Terms and Conditions | BYJU’S Tuition Centre


1. Eligibility:
If a student has attained the age of 18 (eighteen) years, then he or she shall, and in case a
student is under the age of 18 (eighteen) years, then his / her parent or legal guardian (for
and on behalf of such student under the age of 18 years) shall read these terms and
conditions (“T&Cs”) and accept the same unconditionally prior to availing any Course
(defined below) and Services (defined below) offered by Think & Learn Private Limited
(“Company” or “our” or “us”) at a Byju’s Tuition Centre (“BTC”). For the purposes of these
T&Cs, “you”, “your”, or “yourself” shall mean and refer to a student who has attained the age
of 18 (eighteen) years or in case a student is below the age of 18 (eighteen) years, then his/
her parent and/ or legal guardian, as applicable in the context or meaning there of, and
“Student” shall mean any student notwithstanding the age intending to enrol and avail
Course and Services at BTC.

Consent of parent/ legal guardian : If you have the ability to enter into a legally binding
contract and you approve or consent to the enrolment of Student below the age of 18
(eighteen) years to a Course (defined below) offered at BTC, you represent and warrant that
you are such Student’s parent or legal guardian and you agree to be bound by these T&Cs of
on behalf of such Student, including without limitation being liable for any and all claims and
liabilities arising in relation to such Student availing Course and Services offered by us.
Further, you hereby covenant that you shall cause such Student to avail the Course and
Services strictly in accordance with these T&Cs and all terms contained herein shall be
enforceable against you and you shall be responsible for all losses or liabilities incurred by
the Company due to any breach of these T&Cs by the Student. You hereby acknowledge
that the Company may choose, but is not obligated, to make any inquiries, either directly or
through third parties, that the Company deems necessary to validate your information and
status as parent or a guardian, unless required under applicable law.

2. Application and Enrolment:


To enrol for a Course at a BTC, the application form must be completed, signed by you and
submitted along with two recent passport size colour photographs affixed on the
admission form and such other documents as the Company may reasonably request in
order to complete the enrolment process. Enrolment at a BTC is on first - come - first -
served basis, subject to availability of seats at such BTC. Any incomplete forms shall be
rejected and no claims shall be entertained in that respect.

3. Course and Services:


The Company will initially offer Mathematics and Science course for class 6 to 10 in
CBSE, ICSE, NIOS, State Boards and IB (each a “Course”). For latest information on the
Courses offered by the Company at BTC and fees applicable in relation thereto, please
check at your nearest BTC. For the purposes of these T&Cs, “Services” shall mean all
services and content provided by the Company as part of the Course.

The Course and the Services offered are for individual use only. Commercial use of the
Course and the Services or broadcasting the Course and the Services through any
means, including but not limited to through the internet, television, handheld devices
and other devices, is not permitted, and is a breach of the intellectual property rights of the
Company. The Company reserves the right to initiate legal proceedings in the case of such a

breach.

It is expressly clarified that all intellectual property rights including but not limited to
copyright, patent, trademarks, trade secrets in the products, modules, contents and
programs shall continue to vest within the Company at all times. You shall not have the right
to claim any rights over the intellectual property in the Course and the Services by virtue of
purchasing the same. You acknowledge that a breach of this clause may cause irreparable
harm to the Company as to which monetary damages may be difficult to ascertain or may
not bean adequate remedy and that the Company will have the right, in addition to its other
rights and remedies, to seek injunctive relief for any violation of the clause.

The Company reserves its right to make any alteration in its programs, venue, timing and
days of classes without any prior notice to you or the concerned Student.

4. Change in Course/ Branch:


If an enrolled Student wishes to change the Course or avail Course from another BTC (i.e.
other than the BTC he/ she enrolled at), then please write to support@byjus.com. Any such
request may be considered and approved at the sole discretion of the Area Business
Head subject to availability of seats and the same cannot be claimed and/or
demanded as a matter of right. For any issues arising in relation to a change request, the
decision of the Area Business Head shall be final and binding on you.

Please note where such change is from a Course with higher fee to a Course with lower fee,
for any queries pertaining to applicable refund, please refer to clause 7.

5. Conduct of Student:
1. ID Cards: Each Student will be issued an identity card and the concerned Student is
required to carry the 2 same while at BTC. Right to admission of a Student at BTC is
strictly subject to Student carrying his/ her ID card.

2. Students are required to either switch off or keep their mobile phones on aeroplane mode
while at BTC. We shall not be held responsible for any loss or theft of mobile phone
or any other personal device or belongings that a Student carries to BTC.

3. In case teachers are of the opinion that a Student is not maintaining discipline and
decorum at BTC, bullying other Students, posting or spreading wrong and negative
messages about BTC or the Company on any media, or undertaking any other actions
which brings disrepute to or defames the Company/ BTC then he/ she may be expelled
from BTC. The decision of the Area Business Head shall be final and binding on you. No
fees or any portion of thereof shall be refunded in such cases.

6. General Conditions:
1. Students should reach on time to attend their scheduled classes. Late comers may not
be permitted entry into the classroom.

