COUNCIL AS A WHOLE ORDINANCE NO. $8-2022 AN ORDINANCE ACTING ON THE FACI-PINDER’S REPORT RECEIVED IN CONNECTION WITH THE COLLECTIVE BARGAINING NEGOTIATIONS BETWEEN THE CITY OF BUCYRUS AND THE INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS, LOCAL 1120 AND THE RECOMMENDATIONS CONTAINED THEREIN, AND DECLARING AN EMERGENCY. WHEREAS, the City of Bucyrus, Ohio, is a public employer as that phrase is defined in Chapter 4117 of the Ohio Revised Code and is currently engaged in collective bargaining with the International Association of Fire Fighters, Local 1120; and WHEREAS, representatives of the City of Bucyrus have received a fact-finding report dated ‘Novernber 30, 2022 containing findings and recommendations ofa fact-finder; and WHEREAS, the law of this State provides that when the parties to a collective bargeining agreement receive a fact-finder’s report, the legislative body of the public employer shall mect ‘within seven (7) daysof the date on which the report is received to consider the report and to accept or teject the report and recommendations contained therein; end WHEREAS, the law further provides thet upon failure ofthe legislative body to accept or reject ‘the report, the recommendations are “deemed accepted” by the legislative body as the final resolution ofthe issues submitted to the fact-finder and that such recommendations shall be added. to the successor collective bargaining agreement between the parties; and WHEREAS, the Bucyrus City Council considered this matter on December 6, 2022 during a ‘Regular Meeting; and WHEREAS, the Councils vote will be submitted to the State Employment Relations Board within twenty four (24) hours pursuant to Ohio law; ‘NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BUCYRUS, COUNTY OF CRAWFORD, AND STATE OF OHIO, THAT: Section 1: By virtue of Chapter 4117 ofthe Ohio Revised Code, thia Council, not later than seven days after the fact-finde’s report and recommendations were served on the Patties, does hereby cerfy (1) that it has been provided with said report and recommendations ofthe fact-finder, (2) tat the legislative body has met in open session having done so on December 6, 2022, and (3) that the vote of its ‘membership with regard to the report is as follows: TotalNumber ceVores:_ Votes to Accen_B Votes oRejeet_S Seetion2: An emexseny is herby dele to exist dust the Sct thet Ohio I egies proper procedures and prectces be ratified for the nesesacy employment of ‘uniformed members of the Division of Fire therefore, this Ordinance shall become cffective immediately Page 1 of 2 Passed tis UY day of December, 2022.
