On Saturday, November 19, 2022, at approximately 7:00 a.m. I, Sergeant (Sgt.) I was advised to proc department located at 2500 Campus Blvd. Upon arriving at the UNM police department, I 0 the University of New Mexico (UNM) campus police learned Agent Miguel Gaytan (NMSP/IB) Zone 3 Abq was assigned as case agent BREIFING: earned there was one deceased male in this incident identified as Brandon Travis, another male currently at UNH with a gunshot wound identified as Michael Peake. Also, two other males and one female who were involved who fled © Michael Peake was identified as a New Mexico stat: University (NMSU) basketball player cured the incident. I was who was in Abq for a game. UNM campus video surveillance cap! told el walking with a female when three males run up beh! ad a firearm. Michael also e surveillance showed Mic em. One of the three produces a firearm. Michael gets hit with the bat and then gunfire is exchanged. Brandon 8 hit by gunfire and succumbs to hie injuries on scene. Michael is also struck by gunfire in his leg and transported to Hospital (UNMH) Video surveillance captured Michael walking up to a yellow Camaro that pulls up to UNM campus after dent. END OF BRIEFING Following the briefing, I was assigned to locate where the N¥SU Basketball team was staying and conduct an interview with the Coach. A Lieutenant with the UNM Police NMSU Basketball team was staying at the Doubletree Hotel in downtown Aba. We also provided me with the Coach's name which was Dominique Taylor and his phone number. I proceeded to the Doubletree and contacted Coach Taylor as I arrived. T learned advised me coach Taylor was in fact the Assistant Coach and Head Coach was Greg Heiar. Coach Heiar also mentioned they were talking about canceling the game that was supposed to take place on this day. It was confirmed that ¥ sake was one of Coach Heiar's players on the NWSU Basketball ael team. coach Heiar said he has not seen any of the players yet and they were supposed to have a team meeting at 10:30 AM. I asked Coach Heiar if he knows € any of his players that drive a yellow Camaro or anybody who ig friends with Michael who drives a yellow Camaro, and his response was no. Coach Heiar said all the players came to Abg on the bus and them drove emselves here. I advised Coach Heiar it was believed ael placed n and other items in the trunk of the Camaro Coach Heiar told me he doesn't know Michael very well, but Coach Taylor knows him better. Coach Heiar said he has only been with the team for seven months. Coach Heiar told me he would talk to his team to try and find o and pase it on to me ag much information as possible As we exited my department issued Dodge Charger, I received information from sgt. Vargas th ree individuals Michael met with by the yellow Camaro were identified as Issa Muhammad, Marcelus Avery, and Anthony Roy. He said he had 5 missed calle from Isea Muhammad, and 11 missed calle from Ani he ony Roy, and even had missed calls from Coach # =. Coach Taylor vex woke up to any of those phone calle because he turned his ringer off. He said he finally woke up to his hotel room phone ringing and he said it was Coach ront of the h phone. I emphasized to Coach Taylor how important sure if was to recover the gun and other items that were placed in the trunk. T asked him to let other itens and he me know if he finde out any information about the Camaro, gun, or said he would (nore: issued cell phone to Coach Taylor following the interview inside the vehicle. My WatchGuard body cam approximately 10:27 AM ne following information below was learned over a phone call on my department captures the conversation. The phone call was made at Coach Taylor told me they did room checks at midnight to make sure all players were in oomé and all players were in their rooms. He said they would take turns ng in the lobby of the hotel to make sure players were not leaving the hotel. Coach Taylor said he sat in the lobby from approximately 12:45 AM to 2:20 AM. During his time observed three players lobby, he said at approximately 1:15 AM to 1:20 AM, h walk into the hotel. Coach Taylor identified those players as Michael Peake, Xavier Pinson, and William Benjamin. He said he only pointed towards the elevators and did not have a conversation with them. Before the phone call was ended I asked Coach Taylor if able to in he heard anything from Coach Helar about me be: rview Isa, Marcelue, and Anthony. He said he hasn't heard anything, but that Coach Heiar was in contact with theiz AD to find ot on first if they needed legal represen’ END OF INTERVIEW. (NOTE: My WatchGuard body camera was activated and recording for the below phone call on ny department issued cell phone) At approximately 10:38 AM, I attempted to contact Coach Heiar over the phone to get an update on if he learned any new information or if I was able to speak to Issa, Marcelus, and Anthony. His phone rang and eventually went to voicemail. I never received a call back from Coach Heiar I then contacted Coach Taylor over the phone, and he answered. At thie point I learned Michael had a tablet device with him during the incident which he also placed inside the camaro. I asked Coach Taylor if NMSU issues tablets to the students and he said some of them get one and some do not. I never received a call bac! from Coach Helar I then attempted to contact Coach Taylor and his phone also went to voicemail. I left a voicemail message for Coach Taylor also requesting an update on speaking with the three other players. I also let him know I was starting to see some players gett the bus. I never received a call back from Coach Taylor (NOTE: My WatchGuard body camera was activated and rec: