Jonathan Smith] with intent to prevent the apprehension, prosecution or conviction of himself or
another or to throw suspicion of the commission of a crime upon another, and the highest crime for
which the tampering was committed was a third degree felony or a fourth degree felony or an
indeterminate felony, contrary to NMSA 1978, § 30-22-05(A) & (B)(2).

Smith] with intent to prevent the apprehension, prosecution or conviction of himself or another or to

AFFIDAVIT FOR ARREST WARRANT

The undersigned, being duly sworn, on his oath, states that he has reason to believe that on or
about the 19th, day of November 2022. In the County of Bernalillo State of New Mexico, the above-named
defendant did commit the crime of:

The undersigned further states the following facts on oath to establish probable cause to believe that the
above-named defendant committed the crime charged:

On Monday, November 19, 2022, I, Agent Miguel Gaytan of the New Mexico State Police Investigations
Bureau (NMSP/IB), Zone 3 Albuquerque was contacted by Sergeant (Sgt.) Philip Vargas (NMSP/IB Zone
3) and assigned to investigate a homicide that occurred at 301 Girard BLVD NE Coronado complex, in
Albuquerque, County of Bernalillo, State of New Mexico. This complex is part of the University of New
Mexico (UNM).

BRIEFING:

During the brief I learned, a New Mexico State University (NMSU) basketball player who was identified as
Michael Peake had been shot. I learned Michael was seen on surveillance video walking with a female
outside of the Coronado complex when three individuals walked up to Michael and one individual pointed
a gun at Michael. Two other males stood behind Michael and one of those males hit Michael on his right
leg with a bat. Michael ran and the male with the gun fired at Michael several times. Michael pulled a gun
out from his waist area and shot back at the male who was shooting at him. Michael struck the male and the
male fired back striking Michael on his leg. The un-identified male was identified as Brandon Travis.
Brandon died at the scene and Michael was transported to the University of New Mexico Hospital
(UNMH)

I interviewed Elijah Scott who was the roommate of Brandon. Elijah told me he saw Brandon, a female
who was called Honey, Eli, John and two other females who he did not know in his dorm room, in the early
morning hours.
During the course of the investigation a UNM housing administrator informed me Mya Hill went by the
name Honey. Mya was staying at the Santa Clara dorm in room 214. I made contact with Mya and
conducted an interview.

I conducted an interview with Michael Peake at UNMH. Michael told me he was going to meet with a
female at the UNM campus. The female went by the name Honey. Michael took an Uber to the UNM
campus and met with Honey. Honey and Michael were walking along side a building complex when three
individuals walked up behind them. One individual pointed a gun to his face and told him “run it.”

One male struck Michael with a bat on his right leg. Michael pushed the male with the gun and Michael
ran. The male with the gun shot at Michael. Michael pulled a gun out of his front right pocket and shot back
at the male. The male shot again and struck Michael in the leg. Michael kept running and eventually called
for help.

Mya told me she had been talking to Michael for a while. Mya told me she was going to meet up with
Michael to have sex since he was in town. Brandon Travis is Mya’s friend. Brandon found out Mya was
talking to Michael. Brandon told Mya to set up Michael so he and his friends could jump him, and Mya
agreed. Brandon wanted to jump Michael because Michael and his friends had beat him up badly at the
UNM vs NMSU homecoming game in Las Cruces, New Mexico.

Mya stated that on November 19, 2022, her, Eli, John, and Brandon were in Brandon’s dorm room. While
in his room they all planed on how they were going to beat up Michael. Mya said John and Eli agreed to
“jumping” Michael. Mya said the plan was for her to walk with Michael outside of Coronado Hall
complex and once Brandon, Eli and John “rolled up” on Michael she was supposed to run away and not to
come back.

Mya told me Michael took an Uber to meet her at the Coronado complex. Once Michael was there, Mya
met him outside. Mya and Michael walked by the Coronado complex. Mya stated while they were
approaching the door of the complex three individuals walked up behind them. Mya told me she saw
Brandon point a gun at Michael’s face. She observed another individual hit Michael with a bat on his leg.
Mya walked inside the complex then heard noises, which she later identified as gun shots.

Mya went into the restroom to vomit because she was drunk. Mya then went to Eli’s dorm and then back to
her dorm.

Interview with JONATHAN SMITH:

Jonathan told me Brandon, Eli and he were at a UNM vs. NMSU in Las Cruces, New Mexico. While at the
game Eli, Brandon and Jonathan got into a fight and got jumped. Jonathan stated they knew one of the
people they had fought was Michael Peake who was a NMSU basketball player.

Jonathan told me, Eli, Brandon and he had talked about getting revenge. Mya told them he was talking to
Michael.

On November 19, 2022, Brandon, Eli, Jonathan and Mya were in Brandon’s dorm room. They came up
with a plan to lure Michael on the UNM campus and they were going to beat up Michael. Michael was in
town for a basketball game so they could get revenge on Michael. Mya was texting Michael and being
nasty to get Michael to go to the UNM campus and make him think Mya was going to have sex with him.
Once Michael was on campus, they would beat up Michael. Eli was going to bring a bat to scare Michael,
but he wasn’t going to use it.

Mya told them Michael was at campus and she walked outside to met him. Once Mya and Michael were
walking outside of Coronado Hall Complex together, Eli, Brandon and Jonathan walked up to Michael.
Brandon pointed a gun at Michael’s face. Eli then hit Michael in his leg with the bat. Michael took off
running and began to reach near his waist area. Michael pulled out a gun and shot towards Brandon and
Brandon fired back. Jonathan and Eli took off running.

Jonathan told me he knew Brandon had a gun, but he did not know Brandon was going to bring a gun
because they had never talked about bringing a gun.

They called 911 and pressed the campus help button. Jonathan told me he threw his phone underneath a car
because he knew he could be tracked by it. He and Eli ran along the side of Coronado Hall Complex to a
window. Eli broke the window with the bat, and they entered Coronado Complex.

They ran to Eli’s room which was in the Coronado Complex. Once in the room they changed their clothes
and took the clothes with them. Jonathan made his way to car and drove back to his phone and picked it up.
Eli and Jonathan threw their clothes that they were wearing during the incident in the sewer that was near
Lobo Village. Eli and Jonathan made their way back to where the shots had been fired and saw Brandon
was dead. They blended into the crowd and watched as police tried to help Brandon.

Jonathan stated while they were in the crowd Eli grabbed a male and pinned him against the wall because
he was laughing while they were watching Brandon. Jonathan pulled Eli off the male, and they left.

Jonathan doesn’t know what happed to the bat Eli had. Jonathan last saw the bat when Eli used it to break
the window to get into Coronado Complex.
