AFFIDAVIT

I, Kirby Maderal Baguio, of legal age, Filipino citizen, Married and with address
at Brgy. Buluangan, San Carlos City, Branch Manager and Authorized Representative
of Des Marketing Inc. Alijis Branch Bacolod city, after having been duly sworn in
accordance with law do hereby depose and state:

1. On April 7, 2021 , Mrs. Lourene Jane Torres Buayan, Loaned 1 unit of Yamaha
Mio I’s 125 with a principal Amount of 110,208

2. That on (date of demand letter),I had sent a demand letter to (name of the
person addressed by the demand letter)a copy of which is attached herein as Annex
“___”.

3. That despite repetitive demands, (name of the person addressed by the

demand letter) still failed to pay the above-mentioned obligation.

4. I executed this affidavit to attest to the truthfulness of the foregoing facts and
circumstances in support of the Statement of Claim against (name of the person
addressed by the demand letter).

AFFIDAVIT
I, MARILYN C. MAGULIANO, of legal age, Filipino, and a resident of Brgy.,
Bungad, San Pablo, Isabela, duly represented by Consolocion V.
Maguliano, likewise of legal age, Filipino, and with residence of Ugad,
Cabagan, Isabela, after having sworn to in accordance with law, do
hereby depose and state:

1. That on May 13, 2020, Defendant Marcos C. Limtuaco, a.k.a Crispin

Limtuaco borrowed an amount of FORTY THOUSAND (Php40,000.00)
Pesos with six (6%) percent monthly interest. It was agreed upon that
the principal amount FORTY THOUSAND (Php40,000.00) Pesos with
corresponding interest shall be paid by the defendant upon harvest of
his corn crops; a copy of the Loan Agreement dated May 13, 2020 is
hereto attached as ANNEX "B".

2. That however, despite repeated demand, defendant refused to settle

his obligation after his harvest;

3. That the matter was brought before the Office of the Punong
Barangay of Barangay Bungad, San Pablo, Isabela. Nonetheless,
defendant willfully failed or refused to obey summons or to appear for
hearing. Thus, a Certificate to File Action was issued on June 14, 2021, a
copy of which is hereto attached as ANNEX "C".

4. That I am executing this affidavit to attest the truth and veracity of the
foregoing and for the purpose of filing the small claims complaint
against defendant Marcos C. Limtuaco, a.k.a. Crispin Limtuaco.
