Legal Writing and Analysis

Section 1

The creation of BARMM has raised hopes that the Bangsamoro will have a chance at genuine self-
governance that it has been fighting for decades. And the BTA creation of the BOL or Bangsamoro
Organic Law (R.A Act. No. 11054), which in turns in the product of at least 17 years of peace negotiations
between the Philippine Government and the MNLF, followed by the crafting of a law that was ratified by
the people through plebiscites. The Bangsamoro Organic Law does not categorically limit the term of the
interim parliament of the BARMM to three years. The said 3 years’ term limit is imposed on the regular
Parliament.

The BTA (Bangsamoro Transition Authority) should have more time at least until 2025 to complete its
mandates, inasmuch as its activities have been greatly upset by the COVID-19 Pandemic. Some member
of the BTC (Bangsamoro Transition Council) said that, when the BTA was formed, they already had the
challenge of time and how much more now considering the existence destructions and challenges
brought by the COVID-19 pandemic that really affects the implementation of their mandates. Hence, the
extension of the BTA (Bangsamoro Transition Authority) should push through.

On the other hand, to permit the extension or augmentation of the Transition period would be
commensurate to get away from judgment by the constituents of the BARMM (Bangsamoro
Autonomous Region of Muslim Mindanao) on the exhibition of the last visa-a-vis its ability to manage or
administered a region, and would be a barefaced forswearing of individuals' privilege or right of suffrage
that is revered in the Constitution to which the BOL (Bangsamoro Organic Law) has been consolidated
into.