ny department issued cell phone) ow phone call on At approximately 12:27 PM, I received a phone call from the NMSU AD who was ident: as Braun Cartwright. He stated he received a phone call from Coach Heiar that he was busy Ww: ght nyway. I advised Cartwright Michael was being cooperative with NNSP IB Agents and that he told Agents he the team for Cartwr: to call me to assist in gave his gun and tablet to Issa, and Anthony. T told Cartwright T observed players gel bus and that the bus left. I algo tol to go inte the hotel to secure those items because Michael told Agents who had them and they are considered evidence him I was abo! ng on ¢ Ay this time, Cartwright tells me the bus left and was heading back to Las Cruces. He told me he was going to make some phone calls to find o he gun and tablet were (NOTE: My WatchGuard body camera was activated and recording £ my department issued cell phone) the below phone call on At approximately 12:33 PM, I called AD Cartwright back to confirm the bus was on it?s way back to Las Cruces and that Issa, Anthony, and Marcelus were not at the hotel anymore. He stated last he heard it was on it?s way back to Las Cruces and he tried to call Coach Heiar, but it went to voicemail At approximately 12:36 PM, I attempted to contact Coach Taylor. It does not ga to voicemail but sounds like someone answers the phone and they immediately hang up on me a on Interstate 25 with my lights and sirens activated attempting to locate the bus with the NMSU 8 time, I beg ariving sout! Basketball team on it At approximately 12:51 PM, I receive a text message from NMSU Police Department Lieutenant (Lt.) Nelson McGuire that they could assist us if needed. I contacted Lt 1¢ phone and asked if he could get in contact with anyone on the bus to om pull over. A short while later I receive a text message from Lt. McGuire ng they pulled over at the Fort Craig rest stop which is located on Interstate 25, ar milepost 114 NEW MEXICO SUPPLEMENTAL REPORT 4 wmse2300 | 2022-23676 | w | 7 | 10 I requested NMSP Patrol to assist me. Officer Lawrence Guzzardo from District 11 was assigned to assist. Officer Guzzardo arrived at the rest stop prior to my arrival. Refer to Officer Guzzardo's report for details of his involvement. Prior to arriving at the Fort Craig rest stop, I received another text message from McGuire stating the Coach advised an Aesistant Coach has possession of the firearm back confirmed that an at the Doubletr 2 Hotel. I immediately contacted AD Cartwright and the hotel. AD Cartwright texted me the ique Taylor (screenshots of these text messages will be attached to this report). I later asked 1 received this information and he stated AD Cartwright contacted Chief Andrew Bowen. They told AD Cartwright they wanted an attorney. I requested Coach Michael?s firearm. Coach Taylor Taylor take a photo of the firearm and text it to me so I could visually confirm he had t. Coach Taylor texted me a photo of the firearm. (a screenshot of this text message and photo will be attached to this report) At approximately 2:33 PM, I received a text message from AD Cartwright advising of it Michael?s phone was in Las Cruces and one of their administrators had possess: (a screenshot of this text message will be attached to this report) I arrived back at the Doubletree in Abq. I activated ny d contacted Coach Taylor. He advised me he was on the third Ay approximately 3:44 Pt ward body camera a and T told him I would come up to him. As soon as I exited the elevator, Coach a table hallway. While wearing gloves, I lifted the towel to ensure the firearm was there in a paper bag. I then asked Coach Taylor how he came about getting the firearm. Coach Taylor said explained th my told Coach Heiar where the firearm was at. Coach Heiar then called Coach Taylor and told e firearm was at and to go get it. I had Coach Taylor show me which room he got the firearm from. He brought me down to the was standing to my left and the firearm was wrapped in a white towel o was. He said I could come to his office and pick them up and I did. After picking up the consent forms I proceeded to the NMSP office and met with our evidence technician to retrieve Michael?s firearm and tablet. I picked them up and secured them in the trunk of my vehicle. I brought them back to the NMSP/TR office Michael sisi to process them ¢ fizearm wa identified as a smith & Weeeon SD40 VE, gerial number FDXx6293 magazine was a 13 round capacity 25 photos were taken to include 2 photos of the consent form, nd contained 4 unspent bullets The tablet was a Rugged Combo 3, with a serial number of 2111LZ99G5F8 16 photos were taken of the tablet to include 2 of the consent form I was advised by Agent Gaytan the female involved in this incident went by the name Honey" on Snapchat. While viewing Michael's Snapchat, I observed a conversat: the name "Honey". After opening it, it displayed one message from saying, “hurry up pls". No other messages between Michael and Honey were displayed acl to # ‘The tablet will be taken to the Regional Computer Forensics Laboratory (RCFL) for a forensic download A total of 42 photos were taken to include a cover sheet. These photos will be uploaded and attached to this report ‘The fizearm, magazine, ammunition, and tablet were all packaged separately, sealed with evidence tape, sigi dated. The magazine and anmunition was entered into evidence tracker. The magazine was entered as ITEM #56 and the ammunition was entered as ITEM #55. I then went to room #109 and called the Resident Assistant who was able to call the occupant of the room, Daniel Gallagher. Daniel met us at his room and signed a consent form to search his room for the projectile.
