4B of this policy.

Geographical limits
1. The Republic of Ireland, and
2. for the purposes of travel only, the remainder of Europe, the United States of America, Canada,
Australia and New Zealand.

Special conditions and exceptions


1. Exclusions to cover
We shall not pay a claim under this section in respect of bodily injury whether fatal or non-fatal,
directly or indirectly caused by or resulting from:
a. The insured person taking part in military, air force or naval service operations or while at sea
as an officer or member of the crew of a merchant vessel.
b. Intentional self-injury, suicide or attempted suicide, provoked assault, fighting (except in
genuine self-defence) or deliberate exposure to exceptional danger (except in an attempt to
save human life), disease or natural causes.
c. Any accident happening when any insured person is insane or is under the influence of drink
or drugs.

d. Any accident happening while the insured person is taking part in aeronautics and or
aviation of any description or resulting from being in on or getting into or out of any aircraft
(other than as a passenger in a standard type aircraft operated by a recognised air charter
company) or while taking part in any speed or duration test of any kind. “Aircraft” shall
include any vessel, craft, or thing made or intended to float in or travel through the air.
e. Medical or surgical treatment (except where such treatment is made necessary by bodily
injury caused by an accident covered under this section), childbirth or pregnancy.
f. The insured person engaging in football (of any kind), hurling, hunting, motor-cycling
(whether as driver or passenger), mountaineering, winter sports, polo, racing of any kind
(other than on foot) or using a circular saw unless otherwise agreed in writing by us.

2. Our rights in the event of a claim


We will not pay a claim under this section unless:
a. a person we appoint is allowed to undertake a medical or surgical examination of the insured
person when the alleged injury occurs, and
b. a person we appoint is allowed to examine the insured person as often as we may require, and
c. we can in the event of death undertake any necessary post mortem examination of the
deceased for the purpose of finding out the extent of the alleged injuries and disability or the
true cause of death, and
d. we are provided with prior notice of any surgical examination of the body, requested by
the deceased’s representative, to allow us have our own medical officer present at the
examination.

3. Your obligation to advise us of a change in occupation


You must immediately notify us in writing if any person availing of cover under this section changes
their occupation to one which increases the risk of injury above that last declared to us. If you are in
any doubt as to whether an occupation increases the risk of injury, you should contact us.
We will only be responsible to pay for any bodily injury arising out of or in the course of the new
profession, business or occupation if we have agreed and noted the change by endorsement to the
policy.

4. Your obligation to provide all necessary information


Any insured person or their legal personal representatives will at their expense provide all certificates,
information and evidence as we may reasonably require. We will not pay a claim under this section
unless you or any insured person or their legal personal representatives have complied with the
terms of this condition.

5. Refunding benefits that are not due


If we pay a claim for accidental death of an insured person and it is later found that death has not
occurred, the amount paid shall be refunded to us.
