1. Why was this a landmark judgement?


A landmark judgement is a judgement in which clarifies ambiguity in a law. This is what the
judges did in the case of R v. Drybones.

2. Outline the reasons that this case concerned questions of aboriginal rights rather than
unlawful behaviour by an individual.
The law singled out and was biased against aboriginal peoples, due to the fact that the rest of
the population were allowed to be intoxicated in a non-public place. This law ONLY applied to
aboriginals, and was therefore unconstitutional.
