Constitution of Cantonment Authorities under the Cantonments Act, 1924. Siz, Tam directed (0 inform you that after considering the opinions received in reply to Army Department letter No. 24570-1 (A. D), dated the 27th August 1922, on the subject noted above, the Givernment of Indi hare decide! that’ the form of constituticn. t9 be adoptéd for each of the eanton- ments which will be governed by the Cantonments Ast, 1924, shall at the outsct be as stated in the schedule attached to this letter. 2. It will be observed from/the achéilile that the Cantonments Act, 1924, Till not be applied to certain exiting eantonsients, and that in the canton ‘ments to which the Act will be applied, the constitution will take one or other of the following forms :— (@) No Cantonment Board will bs created and the Cantonment Autho- rity will be a Corporation Sole (section 12(2), Cantonments ‘Ack, 1924), (6) A. Cantonment Board will be created and will consist of official and son-oficial (nominated) members in the proportions prescribed in Section 14 of the Cantonments Act, 1924. @pA Cantonment Board will be ereated and will consist of official “and non-official (elected) r.euibers in the proportions prescribed «7 in seotion 14 of th Cantoments Act, 1924. 3: The Governor General in Council will, in due course, by notification inthe Gazette of india, direct the creation of Cantonment Boards in the cautonments to which this form of alministration is to be applied, the sation of the Board to have effect from the date on which the Sprtutaneck Aafeaane tion oF election cf members, as the case may be, is completed by the com authorities ucder the procedure laid down in the Cantouments Act, 1924. Further details of the arrangements to be made in each of the three eategories of eantonments are given in the suceteding paragraphs of this letter for the information and guidance of all concerued. 4. The Corporation Sole—Prom the date the en A comes into force, i.e, 1st May 1924, the Commandi ag Onoe te Contest ment will assuine the functions and responsibilities of Oeaiectoatd A undor the Act and will conticue to administer the affairs of the accordance with the Act.5. The Nominated Board.—The Commanding Officer of the Cantonment will temporarily administer the cantonment aaa Corporation Sole in the Brst instance, i, until such time ns— () the local Government hare by notification made the declaration specified in the proviso to section 14 of the Cantonments Act, 1924; and (ii) the District Magistrate has nominated a Ist Class Magistrate to be ‘a member of the Cantonment Board (section 14 (1) (5) of the Cantonments Act, 1924) ; and (idi) the local Government acting in consultation with the Officer Cor manding-in-Chief the Command have nominated the non- official members of the Board. It is expected that these formalities will be completed and that the ad- ministration of the eantonmont by the Cantonment Board will commence within a very short space of time after the Cantonmenta Act comes into force. 6. The Elected Board.—The Commanding Officer of the Cantonment” will |i temporarily admicister the cantonment as a Corporation Sole in) the first || instance, z-e., until such time as the appointment, nomination snd electioa of ‘| the members who are to compose the Board have been carried out. In this | case, a certain ammount of delay'is bound to occur before the Board can be formally constitated, as ia the first instance, election rules have to be framed by the local Governments and further, in order that persons may qualify for enrolment as electors under section 27 (1) (a) of the Cantonments Act, 1924, it will be necessary for them to be assessed to taxation under the new Act. Instructions are being issued separately to the local Governments indicating the manner in which the delay ean be reduced tos minimum. It ig, of course, the desire of the Government of India that the elected Boards should be brought into peing aud conmence their work as soon as possible, 7. An Executive Officer for each eantonment will be appointed by the thority specified in this behalf, i, the whole-time Executive Officers will be appointed by the Governwrent of India and the part-time Executive Odicers will be appointed by the General Officers Commanding-in-Chief the Commands, vide paragraph 5 of Army Department letter No. 26314—1 (A. D.), dated 3rd March 1924. The General Officers Commending-in-Chief the Commands should be directed to take steps to ensure that ip each case the part-time Executive Officer is ready,to enter upon his new duties with effect from Ist May 1924. 8, You will receive a separate communication in due course regarding the action, if any, required to be taken in respect of those existing cantonments to whieh’the Cantonments Act, 1924, will not be applied.