2. In case a Student misses any class on account of a genuine reason (as determined by
the Company in its sole discretion), he/she may request the counsellor at the concerned
BTC to allow him/her to attend the same class in another batch at the same BTC. The
Company will on a best efforts basis accommodate any request for arranging an
alternate class for the class missed on account of a genuine reason and the same
cannot be demanded as a matter of right.

3. Unless otherwise communicated by the Company, you will have access to the content

provided as part of the Course until the month and year of validity specified in this form
and certain courses/ programs by the Company may have a view count restriction.

4. If SD card is lost/misplaced post-delivery, you may request for a new SD card by paying
for the same. On receipt of such request, the Company will disable / lock the misplaced
SD card. You undertake to provide any necessary assistance as may be required by the
Company for the same. The content SD card will be replaced for INR 2,500 each, which
price may be amended modified from time to time at the sole discretion of the
Company.

5. If any tablet is provided as part of the Services, the warranty of the tablet will be
valid only when the original tax invoice is presented together with the defective
product. This warranty will not apply if the type or serial number on the product has
been altered, removed or defaced. Further, please note that tablet warranty extends
only for the defects/ damages covered within the warranty provided by the
manufacturer. Any problems related to the tablet will be rectified/replaced by the
device manufacturer only, and the Company shall not be liable for the same.

6. Force Majeure: The Company shall not be held liable for any loss and/or damage of life
or property due to any mishap and/or accident at a BTC due to reasons beyond the
control of the Company, such as natural calamity, fire/electric short circuit,
pandemic,etc. In case the Company is unable to conduct classes at a BTC due to
Government restrictions, the classes will be conducted in online mode till such
time the restrictions are lifted.

7. The Company may contact from time-to-time through SMS, WhatsApp, email and call to
give notifications on various important updates. You agree not to hold the Company
liable for any liabilities including financial penalties, damages, expenses in case your
or the concerned Student’s mobile number is registered with Do Not Disturb (DND) or
National Do Not Call (NDNC) registry database. Further, youdisclaim any claims and
waive and release any rights against the Company in this regard.

8. Course material: Each workbook and any other course materials offered as part of the
Course and Services is checked thoroughly to rectify errors before it goes for printing.
However, please note that the same may not be entirely free from misprints or errors. In
case a Student notices any misprints or errors, please in form us by writing at
support@byjus.com .Further, please note that no part of any material provided as part of
the Course and Services may be reproduced, distributed, or transmitted in any
form or by any means, including photocopying, recording, or other electronic or
mechanical methods, without the prior written consent of the Company.

9. In addition to these T&Cs, please note that you shall,notwithstanding anything stated in
https://byjus.com/tnc_app/#tncdesc and https://byjus.com/tnc_app/#privacydesc, be
bound only by the detailed terms and conditions available at https://byjus.com/btc/
detailedterms (“DetailedTerms”). In case of any inconsistency between these T&Cs and
the Detailed Terms, the T&Cs shall píevail.

10. For any change of address or contact details, you shall notify us without any
delay through a written application or by reaching out to us on our customer care
number +91 9243500459.

7. Refund Policy:
For queries pertaining to any refunds, please referto our Refund Policy available at https://
byjus.com/btc/refund-policy.

8. Publicity:
In consideration of the Course and Services offered by the Company, you hereby grant the
Company and its affiliates non-exclusive, royalty free, worldwide right to use the
Student’s name, likeness, image, voice, performances and/or movements, registered and/
or captured by means of photographs, audio, sound recordings, visual recordings,
video recordings (“Identifying Material”) in connection with the promotion of BTC and the
Company’s products and services, including Course and Services on any media. You agree
to release the Company and its affiliates from any and all present and future claims for
equitable and legal relief and for compensation for the use, in any media, now known or
hereafter developed, of the Identifying Material, as originally created, or as modified, altered,
edited or amended as determined by the Company and its affiliates. The Company and its
affiliates rights shall include, without limitation the right to use the Identifying Material
on such social media channels, including, without limitation, Instagram, Twitter, Facebook,
Pinterest and others, and in motion pictures, television or other commercials,
documentaries, podcasts, as the Company and its affiliates may determine.The Company
and its affiliates may freely use, revise, arrange, rearrange, adapt, modify, reduce, substitute,
add to, subcontract from, associate, make derivative works from, change the fundamental
nature of and merge the Identifying Material with other elements in any manner and on all
medium which the Company and its affiliates may determine in its absolute discretion.

9. Dispute Resolution:
For any grievances arising in relation to the Course and Services at BTC, please
write to support@byjus.com. Alternatively, you may also submit your grievance at the
concerned BTC during office hours. Where any grievances/ complaints are not
addressed to your satisfaction or in case of any dispute or difference between you
and us arising in relation to these T&Cs, the same shall be referred to a sole arbitrator
appointed by the Company. The seat and venue for the arbitration proceedings shall
be at Bengaluru. The arbitration shall be conducted in accordance with Arbitration and
Conciliation Act, 1996. Subject to the arbitration provision contained herein, the courts in
Bengaluru, India shall have exclusive jurisdiction over any disputes arising in relation to
these T&Cs.
